CHAPTER 664.

AN ACT for the benefit of Aaron Lawson, trustee of the Jury Fund for Edmonson county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor of Public Accounts be and he is hereby directed to draw his warrant on the treasury in favor of Aaron Lawson, present trustee of the jury fund for Edmonson county, for the sum of one hundred and twenty dollars and thirty-five cents, the deficit of the jury fund at the September term of the Edmonson equity and criminal term, 1861, as shown by the former trustee, Thos. B. McIntire's, report; and that said Aaron Lawson, the present trustee, pay the same to such of the grand and pettit jurors of that term of the court as have not been paid. § 2. This act shall take effect from its passage.

CHAPTER 665.

AN ACT to change the county line between the counties of Grant and

Owen.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the county line between the counties of Grant and Owen be and the same is so altered and changed as to include the farms and residences of James Simpson and Isaac Holbrook in the county of Grant.

§ 2. This act to take effect from and after its passage. Approved August 31, 1862.

CHAPTER 666.

AN ACT appropriating money to George W. Matthews, Jos. Hickman, and Thomas Montgomery.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the sum of two dollars and twenty-five cents be appropriated to Geo. W. Matthews, Joseph Hickman, and Thos. Montgomery, each, for attending as witnesses before the special committee of the House of Representatives under their summons.

§ 2. This act to take effect from its passage.

CHAPTER 667.

AN ACT to amend the act concerning the trustees, police judge, and town marshal of Greenville.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the acts concerning trustees, police judge, and town marshal for the town of Greenville, Muhlenburg county, be amended, as follows: It appearing that the last elected trustees refuse to qualify it shall be the duty of the old board of trustees, (any two of whom may act,) at any time after having given ten days notice, to hold an election for trustees of said town, under the same rules and in same manner as heretofore prescribed; and the persons so elected after they shall have qualified, shall be the trustees until the next regular election, and their successors shall have qualified. But should they, for ten days, neglect or refuse to qualify, then it shall be the duty of the old board to report the fact to the Muhlenburg county court, at its next succeeding term, and said court shall immediately proceed to appoint a board of trustees, whose duty it shall be to qualify; but whether they do or not they shall be under all the liability and responsibility of trustees, under the law governing said town; and if at any time hereafter, trustees elected under said laws fail or refuse to qualify for said time, it shall be the duty of the old board to report, and of the county court to appoint, as herein prescribed; and if said board shall for one month after the passage of this act fail to hold said election, or shall hereafter, at the regular times for holding said election, fail to do so, it shall be the duty of the county court to appoint a board.

§ 2. It appearing that the marshal elected at the last regular election has deceased, and there is no provision to fill the vacancy, it shall be the duty of the board of trustees, through any two of their number, to hold an election after having given ten days notice; and the person elected shall qualify and act during the residue of said term, and till his successor shall qualify; but said trustee shall report his election to the county court, when he shall qualify and give the bond and surety heretofore prescribed and hereafter any vacancy may be filled in like manner.

§ 3. This act to take effect from and after its passage. Approved August 31, 1862.

CHAPTER 668.

AN ACT for the benefit of Olive Branch Methodist Episcopal Church,
South, in Shelby county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That the trustees of Olive Branch Methodist Episcopal Church, South, in Shelby county, be and are hereby authorized to sell and convey title to the purchaser thereof, the lot of ground, or so much thereof as they may deem proper, on which their old house of worship stood. Approved August 31, 1862

CHAPTER 669.

AN ACT to provide for the election of Mayor and other officers of the city of Henderson.

Whereas, It is represented to the General Assembly, that the offices of mayor, council, and assessor, of the city of Henderson, are vacant-therefore,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an election be held at the usual places of voting in the first and second wards of the city of Henderson, on Wednesday, the 10th day of September next, to afford the voters of said city the opportunity, without let or hindrance, of electing a mayor, councilmen and assessor, to fill the vacancy caused by E. G. Hall's abandoning his home and office; also, the vacancies caused by the resig nations of the councilmen, and also the vacancy caused by the resignation of the assessor of said city.

§2. That F. W. Rentlinger, clerk of the city council, shall advertise the time and place for holding said election, at least three days before the day of election, by putting up posters or bills in at least two of the most public places in each of the wards.

§3. The county judge of Henderson county shall ap point the officers to conduct said election, which shall be conducted in accordance with this act, and the provisions of the charter for the city of Henderson.

§ 4. This act shall take effect from and after its passage. Approved August 31, 1862

CHAPTER 670.

AN ACT to repeal an act, entitled, "an act to regulate navigation on the Kentucky river." approved March 8th, 1862.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That an act, entitled, an act to regulate navigation on the Kentucky river, approved March 8th, 1862, be and the same is hereby repealed.

§ 2. This act shall take effect from and after its passage. Approved September 4, 1862.

CHAPTER 671.

AN ACT to protect the State House from injury.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall not be lawful for any person to use as a prison or jail, for the confinement of suspected rebels, or persons suspected of any other crime or misdemeanor, any of the rooms used by the General Assembly.

§ 2. Any person violating this act shall make remuneration to the State for treble the amount of damages sustained, and may be imprisoned in the county jail not more than six months, or fined in such sum as a jury may assess, not exceeding one hundred dollars, or both fined and imprisoned, at the discretion of the jury.

§3. The police court of Frankfort shall have power to try causes arising under this act.

§4. This act shall take effect from and after its passage. Approved September 4, 1862.

CHAPTER 672.

AN ACT to amend an act, entitled, "an act to amend the Revised Statutes, in regard to filling vacancies in the office of Sheriff," approved February 26th, 1862.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the act, entitled, "an act to amend the Revised Statutes, in regard to filling vacancies in the office of sheriff," approved February 26, 1862, be so amended, that if, from any cause no election is held at the regular election, to fill a vacancy in the office of sheriff, it shall be the duty of the county court of the county in which the vacancy may

exist, to appoint a proper person to act as sheriff for the
unexpired term, provided it be less than one year.
§ 2. This act to take effect from its passage.

CHAPTER 673.

AN ACT for the benefit of the banks of this State.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That all or any one of the banks chartered by the legislature of this State, may have the right, under such rules and regulations as may be prescribed by the president and board of directors thereof, to receive the transfer of any portion of the capital stock of said bank, in payment of the whole or a part of any debt or debts due, or to become due, to such bank; and further, to sell the same.

§ 2. This act to be in force until the 1st January, 1864, and take effect from its passage.

CHAPTER 674.

AN ACT supplemental to an act, entitled " an act for the benefit of the mounted company of Clarke county known as the Volunteer Provost Guard," passed the present session.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act passed at the present session of the General Assembly, entitled "an act for the benefit of the Mounted Volunteer Company of Clarke county, known as the Volunteer Provost Guard," be and the same is amended, so as to make it lawful for the county judge to levy the tax provided for in said act in any month as well as in the month of of September, in the manner provided in said

act.

§ 2. This act to take effect from its passage.
