lished, inserted, or advertised in any newspaper or newspapers published in the city of Louisville, or the county of Jefferson, by or under any general or special law or statute of the Commonwealth, or by or under the charter or any ordinance of the city of Louisville, are hereby authorized to be published, inserted, or advertised in the Louisville Evening Post; and all of said advertisements, notices, and publications are hereby authorized to be published in said newspaper with the same effect in all respects as if published in other newspapers published in said city and county.

§ 2. This act shall take effect from and after its pas

sage.

CHAPTER 1468.

AN ACT for the benefit of common schools in Mason county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the trustees of the several school districts in Mason county shall have power to assess and collect from the patrons of the school a capitation tax, of not exceed ing two dollars on each patron for each year, to buy fuel and to defray other necessary expenses of the schools. § 2. This act to be in force from its passage.

CHAPTER 1469.

AN ACT to prevent the sale of spirituous, vinous, or malt liquors within two miles of Yost Chapel, in Logan county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That hereafter it shall be unlawful for any person or persons to sell, give, loan, or otherwise dispose of any spirituous, vinous, or malt liquors, in any quantity, at any place within two miles of the church known as Yost Chapel, in Logan county; and any person violating the

provisions of this act shall be fined in the sum of twentyfive dollars, and fifty dollars for each offense thereafter, to be recovered by warrant before any justice of the peace. Said fine or fines, shall be paid over to the commissioner of common schools, for the use of the common schools of the said county.

§ 2. This act to take effect from and after its passage. Approved May 5, 1880.

CHAPTER 1470.

AN ACT to amend the charter of the Cumberland and Ohio Railroad.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That where any person owning property or estate of any kind liable to taxation for Cumberland and Ohio Railroad purposes, has failed, wholly or in part, to list said property or estate, or any part thereof, since February 24th, 1869, with the assessor, sheriff of the county, or clerk of the county court, whether called upon or not by either of said officers for that purpose, it shall be the duty of the county attorney to proceed against any person failing, wholly or in part, to list his property or estate, or any part thereof liable to the tax aforesaid, in the manner provided by law for proceeding against delinquents for a failure to list wholly or in part their property, or any part thereof, for the purposes of revenue and taxation.

§ 2. In order to justify proceedings under section one, it shall not be necessary that the party should have been returned delinquent; nor shall it be necessary that a statement should have been filed, showing in what the failure consists.

§3. The county attorney shall have ten per cent. of the amount obtained by the proceedings aforesaid.

§ 4. In case any delinquent is willing to settle any claim against him for said railroad tax without being proceeded against as prescribed in section one, the county attorney shall have the power to make such settlement, and he shall have the same per cent. of the amount

obtained upon such settlement as provided for in section. three.

5. The county attorney shall not receive or collect any claim he may be authorized to ascertain and enforce. Approved May 5, 1880.

CHAPTER 1471.

AN ACT for the benefit of John W. Suddu b.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor of Public Accounts is hereby ordered to draw his warrant on the Treasury in favor of John W. Sudduth for the sum of thirty-eight dollars and fifty cents ($38 50). Said sum shall only be paid out of any money hereafter received for that purpose from the United States Government by the State of Kentucky on the military claim of this State against said United States Government.

§ 2. This act shall take effect from its passage.

CHAPTER 1472.

AN ACT to amend an act, entitled "An act relative to the Henry, Oldham, and Jefferson Turnpike Road Company," approved February 20th, 1878. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act relative to the Henry, Oldham, and Jefferson Turnpike Road Company," approved February 20th, 1878, be amended by inserting after the name of Joseph Potts, in the first section of said section, the names of B. Wilhoite, A. Hawley, and J. W. Griffith.

§ 2. This act shall take effect from its passage.

CHAPTER 1473.

AN ACT to amend an act, entitled "An act to incorporate the Louisville Board of Trade."

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That the Louisville Board of Trade shall have power to define the duties of the flour inspectors of Louisville, to fix their fees, and establish such other rules and regulations as they may see proper for governing the

same.

§ 2. That so much of section eight of the charter of the city of Louisville, and all acts or parts of acts in conflict herewith, are hereby repealed: Provided, That the fees of the present inspectors of flour shall not be changed during their term of office.

AN ACT to amend an act to incorporate the Steele's Turnpike Road Com

pany, approved March 28th, 1872.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That if the Steele's Turnpike Road Company shall fail or refuse to complete the unfinished portion of their turnpike near McKee's cross-roads as far as the Frankfort and Versailles Turnpike Road, by or before the first day of August, 1880, then and in that case, the county court of Woodford county is hereby authorized to have the said unfinished portion completed by letting out a contract therefor Provided, The citizens living near said road will subscribe or guarantee an amount sufficient, when added to the said county subscriptions, to pay for said completion.

2. The county court of Woodford county may appoint one or more of their number to let out the contract for said work, and to receive the subscriptions, pay out the same, and to receive the work when completed, and to do and perform all acts allowed to said company touching

the construction of said road: And be it further enacted, That if said company shall charge toll over that portion of road to be built under this act, then the said county and individual subscribers shall be entitled to a portion of dividends from tolls in proportion to the stock or money subscribed and paid in.

§3. This act shall take effect from its passage.

CHAPTER 1475.

AN ACT to incorporate the Bransford Draining Company, in Daviess county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That Benjamin Bransford, J. H. Bell, George W. Corporators. Williams, James Weir, and James Alsop, and the owners of land lying in the valley between the first and second Location of ridge of hills south of the Ohio river and east of the city of Owensboro, between the western line of the Reid farm and the western line of the Amos Hathaway farm, in the county of Daviess, are hereby created a body-corporate, by the name of the Bransford Draining Company; and by that name they and their successors shall have perpetual succession, and may sue and be sued, and contract and be contracted with, and do all other acts necessary to carry into effect the objects of this act.
