8. Said board of directors are authorized to establish and erect toll-gates on said road when one mile of it has been completed and examined by three magistrates of the county of Daviess in no way interested in said road, and who shall be appointed by the judge of said county court of Daviess county, who, with the aid of a compe· tent engineer, shall view said road and report its condition to the county court. The said justices and engineer shall be paid, each, by said company, one half dollar per mile for every mile they examine; and upon its appearing that said road has been constructed according to law, and as directed herein, the said county court shall make an order authorizing a gate or gates to be erected and established and the collection of tolls.

§ 9. The said board of directors are authorized to let out the building or making of said road to contractors on such terms and in such portions, as they may deem beneficial to the interest of the company.

10. At the time the stockholders meet the first time, and organize by the election of a board of directors, each stockholder shall pay to the treasurer of the company one fifth of the total amount of stock he may have subscribed, and shall pay thereafter such a proportion of the amount he subscribed in stock as the board of directors may call on him for.

11. And the said board of directors may call, at any time, on the stockholders for the payment of stock, or a certain proportion thereof, by giving each of them twenty days' notice thereof; and if any stockholder fail, neglect, or refuse to pay his call when due, the board of directors shall have power to sue therefor in any court of this Commonwealth having jurisdiction of the amount sued for, and all costs.

12. The board of directors shall require the secretary to keep a record of their proceedings in a well-bound book, and it shall be open at all times to the inspection of the stockholders.

13. The board of directors shall have the power to establish a rate of tolls not exceeding those allowed by the General Statutes.

§ 14. The proposed road to be built on or near the line of the county road known as the new Buzzard Roost road, in Daviess county.

15. This act shall take effect from and after its pas

sage.

CHAPTER 985.

AN ACT for the benefit of L. D. Combs, jailer of Perry county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That L. D. Combs, jailer of Perry county, be, and he is, allowed to appoint a deputy jailer, who shall have power to receive prisoners, into the jail of said county, and release said prisoners when it shall be lawful for said prisoners to be released

§ 2. That said deputy jailer shall take the oath of office required by law that jailers shall take, and be under the same responsibility that jailers are under for letting prisoners escape. The jailer shall also be responsible upon his official bond for all the acts of such deputy or deputies as may be appointed under this act, and may take a bond from such deputy to secure himself from damages. § 3. This act shall take effect from and after its pas

sage.

CHAPTER 987.

AN ACT to empower the judge of the Grayson county court to appoint a collector of the delinquent tithes in each of the justices' districts of said county, and prescribing the duties of said collectors.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall be lawful for the judge of the Grayson county court, annually, to appoint a collector in each of the justices' districts of said county of the delinquent tithes for said district, who shall have the power to col

lect the same by distraint, as sheriffs are now empowered to collect the State revenue; and the said collectors shall have the same powers to collect said delinquent tithes by garnishment as is now given to sheriffs by the provisions of sections one, two, three, and four of article nine of chapter ninety-two of the General Statutes.

§ 2. He shall be required to give bond for the faithful discharge of his duties, and shall make settlement at the same time and in the same manner that sheriffs are required to make settlement for the county levy.

§3. That he shall receive for his services the same fees and commissions that sheriffs now receive for the collection of the revenue; and as to commission, fifteen per

cent. more.

§ 4. That nothing in this act shall be construed to prevent the county court from re-listing the delinquents with the sheriff.

§ 5. That this act shall take effect from its passage. Approved April 14, 1880.

CHAPTER 988.

AN ACT to legalize the subscription of stock by the Anderson county court to the completion of the Lawrenceburg, Camdenville, and Mt. Eden Turnpike No. 2.

WHEREAS, The county court of Anderson county has subscribed stock to the amount of one thousand dollars per mile in the Lawrenceburg, Camdenville, and Mt. Eden Turnpike Company No. 2, to complete said road from its present terminus to the Spencer county line, and that said subscription was made at the March term, 1880, of said court, and that said subscription was approved by all the members of said court except one, all the justices being present

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That said subscription of stock be, and the same is hereby, legalized and made as valid as if all the technicalities of law had been complied with in making the same.

§ 2. That when said road is completed, the turnpike company shall have the privilege of establishing a tollgate at any point between the present terminus and the Spencer county line, at which they may charge toll as at a full gate; and for this purpose may, by writ of ad quod damnum, condemn a site for said toll-gate, not to exceed one acre of ground.

3. This act shall take effect from its passage. Approved April 14, 1880.

CHAPTER 989.

AN ACT for the benefit of Isenberg Brothers.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the sum of seven hundred and fifty-six dollars and seventy-two cents be, and the same is hereby, appropriated, out of any money in the Treasury, not otherwise appropriated, to Isenberg Brothers, for sixty-three uniforms furnished by them to Company K (Buckner Chasseurs), Kentucky State Guard, for privates of said company, August 21, 1875; and the Auditor is authorized and directed to draw his warrant for said sum on the Treasurer in favor of said Isenberg Brothers, in full for said uniforms.

§ 2. This act to take effect from its passage.

CHAPTER 990.

AN ACT for the benefit of Alexander Deaton, late sheriff of Breathitt

county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor of Public Accounts be, and he is hereby, directed to receive, and adjust, and audit the delinquent list, exonerations, list of removals, land sales for taxes, bid in by the Commonwealth, of Alexander Deaton, late sheriff of Breathitt county, for the year 1875;

and if, upon a fair adjustment of his accounts with the State, it appears that there is anything due said Deaton on account of said delinquent list, exonerations, &c., as aforesaid, the Auditor of Public Accounts is hereby directed to draw his warrant on the Treasury in favor of said Alexander Deaton for whatever amount may be found due on said adjustment of his accounts' as aforesaid; said sum not to exceed eighty dollars.

2. This act shall take effect and be in force from its passage.

CHAPTER 991.

AN ACT for the benefit of Thomas H. Stevens, of Clark county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That the Auditor of Public Accounts be, and he is hereby, directed to draw his warrant on the Treasury in favor of Thomas H. Stevens for fifty dollars, payable out of any money in the Treasury not otherwise appropriated; being amount paid by said Stevens into the Treasury of the State for the privilege of retailing spirituous liquors at Boonsboro, in Clark county, which license he could not use on account of some error in the Clark county court. 2. This act shall take effect from its passage.

CHAPTER 992.

AN ACT for the benefit of Allen Jones, late sheriff of Pulaski county.
Be it enacted by the General Assembly of the Commonwealth
of Kentucky:

§ 1. That the further time of one year, from and after the passage of this act, be allowed Allen Jones, late sheriff of Pulaski county, and bis deputies, in which to collect, by distraint or otherwise, all uncollected taxes and fee-bills due him for the years 1868, 1869, and 1870,
