within the corporate limits of said town shall have the right to vote. The question to be propounded to each voter shall be, "Are you in favor of adopting the charter of the town of Flemingsburg, passed by the two Houses of the State Legislature of this State at the session of 1879-'80 ?" If a majority of the said voters who vote at said election shall vote in favor of the adoption of said charter, then this act shall take effect from and after the eighth day of August, 1880.

§ 39. If a majority of such voters shall vote in the negative at said election, then this act shall be and remain null and void.

CHAPTER 1320.

AN ACT to incorporate Fountain Tent, No. 137, National Order of Rech

abites.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the present officers, and their successors and associates, be, and they are hereby, created a body-corporate, by the name and style of Fountain Tent, No. 137, National Order of Rechabites; and they, and their successors and associates, shall so continue and have perpetual succession; and by that name are made capable in law as natural persons to sue and be sued, plead and be impleaded, contract and be contracted with, answer and be answered, in all courts of law and equity in this Commonwealth or elsewhere; to make, have, and use a common seal, and the same to break, alter, or amend at pleasure; they may make and ordain regulations and bylaws for their government, and those now in force in said Tent to alter when deemed proper, and may change and renew the same at pleasure: Provided, They be not in contravention of the Constitution and laws of the United States or of this State.

§ 2. That said corporation shall have power and authority to acquire and hold real and personal estate, not

exceeding ten thousand dollars in value at any one time, and may, if deemed expedient, from time to time, sell and convey the same, or any part thereof, and to reinvest and dispose of the proceeds.

§3. The right to alter, amend, or repeal this act is hereby reserved to the General Assembly; but the repeal shall not deprive the persons interested of the property or effects acquired or held under this act.

§ 4. No private property of any member shall be liable or responsible for the corporate debts.

§ 5. This act shall take effect from its passage.

CHAPTER 1321.

AN ACT to amend an act, entitled "An act to create the police court of the town of Winchester, in Clark county."

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That an act, entitled "An act to establish the police court of the town of Winchester," be, and the same is hereby, so amended, that whenever there shall be a vacancy in the office of police judge for said town, either by resignation, removal, or by death, or by any other cause whatever, that it shall be lawful, upon the chairman of the board of trustees for said town certifying that fact to the Governor, for the Governor to fill said vacancy by appointment until the next regular election had in said. town for trustees and police judge. That the person appointed to fill said vacancy shall be governed and regulated by the law that now regulates said office.

§ 2. This act to take effect from and after its passage. Approved April 29, 1880.

CHAPTER 1322.

AN ACT to amend an act, entitled "An act to prescribe the pay of justices of the peace in Woodford and other counties," approved April —, 1880. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act to prescribe the pay

of justices of the peace in Woodford and other counties," approved April, 1880, be so, amended as to exempt the counties of Bell and Pulaski from its provisions. § 2. This act shall take effect from its passage.

CHAPTER 1323.

AN ACT for the benefit of Wm. Quiggins, of Breckinridge county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor of Public Accounts is hereby authorized to draw his warrant upon the Treasurer in favor of William Quiggins, of the county of Breckinridge, when approved by the Superintendent of Public Instruction, for the sum of twenty-three dollars and fifty cents, to be paid out of the surplus school fund of common school district No. 41, Breckinridge county, it being to cover amount of error in census return for said district in the year 1879. § 2. This act shall take effect from its passage. Approved April 29, 1880.

CHAPTER 1324.

AN ACT to regulate and reduce the toll at Fish Point or Gresham's Ferry, on Rockcastle river.

WHEREAS, The increase of travel and commercial business, consequent upon the completion of the Knoxville branch of the L. & N. R. R. to Livingston Station, in Rockcastle county, obviates the necessity of excessive rates of toll at Fish Point or Gresham's Ferry, on Rockcastle river; therefore,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the rates of toll at said Fish Point or Gresham's Ferry shall not exceed the rates of toll fixed for the Tate's Creek Ferry on Kentucky river.

§2. That it shall be the duty of the county court of Laurel county to enforce the provisions of this act.

§ 3. This act to take effect from its passage.

CHAPTER 1325.

AN ACT for the benefit of F. R. Neal, jr., late sheriff of Washington

county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That F. R. Neal, jr., late sheriff of Washington county, shall have until the first day of December next to collect and pay over to the commissioners of the sinking fund of Washington county the levy made by the county court of Washington county at its October term, 1878, for the purpose of paying the interest and principal of the bonds appropriated by said county for the benefit of the Cumberland and Ohio Railroad Company: Provided, The securities of said Neal shall consent in writing to said extension of time.

§2. This act shall take effect from and after its pas

sage.

CHAPTER 1326.

AN ACT to extend the corporate limits of the town of Salyersville, Ma

goffin county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the southeastern boundary line of the corporate limits of the town of Salyersville, Magoffin county, shall hereafter run as follows: Beginning at the mouth of the State road fork of Licking river; thence up Licking river to the mouth of the Burning Spring fork; thence up said Burning Spring fork to the bridge; thence with the road to the lines of the land of James Power, and with his lines to John Candill's line, and with his line to

the corporate line of said town, on the north side of said State road fork of Licking river.

2. This act shall take effect from its passage.

CHAPTER 1327.

AN ACT to legalize the proceedings of the Breathitt county court of claims at its November term, 1879.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the acts, proceedings, and orders of the Breathitt county court of claims, held in the town of Jackson in the month of November, 1879, and presided over by A. B. Short, a justice of the peace, in the absence of the county judge, is hereby legalized, so far as the same relates to the allowance of claims fixing and laying the county levy of said county for the year 1880. $ 2. This act shall take effect from its passage. Approved April 29, 1880.

CHAPTER 1329.

AN ACT allowing H. J. Spradlin to erect and keep a mill-dam across Little Saudy river at or near Martinsburg, Elliott county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That H. J. Spradlin is hereby given the right to erect and keep a mill-dam across Little Sandy river at or near Martinsburg, Elliott county: Provided, That said dam shall not be built higher than eight feet, and have an apron or slope on its lower side; that the said dam be so built as to be no obstruction to the downward navigation of said stream.

§ 2. This act shall take effect from its passage.
