Ordered, That the Clerk return said bill to the Senate, with a message that the Assembly have concurred in the passage of the

same.

On motion of Mr. Hutchinson, the committee on rules was instructed to report Senate bill (No. 1446, Rec. No. 334) entitled "An act to amend the Insurance Law, in relation to application of agent's certificate of authority."

On motion of Mr. Hutchinson, and by unanimous consent, said bill was read the second time and ordered to a third reading.

On motion of Mr. Hutchinson, and by unanimous consent, said bill was read the third time, having been printed and upon the desks of the members in its final form at least three calendar legislative days prior to its final passage.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, and three-fifths being present.

No. 1314) entitled "An act to direct the Public Service Commission to examine the meters of certain gas or electrical corporations, and prohibiting service charges by such corporations," with the following amendments:

Page 1, line 2, strike out "the" and insert "each".

Line 4, after the word "Rockland" insert the following: garding which a complaint has been made to the commission by a consumer".

Line 6, after the word "install" strike out "new" and insert. "accurate".

Line 9, strike out entire line except first word "meter" and insert instead "in addition to the rate prescribed by the commission."

Mr. Speaker, from the committee on rules, reported said bill amended as directed.

On motion of Mr. DePew, said bill was ordered reprinted as amended and recommitted to said committee.

On motion of Mr. DePew, the committee on rules was instructed to report Assembly bill (No. 1769, Int. No. 1557) entitled "An act to amend the Greater New York charter, in relation to the arms expert in the police department of such city," with the following amendments:

Page 1, line 9, before the word "police" insert the word "uniformed ".

Page 1, line 9, after the word "and" insert "such appointee shall be qualified so as to enable him to repair firearms and to instruct members of the police force in assembling and disassembling of fire arms. Such officer shall when called on testify in courts as an expert on firearms on behalf of the department." Page 1, line 9, capitalize the "W" in the word "when".

Page 1, line 9, after the word "appointed" insert "such appointee".

Page 2, line 3, after the period insert "The board of estimate and apportionment shall provide funds pursuant to law for the salary of such officer."

Mr. Speaker, from the committee on rules, reported said bill amended as directed.

On motion of Mr. DePew, said bill was ordered reprinted as amended and recommitted to said committee.

Mr. Adler moved a call of the members of the House. Mr. Speaker put the question whether the House would agree to said motion, and it was determined in the affirmative.

No. 311) entitled "An act to amend the Public Health Law, in relation to violations of rules or orders of local boards of health," having been announced for a second reading,
