or of the sums furnished and advanced by each Subscriber towards the making and completing the said Harbour, together with such further sum as will amount to twenty-five per cent. upon the monies so advanced and paid, as a full indemnification to such Company; and the said Harbour shall from the time of such assumption in manner aforesaid, appertain and belong to His Majesty, His Heirs and Successors, who shall from thenceforth be substituted in the place and stead of the said Company, upon the conditions, and subject to any Act of the Legislature of this Province that may be passed for or respecting the same: Provided always, that it shall not be lawful for His Majesty, His Heirs or Successors, at any time after the expiration of the said fifty years to assume the possession and property of the said Harbour, with its appurtenancesas aforesaid, unless it shall appear from the accounts of the said Company, to be for that intent laid before the Legislature, that the Stockholders of the said Company have received every year, upon an average, the sum of Twelve Pounds, Ten Shillings, for every One Hundred Pounds they shall be possessed of in the said Company.

XVII. XVIII. And be it further enacted by the authority aforesaid, That nothing herein contained shall give the said Company, or be construed Company to enjoy no to give to the said Company the exclusive right of fishing within the exclusive right of said Harbour or Lake shore, within the limits hereinbefore mentioned; and that it shall not be lawful for any person or persons to take, catch or kill, or to attempt to take, catch or kill any Fish by torch or fire-light, within one hundred yards of any work erected by the said Company.

XIX. And be it further enacted by the authority aforesaid, That if, any person or persons shall be duly convicted by the oath of one or more fish near the Harbor,

credible Witness or Witnesses, before any two of His Majesty's Justices for the said District, of having so caught or killed, or so attempted to catch or kill any Fish in manner aforesaid, such person or persons respectively, upon conviction as aforesaid, shall forfeit and pay a sum not exceeding Five Pounds, nor less than Five Shillings, for every offence so committed, with all reasonable costs both before and after conviction, or in default of payment to be committed to the common Gaol of such District, as aforesaid, for a term of not more than thirty days, nor less than two days, unless the fine and costs are sooner paid.

CHAP. XXIV.

AN ACT to explain and repeal part of an Act passed in the first year of His present Majesty's Reign, entitled “ An Act to erect the County of Prince Edward into a Separate District.”

[Passed 13th February, 1833.]

WHEREAS by an Act of the Legislature of this Province passed in the first year of His present Majesty's Reign, entitled "An Act to erect the County of Prince Edward into a Separate District," it is amongst other things enacted, that so soon after the passing of the said Act as the said County of Prince Edward shall have paid into the Midland District Treasury, out of the Assessed Rates and Taxes now or hereafter raised within said County, the full sum of Six Hundred Pounds, it shall be and be taken to be in full satisfaction for all arrears of said loan and interest thereon to be contributed and paid by the said County towards the said Midland District Debt: and whereas the sum of Six Hundred and twenty-four Pounds, twelve Shillings and ten Pence, was paid by the said County into the said Midland District Treasury up to the time of holding the General Quarter Sessions in said District in the month of April next after the passing of the said Act, out of the Assessed Rates and Taxes of the said County for the year one thousand eight hundred and thirty and whereas doubts have arisen whether the said Rates of the said County for the year one thousand eight hundred and thirty were applicable towards the payment of the said Six Hundred Pounds mentioned in the said Act, or whether the same should be considered as belonging to the Midland District Funds :-Be it therefore enacted, by

the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Upper Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of Great Britain, entitled "An Act to repeal certain parts of an Act passed in the fourteenth year of His Majesty's Reign, entitled 'An Act for making more effectual provision for the Government of the Province of Quebec in North America, and to make further provision for the Government of the said Province,'" and by the authority of the same, That Six Hundred Pounds of the aforesaid £600 to be received sum of Six Hundred and twenty-four Pounds, twelve Shillings and ten District in lieu of all Pence, so paid by the said County at the time aforesaid after the passing Edward. of the said Act shall be, and be taken to be, in full satisfaction of the proportion so to be contributed and paid by the said County of Prince Edward towards the said Midland District Debt, any Law, usage, or custom to the contrary in anywise notwithstanding.

CHAP. XXV.

AN ACT to authorise the Magistrates of the Eastern District to borrow a further sum of Money for the completion of the Gaol and Court House in the said District, and for inclosing the same; and also to empower the said Magistrates to continue the Assessments already imposed for building the said Gaol and Court House, until the Money so borrowed shall be repaid, with the Interest thereon.

WHEREAS it is expedient to enable the Magistrates of the Eastern

District to borrow a further sum of money for the completion of the
Gaol and Court House at Cornwall, in and for the said District, and for Freamble.
inclosing the same, and also to empower the said Magistrates to con-

ers of said District by the fifth clause of an Act passed in the Eighth
year of His late Majesty's Reign, entitled "An Act to provide for the

II. And be it further enacted by the authority aforesaid, That so continued until debt much of the fifth clause of the said Act passed in the Eighth year of His late Majesty's Reign as empowers the Magistrates of the said District in General Quarter Sessions assembled, to levy by Assessment, an additional rate upon every Inhabitant Householder in the said District, for the crection of the said Gaol and Court House, be, and the same is hereby continued for such term of years as may be necessary to repay the said sum of money and Interest, and no longer.

III. of the Reign of His late Majesty, entitled, "An Act for the relief of
the sufferers who sustained loss during the late War with the United
States of America," and also of a certain other Act passed in the same
year, entitled "An Act to authorise the Receiver General of the Pro-
vince to raise by Debentures, on the credit of certain Duties therein
mentioned, a Sum of Money for the relief of the Sufferers during the
late War with the United States," and for affording further relief to
the said Sufferers.

Preamble.

WHEREAS a certain Act of the Parliament of this Province, passed in the Eleventh year of the Reign of His late Majesty King George the Fourth, entitled "An Act for the relief of the sufferers who sustained loss during the late War with the United States of America," and also a certain other Act of the Parliament of this Province, passed in the same year, entitled "An Act to authorize the Receiver General of this Province to raise by Debentures, on the credit of certain Duties therein mentioned, a sum of money for the relief of the sufferers during the late War with the United States," have been found ineffectual for the purposes intended, and it is expedient to repeal the same: We therefore beseech Your Majesty that it may be enacted, And be it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Upper Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of Great Britain, entitled "An Act to repeal certain parts of an Act passed in the fourteenth year of His Majesty's Reign, entitled 'An Act for making more effectual provision for the Government of the Province of Quebec, in North America, and to make further provision for the Government of the said Province," and by the authority of the same, That the said Acts, and every clause, Part of 11 Geo. 4, matter and thing therein contained, be, and the same are hereby re- ch. 21 & 22, repented. pealed, save and excepting so much thereof as continues the Duty upon Salt and Whiskey, which shall, after the passing of this Act, be paid
