Mr. Kaltman: That is objected to on the ground

By Mr. O'Rourke:

Q. Then you didn't see him after that, did you? A. No.

Q. Do you know anything about this woman that he carried, that you also helped to carry? A. She is an elderly woman, about seventy years old.

Q. Do you know anything else about her? A. No. I know two boys took her down to a taxi and took her home.

Q. Do you know how they took her down? A. They carried her to the taxi.

Q. Do you know whether she was able to walk at the time? A. No, she wasn't.

Q. How do you know that?

A. Because she

couldn't get off the couch when I was with her.

Q. Did you ever hear anything about the history of this woman? A. No, I did not.

Q. How soon after the explosion took place was it you saw him carrying this woman? A. It happened about ten o'clock.

Q. Was he carrying this woman immediately after the explosion took place? A. Right after. She was trampled down with all the people.

Mr. Kaltman: I move that be stricken from the record. It is not responsive.

Q. Did you see them trampled down? A. No.

Mr. O'Rourke: That's all.

Cross-examination by Mr. Kaltman:

Q. You don't know whether he carried her over to the point where you saw him or not? A. I was called by him.

Q. After that time you know-prior to that you were in the ladies' room, you don't know whether he carried her or not, do you? A. All I know he yelled for me. He had her in his arms.

Q. He had her in that particular place? A. Yes. Q. In other words he called you there. Whether he carried her to that particular point you don't know? A. No.

Q. You said that he had her by the right arm and you took her left arm? A. Yes, because I came out of the ladies' room.

Q. Did you walk her over to the couch? A. I helped her. She was very heavy on my arms when I helped her. She couldn't walk.

Q. You had her by the left arm and he had her

by the right arm? A. Yes, sir.

Q. I take it you mean by that she was between two of you? A. Yes, sir.

Q. And you were dragging her along the floor? A. Yes, sir.

Q. But her feet were on the floor? A. Yes, sir. Q. So when you said he had his arm around her you mean that he had the woman resting? A. He had her over on his thigh.

Q. Over on his thigh. He wasn't walking with her? A. He dragged her into the ladies' room.

Q. With your help? A. Yes.

Q. But at the time you saw her he wasn't holding her in his arms off the floor, she was propped up against his side? A. Yes.

Q. With the weight of her body on his side, on the floor? A. Yes.

Q. Was he against the banister? A. No, he was right up on a little alcove up against the little veranda, a pole.

Q. He was up against a pole? A. He fell against the pole.

Q.

Were they both resting against the pole? A. No, just him.

Q. He was resting on the pole, and she was resting up against him? A. Yes, sir.

Q. But his feet were on the floor? A. Yes, sir.

Q. You took her left arm, he had the right arm and you brought her up in the ladies' room? A. Yes, sir.

Q. A distance of fifteen feet? A. Yes, sir.

Q. What he did before that with any of the other patrons you don't know? A. No.

Q. What he did after that you don't know either, do you? A. No, sir.

Q. Was there much of a crowd around at that particular time? A. Yes, sir.

Q. There were a great many people? A. Yes, sir.

Q. Were there many people? A. The theatre was crowded.

Q. Were there many people there at the particular time when you saw DeVellier and the old lady? A. There were some people in the ladies' room.

Q. Were there any people outside near the veranda or alcove? A. I didn't take notice. I was in the ladies' room all the time.

Q. When you came up? A. I was helping him. I didn't notice how many people were there.

Q. Didn't you notice whether there were any people? A. When I ran out of the ladies' room-when I got down in the show I noticed the people.

Q. When you came out of the ladies' room and heard DeVellier call you were there any people around? A. Not by the ladies' room. There were some in the ladies' room.

Q. Were there any people around the place where DeVellier and the lady were? A. There must have been, but I cannot say how many.

Q.

There were more than two? A. Oh, yes.

Q. There were quite a crowd around that particular point? A. Yes.

Q. Nobody volunteered to help DeVellier? A. No, I helped him.

Q. A lot of people were around there. She was propped against you? A. He yelled for me to help.

Q. Your mother was there too? A. Yes.

Q. Wasn't she in the ladies' room at the time? A.

Yes. Q. When you and DeVellier came in with the old lady your mother was in the ladies' room? A. Yes. Q. Were there any other people sick in the ladies' room? A. Yes, two people, and a woman with her legs badly hurt.

Q. Who brought those people in there? A. My mother was helping the woman with her legs badly hurt.

Q. Who brought them in there? A. I don't know. Q. Were you in there during the time they were brought in? A. I just helped Mr. DeVellier. I didn't see who brought them in at all.

Q. How long were you in the ladies' room? A. Most of the evening, from ten o'clock all evening.

Q. How long prior to the explosion were you in there? A. After?

Q. Before the explosion? A. I ran up to my mother. We didn't know what happened.

The Referee: Before the explosion were you in the ladies' room?

Witness: No, I was out in the show when the explosion happened.

By Mr. Kaltman:

Q. In the balcony? A. Yes.

Q. Then the explosion occurred? A. Yes.

Q. What did you do? A. I immediately ran up to the ladies' room and I was called by him.
