CHAPTER 279.

AN ACT to amend an act, entitled, an act to amend the charter of the Owingsville and Big Sandy Turnpike Road Company.

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That, hereafter, when any part of the Owingsville and Big Sandy Turnpike Road, that passes through the counties of Fleming, Bath, and Greenup, shall be out of repair for the space of ten days, it shall be lawful for any person to make complaint, before two Justices of the Peace, in the county in which said road passes, and is alledged to be out of repair: and upon satisfactory proof being made, before said Justices, that said road is out of repair, in said county, the said Justices shall issue a summons against the lessee of said road, to appear before the County Court of said county, where the complaint is made; and said lessee shall be served with notice at least ten days before the sitting of said Court to which application is made.

SEC. 2. That the lessee of said road shall be governed by the laws and regulations which existed at the date of his contract with the Board of Internal Improvement.

SEC. 3. That the act, approved 1844, regulating said road,

so far as relates to the counties of Fleming, Bath, and Greenup, be, and the same is hereby, repealed.

AN ACT to incorporate a Turnpike Road Company in the county of Greenup, and for other purposes.

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That a company shall be, and the same is hereby, formed, for the purpose of making a turnpike road from the mouth of Big Sandy to Springville, in Greenup county, under the style of the Big Sandy and Springville Turnpike Road Company.

shall be thus organized, they shall be, and are hereby, declar-
ed a body politic and corporate, in deed and in law, by the
name and style of the President, Directors and Company of
the Big Sandy and Springville Turnpike Road: and by that
name, the said subscribers shall have perpetual succession, and
all the privileges and franchises incident to a corporation, and powers,
shall be capable of taking and holding said capital stock, and
the increase and profits thereof, and of enlarging the same,
from time to time, by new subscription or subscriptions, in
such manner and form as they shall think proper, if such en-
largement shall be found necessary to fulfil the intent of this
act, and of purchasing, taking, and holding, to them and their
successors and assigns, and also of selling, transferring, and
conveying, in fee simple, all such lands, tenements, heredita-
ments, and estates, real and personal, as shall be necessary to
them in the prosecution of their work; and of suing and be-
ing sued, impleading and being impleaded, answering and be-
ing answered, defending and being defended, in courts of re-
cord, or any other place whatever; and also to make, have,
and use, a common seal, to break, alter, and renew the same at
pleasure; to make such by-laws, rules and regulations, not in-
consistent with the laws and constitution of this Common-
wealth, and of the United States, as shall be necessary for the
well ordering the affairs of said Company, and to do all and
every other matter and thing which a corporation or body pol-
itic may lawfully do.

SEC. 5. That the whole width of said road shall be forty feet; the graded part shall be twelve feet in width, and made on the plan of the Owingsville and Big Sandy Turnpike Road, and regulated by the laws governing the same, in relation to erecting gates on said road, and charging tolls.

SEC. 6. That as soon as said Company are organized, they may proceed to erect any bridge or bridges, on said road, across bridges any stream; and as soon as any of the bridges shall be completed, the road Company shall be authorized to demand and receive, by their proper agents or officers, the toll that is now allowed, by law, for crossing said stream or streams; and said Company are hereby authorized to make any change in said road, that they may desire, leading from the mouth of Big present road. SEC. 8. AN ACT to establish a State Road from Canton, in 'Trigg county, to Mills'
Point, in Fulton county.

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That James Stone, Charles Curd and ers. John G. Grayham, of Calloway county, Dennis Kelly, W. A. Bowdon and George W. Pirtle, of Graves county, be, and they are, hereby, appointed Commissioners to view and mark out the best and most practicable route for a State road from Canton, in Trigg county, to Mills' Point, in Fulton county; and road. said Commissioners shall meet at Canton, on the first Monday in April next, or as soon thereafter as practicable, and after meet, &c. being first duly sworn, faithfully and impartially to discharge the duties assigned them by this act, shall proceed thence to view and plainly mark the nearest and most practicable route for said road, to the town of Murray, in Calloway county, and from thence, to intersect the road leading from Boydsville to Feliciana, at or near the widow Hanley's, and thence, with said road, to Feliciana, and thence, with the State road, to Mills' Point, in Fulton county; and said Commissioners shall report the result of their proceedings to the County Courts of Calloway and Graves counties, describing, as near as practicable, the ground on which said road may be viewed; and in the event all the Commissioners shall not attend at Canton, on the day above named, a majority of those appointed shall be competent to perform the duties assigned them by this act.

SEC. 2. That it shall be the duty of the Calloway and Graves County Courts, as soon as practicable, after said road has been viewed, and a report of the same made to their respective Courts, to lay off said road, or so much thereof as may lie in their respective counties, into convenient precincts, appointing Surveyors for the same, and allot to each a sufficient number
