not inconsistent with the Constitution and laws of this Commonwealth. Persons obtaining license under the provisions of this act must give bond and pay the State tax as now required by law.

§3. That said trustees be, and the same are hereby, empowered to tax shows and exhibitions, ten-pin alleys, and billiard-tables, exhibited or kept in said town, in any sum not exceeding ten dollars for each performance, and five dollars per year for each billiard-table or ten-pin alley.

§4. That the police court of said town, in rendering judgment in penal cases against defendants, shall adjudge that, unless the defendant immediately pay or replevy the fine and costs, that he shall be put to work, secured by ball and chain, on the streets or other public improvements in said town until the fine and costs be paid, allowing the defendant one dollar per day for each day he labors.

§ 5. This act shall take effect from its passage. Approved April 8, 1880.

CHAPTER 864.

AN ACT to amend and change an act, approved March 22d, 1878, to incorporate Columbus College, in Hickman county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That said charter be so changed and amended, by striking out and repealing the latter part of section two of said act, which reads as follows: "And invest the proceeds arising therefrom in any property they may deem proper for the benefit of the college," and by enacting in lieu thereof" that they may sell, convey, and dispose of the same as they deem proper."

§ 2. And that third section of said act be repealed, and in lieu thereof, Be it enacted, That the trustees of said college shall be elected by the stockholders thereof. Each stockholder shall be entitled to one vote for each share of stock owned or controlled by him; said election to be held on first Tuesday of May, each year, and said trustees

so elected shall hold their office until their successors are elected; and that the stockholders in the said company shall be individually liable only for the actual stock held by them in said company.

3. This act to take effect from its passage.

CHAPTER 865.

AN ACT to incorporate Pryorsburg Lodge, No. 257, Independent Order of Odd Fellows.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That Pryorsburg Lodge, No. 257, and their associates, be, and they are hereby, created a body-corporate, by the name and style of "Pryorsburg Lodge, No. 257, of the Independent Order of Odd Fellows," and they and their associates and successors shall so continue and have perpetual succession; and by that name are made capable in law as natural persons to sue and be sued, plead and be impleaded, contract and be contracted with, answer and be answered, in all courts of law and equity in this Commonwealth; to make, have, and use a common seal, and the same to break, alter, or amend at pleasure. They may make and ordain regulations and by-laws for their government, and those now in force in said lodge to alter when deemed proper, and may change and renew the same at pleasure: Provided, They be not in contravention of the constitution, laws, and regulations of the Grand Lodge of the Independent Order of Odd Fellows incorporated by an act approved February 16th, 1838, nor in contravention of the Constitution and laws of the United States or of this State. The said corporation shall have. power and authority to acquire and hold real and personal estate, not exceeding twenty thousand dollars in value, and from time to time, if deemed expedient, sell and convey the same, or any part thereof, and to re-invest and dispose of the proceeds. repeal this act is hereby reserved to the General Assembly.

§ 2. This act to take effect and be in force from its pas

sage.

CHAPTER 866.

AN ACT authorizing the Boyd county court to apply the local tax on Chattaroi Railway Company's road and property in payment of expenditures for right of way to a limited amount.

WHEREAS, The people of Boyd county were deeply interested in having the Chattaroi Railway built through said county; and it was proposed to secure for the railway company the right of way, free of cost; but it was found that this could not be done by voluntary grant of the land-owners; a few refused to give the right of way, and in some instances the owners were infants, and could not. It was then proposed that the railway company should procure the right of way by purchase and condemnation, neither the people nor county court having a right to condemn lands; that for the amount paid for such right of way, including cost of condemnation and interest thereon, the county court of said county should issue bonds, to be paid out of the local tax to which the road and company's property within the county might become liable. This proposition was accepted by the Chattaroi Railway Company; therefore, in order to ena ble the county court of Boyd county to carry out said agreement,

Be it enucted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the county court of Boyd county is author ized to ascertain the amount paid, and that may be paid, by the Chattaroi Railway Company for the right of way for its railroad through the county of Boyd, including the cost of condemnation, and the respective dates when paid; that the county court, at its court of claims, shall enter upon its order-book the amount so ascertained, and that the local tax upon the road and company's property

within the county of Boyd, when the same shall become liable to local tax for county purposes, shall be applied to the payment of said amounts and the interest thereon, not, however, exceeding in the aggregate, including interest, the sum of seven thousand dollars.

2. That it shall be the duty of the county court, when the road and company's property becomes liable to the payment of local taxes to have the same set apart and applied as above provided, and no further obligation shall be imposed upon the county than is herein declared. 3. This act shall take effect from its passage. Approved April 8, 1880.

CHAPTER 867.

AN ACT to incorporate Elizaville Lodge, No. 510, of Free and Accepted

Masons.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Worshipful Master, Senior Warden, and Junior Warden, and their successors in office, be, and they are hereby, constituted a body-politic and corporate, under the name and style of Elizaville Lodge, No. 510, of Free and Accepted Masons; and that the officers and members of said lodge, and their successors, shall so continue and have perpetual succession; and by the name and style aforesaid they are hereby made capable in law to sue and be sued, plead and be impleaded, to contract and be contracted with, and to answer and be answered, in all the courts of law and equity of this State and elsewhere; to make, have, and use a common seal, and the same to break, alter, or amend at their pleasure

§ 2. The said corporation shall have the right to take. and hold, by purchase, gift, or devise, real or personal estate, to an amount not exceeding five thousand dollars, to dispose of and convey the same at their pleasure.

3. The business and affairs of said corporation shall be under the management and control of the first three named officers of the lodge, to be elected annually by the members of said lodge, and whose duties shall be such as

shall be prescribed by a majority of the members thereof. § 4. The members of said corporation shall have power to pass such by-laws, rules and regulations, as may be necessary for the safe-keeping of the property and other interest of said lodge, not inconsistent with the Constitution of the United States or of the Constitution of this Commonwealth.

§ 5. This act to be in force from its passage.

CHAPTER 868.

AN ACT to incorporate the Oddville and Stony Point Turnpike Road, in Harrison county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That D. H. Raymond, N. C. Marsh, R. J. Reese, R. J. Whitaker, R. T. Doon, L. McCauley, James Judy, John T. McCauley, B. C Hickman, John F. McCauley, David Florence, and their associates, successors, and assigns, be, and they are hereby, created a body-politic and corporate, with perpetual succession, under the corporate name and style of the Oddville and Stony Point Turnpike Road Company, for the purpose of constructing and maintaining a turnpike road from the town of Oddville, in Harrison county, to the Beaver Baptist Church near Beaver creek, in said county; and by that name may sue and be sued, contract and be contracted with, plead and be impleaded, in all courts and places within the State of Kentucky.

§ 2. The capital stock of this said company shall be raised by individual subscription, and the subscription of the Harrison county court of seven hundred and fifty dollars per mile, as now regulated by law; and said capital stock shall not exceed the sum of ten thousand dollars.

§3. The capital stock of said company shall be divided into shares of fifty dollars each.

§ 4. Any two of the aforesaid incorporators may open in a book for subscriptions to the stock of the company at such time and place as they may determine, and the sub
