Cers of infantry, light-infantry, grenadiers and riflemen, shall feverally, at their own expence, be armed with a fword or hanger and an efpontoon; and thofe of artillery, with a fword or. hanger, a fuzee, bayonet and belt, and a cartridge-box, to contain at leaft twelve cartridges; the commiflioned officers of the feveral troops of horfe, fhall furnish themfelves with good horfes, of at leaft fourteen hands and an half high, and fhall be armed with a fword and a pair of pistols, the holfters of which fhall be. covered with bear fin caps; each light-horfe man or dragoon fhall furnifh himfelf with a ferviceable horse, of at leaft fourteen hands and an half high, a good faddle, bridle, mail-pillion and valefe, holfters, and a breaft-plate and crupper, a pair of boots and fpurs, a pair of piftols, the hollters of which fhall be covered with bear fkin caps, a fabre and cartridge-box, to contain at leaft twelve cartridges for piftols; and every perfon fo enrolled and provided with arms, ammunition and accoutrements required as aforefaid, fhall hold the fame exempted from all fuits, diftreffes, executions or fales for debt, or for the payment of taxes.

Sec. 7. And be it further enacted by the auHow the mi- thority aforefaid, That the militia fhall be officered as follows: To each divifion one majorgeneral and two aids-de-camp, with the rank of major; to each brigade, one brigadier-general, one brigade-major, and one brigade-inspector, each with the rank of major; to each regiment, one lieutenant-colonel commandant; and to each battalion, one major; to each company of infantry (including light-infantry, riflemen and grenadiers) one captain, one lieutenant, one enfign

fign, four fergeants, four corporals, one drummer and one fifer or bugler: There fhall be a regimental staff, to confift of one adjutant and one quarter-mafter, to rank as lieutenant, one pay-mafter, one furgeon, one furgeon's mate, one fergeant-major, one quarter-mafter sergeant, one drum-major and fife-major; there fhall be to each company of artillery, one captain, two lieutenants, four fergeants, four corporals, fix gunners, fix bombardiers, one drummer and one fifer; and to each troop of horse, there fhall be one captain, two lieutenants, one cornet, four fergeants, four corporals, one faddler, one farrier, and one trumpeter. There fhall be one adjutant-general, with the rank of brigadiergeneral, appointed for the whole militia; and it fhall be the duty of the first fergeant of every company, to act as clerk of the company.

Sec. 8. And be it further enacted by the authority aforefaid, That the adjutant-gencral, By whom the major-generals, brigadier-generals, and brigade-officers fall be infpectors, fhall be appointed and commifiioned by the Governor; the divifion and brigade officers to be refiding within their respective divifion and brigade bounds; that the major-generals fhall appoint their own aids-de-camp, and the brigadier-generals their brigade-majors; that the field officers of each regiment fhall appoint their refpective regimental Itaffs; that the lieutenant-colonels, majors, captains, licutenants, and enfigns, fergeants and corporals, fhall be elected in form and manner herein after mentioned and provided for; but no perfon fhall Who may not be eligible, or hold a commiffion in the militia, million; who is not a citizen of this ftate, or who fhall not refide within the regiment, battalion or company in which he was elected; that all duration of commiffioned officers fhall be commiffioned commiffio

Sec. 9. And be it further enacted by the auDuties of the thority aforefaid, That it fhall be the duty of adjutant-ge the adjutant-general to diftribute all orders from the Governor, as commander in chief of the militia of the ftate, to the brigade-infpectors, or to the feveral corps, when in actual fervice; to attend all public reviews when the Governor fhall review the militia; to obey all orders from him, relating to the carrying into execution and perfecting the fyftem of military difcipline eftablifhed by this act; to furnifh each brigade-infpector with one fet of blank forms of the dif ferent returns that may be required, for which he fhall be allowed in the fettlement of his accounts with the regifter-general, and to explain the principles on which fuch returns fhould be made; to receive from the feveral officers of the different corps throughout the state, returns of the militia under their command, reporting the actual fituation of their arms, accoutrements and ammunition, their delinquencies, and every other thing which relates to the general advance ment of good order and difcipline; all which the feveral officers of the divifions, brigades, regiments, battalions, troops and companies, are hereby

hereby required to make, in fuch manner as the Governor fhall direct, fo that the faid adjutantgeneral may he furnifhed' therewith; from all which returns he fhall make a general return of all the militia of the state, and lay the fame before the Governor, and tranfmit a duplicate thereof to the prefident of the United States; To give bond that the faid adjutant-general, before he enters with furtics; on the exercise of the duties of his office, fhall give bond, with two or more fufficient fureties, in the penalty of five thousand dollars, conditioned for the due and faithful performance of the faid duties, and fhall in full compenfation for his fervices, receive a yearly falary of fix his falary. hundred dollars; and it fhall be the duty of faid adjutant-general, his heirs, executors or adminiftrators, under the penalty of one thousand dollars, to deliver to his fucceffor, all the books, papers and documents relating to the duties of

his office.

Sec. 10. And be it further enacted by the authority aforefaid, That it fhall be the duty of brigade-ineach brigade-inspector, at least once in every spector. year, to inspect the arms, ammunition and accoutrements of the militia compofing his brigade; to execute all orders which he may receive from the adjutant-general or commander in chief; to fuperintend the elections of fieldofficers; to furnish all the neceffary blank returns, the form of which fhall be prescribed by the adjutant-general; to deliver or cause to be delivered, yearly and every year, on or before the first day of April, to each captain or commanding officer of a company, three blank infpection rolls and three blank clafs rolls, which feveral rolls the faid captain or commanding officer of a company, is hereby directed to fill, and fhall under the penalty of twenty dollars, VOL.
