CHAPTER 985.

AN ACT to regulate civil actions against officers and soldiers in the service of the United States and this State.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That in all civil actions in any court of original jurisdiction in this Commonwealth, where it is satisfactorily shown by affidavits or otherwise that any defendant thereto is an officer or soldier in the military service of the United States or of this State, the court shall give such defendant further time to file his answer or make his defense; and no judgment shall be rendered against him by default while he continues in the service aforesaid: Provided, No such officer or soldier who has deserted, or is absent from said service without leave, shall be entitled to the benefits of this act: Provided further, That if any such officer or soldier is in the county of his residence at the the time any such action is called for trial, he shall be required to show the fact to the satisfaction of the court, that he is absent from the service with leave, otherwise the case may be tried.

§ 2. That this act shall take effect from its passage, and continue in force for one year only.

CHAPTER 987.

AN ACT concerning the collection of the public revenue for 1863. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

Time for ap point'g collectors extended.

§ 1. That the time allowed by the second section of the act, entitled, an act to amend an act, entitled, an act concerning the collection of public revenue and county levy for the years 1861 and 1862, approved August 28th, 1862, for the appointment of collectors of the public revenue and county levy for the years 1861 and 1862, is hereby extended until the 1st day of July, 1863: Provided, That the right given by said act, and the act to which the same is an amendment, to the Auditor, to make said appointment shall remain unimpaired: And, provided further, That should the Auditor make any appointment of a collector give bond in oo of the revenue in any county for those years, the party or person so appointed may give bond for the same before the county court, instead of before the Auditor, as required by said act-a certified copy of which shall be forwarded to the Auditor.

§ 2. This act to take effect from its passage.

CHAPTER 992.

AN ACT to regulate the time of holding the circuit courts in the 11th
Judicial District.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the circuit courts in the 11th judicial district be held at the times named herein, and continue the number of juridical days hereinafter named, if the business require it:

In the county of Montgomery on the 1st Mondays in February and August, and continue twelve juridical days. In the county of Powell on the 3d Mondays in February and August, and continue twelve juridical days.

In the county of Morgan on the 1st Mondays in March. and September and continue twelve juridical days.

In the county of Wolfe on the 3d Mondays in March and September, and continue six juridical days.

In the county of Magoffin on the 4th Mondays in March and September, and continue six juridical days.

In the county of Floyd the Mondays succeeding the Magoffin courts, and continue six juridical days.

In the county of Pike the Mondays succeeding the Floyd courts, and continue six juridical days.

In the county of Johnson on the Mondays succeeding the Pike courts, and continue six juridical days.

In the county of Lawrence on the Mondays succeeding the Johnson courts, and continue twelve juridical days. In the county of Carter the Mondays succeeding the Lawrence courts, and continue twelve juridical days.

In the county of Boyd the Mondays succeeding the Carter courts, and continue twelve juridical days.

In the county of Bath on the Mondays succeeding the
Boyd courts, and continue twelve juridical days.
§2. This act shall take effect from and after the 1st of
July next.

CHAPTER 993.

AN ACT giving additional clerk hire to the Treasurer. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That hereafter there shall be allowed to the Treas urer the sum of five hundred dollars per annum, for clerk hire, instead of the sum of three hundred dollars, as now allowed by law, to be drawn from the treasury in the same

manner in which salaries to public officers are authorized to be paid.

§ 2. This act shall take effect from and after its passage. Approved March 2, 1863.

CHAPTER 995.

AN ACT in reference to the Library.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor draw his warrant on the treasury in favor of the State Librarian for one hundred dollars; and that the amount thereof is hereby appropriated, to be laid out and expended by said Librarian, under the direction of the board of education, for the purchase of literary and miscellaneous works, to be added to the State Library; and that from and after the passage of this act an additional sum of one hundred dollars per annum is hereby set apart and appropriated, to be drawn from the treasury and expended in the manner and for the purposes aforesaid: Provided, That in all the purchases to be made, as provided in this section, special reference be had to the purchase of such books as relates to the history and literature of this Commonwealth.

§ 2. That the Librarian may, from time to time, with the consent of the Governor, exchange with any State in this books and docuUnion, and with any foreign country, copies of the public books and documents published by this State, for copies of the public books and documents of such other State or country.

§ 3. That the proceeds of sales of the remaining copies of Stanton's Revised Statutes, authorized by a former act of this General Assembly to be sold, and yet undisposed of, ted to above ou be dedicated and set apart for such purchases as have been mentioned in the first section of this act.

CHAPTER 997.

AN ACT concerning Sheriffs' deeds.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

CHAPTER 999.

AN ACT supplemental to an act laying off the State into nire Congressional Districts.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That so much of the Congressional apportionment bill, passed at the present session of this General Assembly, as adds Casey county to the 8th district be changed, so as to make Casey county part of the 4th district. § 2. This act to be of force from its passage.

CHAPTER 1004.

AN ACT to locate an Agricultural College.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the State Agricultural Board, composed of the State Agricultu- following persons, to-wit: Laban J. Bradford, President; Philip Swigert, J. B. O'Bannon, and John P. Campbell, Vice Presidents; and of the First District, O. H. Burbridge, Zeb. Ward, L. P. Tarlton, Anthony Killgore, and J. H. G. Bush; and of the Second District, G. Mallory, S. T. Drane, Geo. Denny, Alf. Allen, and James S. Wallace; and of the Third District, Archie Dixon, R. B. Ratliff, W. B. Woodruff, Sam'l Murrill, and Edward R. Weir-be and they are hereby appointed commissioners to examine and report to the next General Assembly upon the advantages of various localities, and the inducements offered by each for the location of a State Agricultural College.

§ 2. That this act shall be in force from and after its passage.

CHAPTER 1006.

AN ACT providing for allowing claims against the Commonwealth in
Whitley county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1863.

§ 1. That the judge of the twelfth judicial district, if unable safely to hold the spring term of the circuit court for Whitley county, from the fact of the occupancy of said in 12th judicial county by Confederate armed forces, he may allow, and have certified the claims of officers and citizens of Whitley county against the Commonwealth, at any other court in said district, when proven according to law.

§ 2. That claims allowed under the provisions of the first section of this act, and all orders in relation thereto, shall by order of said court, be transferred to the records of the circuit court clerk's office of Whitley county there to be recorded, and filed in the same manner as if regularly allowed in the Whitley circuit court.

§3. This act to be in force from its passage.

CHAPTER 1012.

AN ACT regulating appeals from Justices and Police Courts and officers of the Quarterly Courts.

Be it enacted by the General. Assembly of the Commonwealth of Kentucky:

§ 1. That upon all judgments hereafter rendered in justices and police courts, where the amount in controversy is of the value of twenty dollars or more, exclusive of interest and cost; and where an appeal is prayed, either party may direct that the appeal shall be taken direct to the circuit court. If either party so direct, the justice or police judge rendering the judgment shall make a minute of the same, as part of the record. The appeal and costs in all other respects shall be regulated as now provided by law. § 2. That deputy clerks of quarterly courts are hereby authorized to administer oaths and certify the same, in all cases where the presiding judge is so authorized, and shall be entitled to the same fees therefor.

§ 3. This act to take effect from its passage.
