§ 11. Said trustees shall have power to cause any street The improve or alley, or any part thereof, in said town, to be improved by grading, paving, curbing, and macadamizing, or by simple grading and macadamizing or paving: Provided, however, That a majority of front feet is represented by petitions to said trustees for said improvement, and also that the cost and expense of same shall be not greater than one third of the value of the property fronting thereon. The improvement of all streets or alleys shall be done at the expense of the owners of lots or parts of lots fronting thereon, according to the front feet.

§ 12. The trustees shall have the power to appoint a clerk, The appointment marshal, and treasurer, and their duties and compensation shall be as said trustees may ordain, and their term of office shall be for one year. In case of any vacancy in the above named offices by death, resignation or removal, the trustees shall have power to fill such vacancies by a majority vote of said trustees. They shall also have power to remove any incompetent or unfaithful officer appointed by them.

§14. The said trustees shall exercise and possess all the powers and privileges which are by the general laws of the State vested in and granted to trustees of towns. They shall have full power and authority to make all necessary by-laws, ordinances, and regulations for the protection of property, and to carry into full effect the powers granted by this act, and such others as are not contrary to the Constitution and laws of this Commonwealth, for the purpose of securing the quiet and good order of said town, and the comfort and health of the citizens thereof.

§ 15. Said trustees shall meet at least once in every month for the transaction of the business of said town;

and the city clerk shall keep a true record of their proceedings, which record shall be taken and received as recorded evidence in any court in this State, and a certified copy from said clerk shall be sufficient for any purpose of evidence.

§ 16. That there shall be, and is hereby, established the Police judge. office of police judge of said town. He shall be elected

at the same time and manner, and shall have the same
qualifications as trustees of said town. His jurisdiction
shall be confined to within the limits of said town. He
shall have concurrent civil and criminal jurisdiction,
which, by existing laws, are conferred upon justices of
the peace; and, in addition thereto, he shall have all the
jurisdiction in felonies and misdemeanors which by the
Code of Practice in criminal cases is especially conferred
upon police judges as such. He shall be a conservator
of the peace, and have concurrent jurisdiction with jus-
tices of the peace over affrays, assaults and batteries,
riots, breaches of the peace, indecent or immoral behav-
ior, or disorderly conduct whatever in said town, all of
which are hereby declared to be misdemeanors; and all
fines imposed by him shall be collected by the city mar-
shal, and paid by him into the treasury of said town. He
shall have power to impose fines to the amount of thirty
dollars; but in all cases the accused shall be entitled to
the right of a trial by jury. He shall have jurisdiction of
all offenses or causes arising out of an infraction of the
by-laws and ordinances passed by the trustees of said
town, and the enforcement of the power granted to them
by law.
He shall have power to issue subponas for
witnesses in cases pending before him, and may issue
compulsory processes to compel their attendance when-
ever necessary. He shall have power to fine and im-
prison for contempts, provided the fine shall not exceed
ten dollars, nor the imprisonment exceed four hours, in
the county jail of Kenton county.

§ 17. The fees of said police judge shall be the same as those of a justice of the peace of Kenton county, and he may hold his court continuously. The fees of the city

marshal shall be the same as those of constables for similar services, and may be collected in the same manner; for all other services, such as collection of tax or other duties imposed upon him by ordinance of the trustees, he shall be paid for as said trustees may ordain: Provided, They shall not exceed that paid to sheriffs.

18. The lands of Mrs. Mary L. Hawthorne shall be exempted from the provisions of this act of incorporation: Provided, This act shall be submitted to the qualified voters of the district hereby incorporated at the next August election, nor shall the same take effect unless a majority of said qualified voters vote therefor. § 19. This act to take effect from and after its passage. Approved May 5, 1880.

CHAPTER 1460.

AN ACT to incorporate the Sharpsburg and Henry's Mill Turnpike Road

Company.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That Jacob Henry, Dr. E. Roe, B. F. Haggard, Waller Sharp, and William Weathers, and their associates and successors, be, and they are hereby, constituted a body-potitic and corporate, under the name and style of the Sharpsburg and Henry's Mill Turnpike Road Company; with power to sue and be sued, contract and be contracted with, plead and be impleaded. Said company to have a capital stock not to exceed three thousand dollars, divided into shares of fifty dollars each.

§ 2. The said company shall have power to construct a turnpike road from or near Sharpsburg, in Bath county, to Jacob Henry's mill, a distance of about three miles.

3. The incorporators named above shall open books of subscription, and after half the capital stock shall have been subscribed, the company shall organize by selecting from their number a president and treasurer and a board of five directors; ten days' previous notice of the time. and place of the meeting having been given by posting

notices, or by publishing the same in the county paper. Each stockholder shall have one vote for each share of stock owned by him, and may vote in person or by proxy.

4 They may have power to acquire the land over which the road is to be built by purchase, donation, or writ of ad quod damnum, as well as for the residence of gate-keepers. They shall have access to timber, rock quarries, grave! pits, &c., necessary to the construction of said road on the same conditions.

5. The grade of said road, as also the width and the depth of gravel, shall be under the control of the board of directors. They may erect a toll-gate at or near B. F. Haggard's house, and charge tolls both ways; the rate of toll not to exceed the rate charged by similar roads.

§ 6. The board of directors may require the treasurer, before entering upon the discharge of his duties, to execute bond to said company, in such sums as they may require, conditioned on the faithful performance of his duties.

§ 7. The board of directors may establish such by-laws as are necessary for the management of said road, provided they shall not be in conflict with the Constitution and laws of the State.

§ 8. Before the county court of Bath county shall make an appropriation to said road, as prescribed by the turnpike laws of Bath county, the question shall be submitted. to the qualified voters of said county at any regular election, and if a majority of the voters of said county voting at said election vote in favor of said appropriation, the county court shall proceed to make said appropriations, and make the necessary levy for the payment of same.

§ 9. The officers first elected shall hold their office for one year after their election, and until their successors are duly elected and qualified.

§ 10. This act shall take effect from its passage.

CHAPTER 1461.

AN ACT to empower the county court of Grant county to make subscriptions to the capital stock of turnpike roads in said county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the county court of Grant county, a majority of the justices of the peace of said county being present and concurring, be, and is hereby, authorized and empowered to subscribe stock for and on behalf of said county to all turnpike road companies which have been, or shall hereafter be, incorporated by said county court, or by the Legislature of the State: Provided, That said subscription shall not exceed seven hundred dollars for each mile of road within said county.

§ 2. Said county court, a majority of the justices of Kay levy a tax, the peace of the county being present and concurring, shall have power to levy a tax upon all of the property in said county subject to taxation for revenue purposes, sufficient for the purpose of paying said subscription of stock, which levy shall, in no year, exceed the sum of twenty-five cents on each hundred dollars of taxable property in said county, said tax to be collected in the same manner and by the same officers, under the same liabilities and penalties, that the revenue tax is now col`lected.
