ALBANY.

The CHARTER of this city was granted, as is express. ed therein, "at the humble petition of the Justices of the Peace of the said town of Albany," to the inhabitants thereof, "by the name or names of The Mayor, Aldermen, and Commonalty of the City of Albany," by THOMAS DONGAN, Governor, July 23d, 1686, in the second year of the reign of JAMES II.

Its officers are a Mayor, Recorder, Aldermen, Assistant Aldermen, Supervisors, Assessors, Collectors and Constables, Treasurer or Chamberlain, Sheriff, Coroner, Clerk of the Market, High Constable, sub-Constable, Marshal or Sergeant at Mace. These are the officers named in the Charter.

There are five Wards in this City, each of which is entitled to elect two Aldermen, two Assistants, one Supervisor, one Assessor, one Collector, and two Constables.

Two Aldermen, two Assistants, and one Constable are to be annually chosen in each of the said wards on the last Tuesday of September; and one Supervisor, one Assessor, and one Constable in each of the said wards, annually on the first Tuesday of May.

The officers holding any city election are required to give five days previous notice of the time and place where such election is to be holden, in at least three public places in each ward.

The Mayor, Recorder, Aldermen, and Assistant Aldermen, in this, as in the other cities in this state, constitute the Common Council.

The MAYOR is annually appointed by the Common Council, and holds his office for one year, or until another be appointed and sworn in his stead.

The Aldermen, Assistants, and Chamberlain, are to be sworn into office on the second Tuesday of October in each year, or as soon thereafter as they shall attend in Common Council.

The RECORDER is appointed by the senate, on the nomination of the governor, and holds his office for five years.

ROBERT LIVINGSTON was the first town clerk of the city of Albany, and was appointed by Governor DONGAN at the time of granting the charter.

The Aldermen are ex officio Justices of the Peace. Any Alderman in the city of Albany is authorized, under the law of the state relating to Justices of the Peace, to try any action for the recovery of a penalty to the amount of twenty-five dollars or under, incurred by or under any By-law of the city, but he has no other jurisdiction by virtue of that law.
