may deem most convenient and beneficial to said town, and by unanimous vote may close an alley in said town. § 44. The owners in front of or upon whose premises Curbing and side the board of trustees shall order and direct curbing or sidewalks to be constructed, repaired, or relaid, shall make, repair, or relay such curbing or sidewalks at their own cost and expense, and in the manner, with the material, and within the time prescribed by said board of trustees by ordinance or order, duly entered on their records; and if not done in the manner, with the material, and within the time prescribed, the board of trustees may cause the same to be constructed, repaired, or relaid, and assess the expense thereof, and collect the same by warrant and sale of the premises, as in the case of taxes. A suit may also be maintained by the board of trustees against such owner or owners for the expenses of said improvements.

§ 45. It shall be the duty of the board of trustees, at all times, to keep the streets, alleys, lanes, public squares, and places in good order and condition; and for every failure to do so, as well as for every other willful failure to efficiently exercise the powers herein conferred upon them to promote the good order, health, safety, and prosperity of said town and its inhabitants, they shall, for each offense, upon indictment and conviction in the Lincoln circuit court, forfeit and pay, for the use of said town, not less than twenty nor more than fifty dollars; and such fine shall be paid by the members out of their individual estates, share and share alike.

§ 47. All ordinances, regulations, and by-laws now in force in said town, and not inconsistent with this act, shall remain in full force until altered or repealed by the board of trustees after this act takes effect.

§ 48. This act shall not affect or invalidate any act done by the board of trustees or any officers of said town, nor divest their successors of rights of property or otherwise, or liability which may have accrued to or been

created by said corporation prior to the passage of this

act.

§ 49. In addition to the authority and powers herein. granted, the said board of trustees shall have all the power, and shall discharge every duty, and be subject to all the responsibilities and penalties mentioned in chapter 107 of the General Statutes of Kentucky, title "Towns," prescribing the powers, duties, responsibilities of boards of trustees of towns, and the penalties to which they are subject.

§ 50. All acts and parts of acts in relation to the town of Tunnel City, inconsistent herewith, are hereby repealed.

§ 51. This act shall take effect and be in force from its passage

CHAPTER 1143.

AN ACT for the benefit of V. F. Hartis, committee of W. Hartis, a pauper

lunatic of Butler county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor of Public Accounts be, and he is hereby, directed to draw his warrant on the Treasury in favor of V. F. Hartis, committee of Wm. Hartis, a pauper lunatic of Butler county, for the sum of seventy-five. dollars ($75), payable out of any money in the Treasury not otherwise appropriated, being for support of said lunatic for the year 1879.

2. This act shall take effect from its passage.

CHAPTER 1144.

AN ACT to amend chapter 801 of the Acts of the General Assembly for the session of 1869-'70.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the charter of the Murray Male and Female

Institute, located at Murray, Calloway, county, be so amended as to empower the board of trustees of said Murray Institute to grant, upon the recommendation of the president and faculty of said institute, special diplo mas and certificates of qualifications to those students of said institution who have completed the normal course of study in said school.

§ 2. The normal course to include at least all those branches of study in which applications for a State certificate are examined by the State Board of Examiners.

§3. Said certificate shall, when presented to the State Board of Examiners, entitle the holder thereof to a State certificate issued by the State Board of Examiners. § 4. This act to take effect from and after its passage. Approved April 24, 1880.

CHAPTER 1145.

AN ACT for the benefit of the assessor of Garrard county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That the further time until the 20th of May next shall be allowed Harrison Ray, assessor of Garrard county, to return his tax-book.

§ 2. This act shall take effect from its passage.

CHAPTER 1146.

AN ACT to amend an act, entitled "An act for the benefit of the public roads in Meade and other counties," approved February 12, 1880. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act for the benefit of the public roads in Meade and other counties," approved February 12, 1830, be, and the same is hereby, amended, so as to include and extend the provisions of said act to the county of Todd.

§ 2. This act shall take effect from its passage. Approved April 24, 1880.

CHAPTER 1147.

AN ACT for the benefit of A. H. Hogan, late sheriff of Boyd county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That A. H. Hogan, late sheriff of Boyd county, be, and he is given further time, not exceeding six months, in which to return to the Auditor his lists of exonerations, made him by the Lawrence county court for the years 1875, 1876, 1877, and 1878; and upon a fair adjustment of said Hogan's accounts for said years as sheriff, the Auditor is directed to draw his warrant on the Treasurer in favor of said Hogan for whatever amount may be found due him, not exceeding eighty dollars and twenty

nine cents.

§ 2. This act shall take effect from its passage. Approved April 24, 1880.

CHAPTER 1148.

AN ACT to amend an act in relation to taking a vote on the question of "license or no license," and regulating the sale of spirituous, vinous, and malt liquors in Bracken county," approved March 18th, 1878.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That section three of said act be amended as follows: "Druggists shall keep a register or file of all prescriptions filled, as to date, quantity, and to whom sold, which record or file shall be kept open subject to inspection by the mayor, council, or board of trustees, or judge of county court, or any committee appointed by the proper city, town, or county authorities for the purpose of making an inspection of the same."

§ 2. "For any violation of this act the offender or offenders shall be fined not less than twenty dollars nor more than fifty dollars, to be recovered before any mayor, police judge, magistrate, or county judge of said county, without the intervention of a grand jury."

§3. This act shall take effect from its passage.

CHAPTER 1149.

AN ACT for the benefit of common school district No. 57, Warren county. WHEREAS, The school commissioner of Warren county, through mistake, failed to report to the Superintendent of Public Instruction six children reported to him by the trustee of district No. 57, for the school year ending June 30, 1879, by which the teacher of said district failed to receive pay for the same, to which he was justly entitled; therefore,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the sum of seven dollars and fifty cents be paid said teacher out of the interest due on the Warren county bond, for the school year ending June 30, 1879, and the commissioner be authorized to draw his draft upon the Auditor for said amount, which, when countersigned by the Superintendent of Public Instruction, the Auditor shall issue his warrant upon the Treasurer in favor of said teacher for said sum, to be paid from the aforesaid fund.

§ 2. This act to take effect from its passage.

CHAPTER 1150.

AN ACT to incorporate the Father Matthew's Total Abstinence Society, of

Maysville.

Be it enacted by the General Assembly of the Commonwealth

of Kentucky:

§ 1. That the officers and members, and their successors, of the Father Matthew's Total Abstinence Society, of Maysville, be, and they are hereby, incorporated, and by that name shall have perpetual succession; shall have power to make and use a common seal, and alter same at pleasure; to contract and be contracted with, sue and be sued, plead and be impleaded, in any court having jurisdiction; to take and hold, by gift, grant, or devise, any real or personal estate, not exceeding ten thousand dollars; to have power to sell and convey same, or any
