CHAPTER I.

AN ACT

To incorporate the Pennsylvania Infirmary for diseases of the eye and ear.

SECT. 1. BE it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met and it is hereby enacted by the authority of the same, That James Gibson, William Meredith, C. N. Bancker, Manuel Eyre, Richard C. Wood, George B. Wood, John K. Corporation Kane, Isaac Hays, John Bell, R. E. Griffith, William Dar- created. rach, Philip S. Physic, William Gibson, and their associates contributors to the institution called the Pennsylvania Infirmary for diseases of the eye and ear, be and they are hereby constituted a body politic and corporate, by the name and style of the "Pennsysvania Infirmary for diseases of the eye and ear;" to have perpetual succession, to use a common Powers and seal, and to alter and renew the same at pleasure; to take, privileges. hold and enjoy lands, tenements and hereditaments, and to make such by-laws for their corporate government and for the admission of new members into the corporation as they shall deem necessary and proper: Provided, the said bylaws shall not be repugnant to, nor inconsistent with, the Proviso. constitution and laws of the United States or of this state.

And provided also, That the clear yearly income of real Second proestate to be held by the said corporation shall not exceed two viso. thousand dollars.

SECT. 2. And be it further enacted by the authority aforesaid,

That the essential object of the said corporation shall be the Object of the ministration of gratuitous relief to indigent persons afflicted corporation. with diseases of the eye and ear.

SECT. 3. And be it further enacted by the authority aforesaid, That, until otherwise provided by the by-laws, a general meeting of the corporators shall be held on the first Monday in each year, for the transaction of the necessary business of the corporation, at which four shall be a quorum; that the officers of the corporation shall be then elected; and that until others are chosen, James Gibson, William Meredith, Charles N. Bancker, Manuel Eyre, Richard C. Wood, George B. Wood, John K. Kane, Isaac Hays, John Bell, R. E. Griffith, William Darrach, Philip S. Physic and William Gibson shall be the managers of the same, and shall have power to regulate the financial and other concerns thereof.

SECT.4. And be it further enacted by the authority aforesaid, That if officers are not appointed at the times prescribed, the corporation shall not for that cause be dissolved, but an election shall be held as soon afterwards as may be, and till such election the officers in place shall continue to act.

SECT.5. And be it further enacted by the authority aforesaid, That if it shall appear that the privileges by this act granted are injurious to the citizens of this commonwealth, the legislature reserve the right to revoke, alter or annul the charter hereby granted at any time they may think proper.

CHAPTER II.

AN ACT

To authorise the committee of Jonas Potts, a lunatic, to sell and

convey certain real estate.

SECT. 1. BE it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met and it is hereby enacted by the authority of the same, That David Bruce, James Kerr, and Benjamin Bubbit, of

Washington county, committee on the person and estate of Jonas Potts, a lunatic, be and they are hereby authorised and empowered to sell all the right, title and interest of the said Jonas Potts in and to a certain messuage and tract of land, situate in Hanover township, Washington county, adjoining lands of George Jackson, John Tucker and others, and to convey any lands of the said Jonas Potts heretofore sold, and to make and execute a sufficient deed or deeds to the purchaser or purchasers, which deed or deeds shall by virtue hereof convey the like interest and have the same effect as if the said Jonas Potts was or were of sound mind and memory, and the same was or were duly made and executed by him. Provided, That the said committee give security in the court of common pleas of Washington county, in such sum as said court may direct, for the proper application of the money which may come into their hands in consequence of such JOSEPH RITNER, Speaker

CHAPTER III.

A SUPPLEMENT

To the act, entitled an act enabling the Governor to incorporate company for making an artificial road from the state line, near the town of Emmitsburg, in the state of Maryland, through Waynesburg, Green-castle and Mercersburg, to intersect the Chambersburg and Bedford turnpike road, at or near the east end of M'Connelsburg, passed the twenty-ninth day of January, eighteen hundred and sixteen.

SECT. 1. BE it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met and it is hereby enacted by the authority of the same, That so much of the twenty-first section of the above recited

SECT. 2. And be it further enacted by the authority aforesaid, That the said commissioners, after being duly sworn or Duty of com. missioners. affirmed, shall, as soon as the said two thousand dollars is expended, make report to the court of quarter sessions of the county of Northampton, and upon such report so made, Viewers to the court is directed to appoint three respectable citizens, be appoint inhabitants of said county, whose duty it shall be to view the said road and make report of the same to the said court, particularly setting forth whether or not the said money was judiciously expended, agreeably to the provisions of this act; and if the report shall be accepted by the said court, then and in that case the said bond shall be null and void.

Compensation of viewers.

SECT. 3. And be it further enacted by the authority aforesaid, That it shall be the duty of the commissioners aforesaid, before they proceed to the expenditure of the sum appropriated by this act, to see that the said road is located at a degree of acclivity or declivity not exceeding five degrees above or below a horizontal line, and if not, to proceed to have it so located.

SECT. 4. And be it further enacted by the authority aforesaid, That the commissioners appointed to view the road as herein provided, shall receive a compensation of one dollar per day for every day that they shall be engaged, to be paid out of the treasury of the county of Northampton.

AN ACT

To extend the act entitled "An act to incorporate The Marine Insurance Company of Philadelphia," and the act entitled "An act to incorporate a company for erecting a bridge over the river Susquehanna, at the town of Danville," passed nineteenth March, eighteen hundred and sixteen.

SECT. 1. BE it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met and it is hereby enacted by the authority of the same, That the charter of the Marine Insurance Company of Charter of Philadelphia, incorporated by an act passed on the seven-the Marine teenth day of March, one thousand eight hundred and nine, Insurance is hereby extended and continued in full force until the first Company extended day of January, which will be in the year of our Lord one until 1st thousand eight hundred and forty-seven, with all the powers January, provisions and restrictions contained in the said original 1847. charter, except so much as is contained in the fourth section

of the said act hereby extended: Provided, That if it shall Proviso. appear that the charter and privileges hereby renewed and granted, are injurious to the citizens of this commonwealth, the legislature shall have full power to revoke, alter or cancel them at any time they may think proper.

SECT. 2.
