An ACT for the establishment of a College at Ca nonfburg, in the county of Washington, in the Commonwealth of Pennsylvania.

HEREAS, the establishment of a col lege at Canonfburg, in the county o Washington, for the inftruction of youth in the learned languages, in the arts and fciences, and in useful literature, would tend to diffuse in formation and promote the public good: There fore,

Section 1. Be it enacted by the Senate and Houfe of Reprefentatives of the Commonwealth Pennfylvania, in General Affembly met, and it i hereby enacted by the authority of the fame, Tha there be erected, and hereby is erected and nonfburg, established in Canonsburgh, in the county o Washington, in this Commonwealth, a

lege for the education of youth in the learn ed languages, the arts, fciences, and useful literature; the ftyle name and title of faid college, and the conftitution thereof fhall be, and are hereby declared to be as is herein after mentioned and defined, that is to fay: The faid college fhall be under the management, direction, and government of a number of trustees, not exceeding twenty-one, and the first trustees of the faid college fhall confift of the following perfons, to wit: Reverend John McMillan, Jofeph Patterson, Thomas Marquis, Samuel Ralfton, John Black, James Powers, James Dunlap, and John M'Pharrin; James Edgar, John M'Dowell, James Allifon, William Findley, Craig Ritchie, John Hamilton, Jofeph Vance, Robert Mahon, James Kerr, and Aaron Lyle, efquires; Alexander Cooke, John Mercer, and William Hughes.

Sec. 2. And be it further enacted by the au thority aforefaid, That the said trustees and their Trustees in fucceffors to be elected in the manner herein corporated, after mentioned, fhall forever hereafter, be and they are hereby erected, established and declarod, to be one body politic and corporate, with perpetual fucceffion, in deed and in law, to all intents and purposes whatsoever, by the name, ftyle, and title, of "The truftees of Jefferson "college, in Canonfburgh, in the county of "Washington," by which name and title, they the faid trustees, and their fucceffors, fhall be competent and capable at law and in equity, to take to themfelves and their fucceffors, for the use of the faid college, any eftate in any meffuages, lands, tenements, heriditaments, goods, chattels, monies, or other effects, by the gift, grant, bargain, fale, conveyance, affurance, will, devife, or bequeft of any perfon cr perfons

perfons whomfoever or wherefoever: Provided The fame do not exceed in the whole, the yearly value of fix thousand dollars, and the fame mef fuages, lands, tenements, heriditaments, and ef tate, real and perfonal, to grant, bargain, fell, convey, affure, demife and to farm-let, and to place out on intereft, or otherwife difpofe of, for the benefit of the faid college, in fuch manner as to them or a majority of them, fhall feem moft beneficial for the inftitution; and to receive the rents, iffues, profits, income and intereft there of, and to apply the fame to the proper ufe and fupport of the faid college; and by the fame name, to fue, profecute and defend, im plead and be impleaded, in any court or courts of law or equity and in all manner of fuits or actions, whatsoever, and generally, by and in the fame name, to do and transact all and every the business, touching or concerning the premi fes, as fully and effectually, as any natural perfon, or body politic or corporate, within this commonwealth may or can do: and to hold, enjoy and exercife, all fuch powers, authorities and jurifdictions, as are cuftomary in other colleges, in the United States of A merica.

Sec. 3. And be it further enacted by the au Corporation to thority aforefaid, That there fhall be a meeting o meet yearly. the faid trustees, at least once in every year at the town of Canonfburgh, at fuch time a the faid trustees or a majority of them fhall ap point, of which notice fhall be given, eithe by public advertisements, in one of the publi newspapers of the town of Washington, in th county of Washington, four weeks before fuc meeting, or by notice in writing, figned by th clerk or other officer, whom the faid truftee for that purpose may appoint, and to be left a

the dwelling houfe of each trustee, at least ten days before the time of fuch intended meeting, and if at fuch meeting, eleven of the faid trustees fhall not be prefent, those present fhall have power to adjourn the meeting, to any other day, as fully and effectually, to all intents and purposes, as if the whole number of truftees, for the time being, were present; but if eleven or more of the faid trustees fhall meet at the faid appointed times, or at any other time of adjournment, then fuch number fo met, fhall be a board or quorum, and a majority of them shall be capable of doing and transacting all the business and concerns of the faid college, not otherwise provided for by this act; and particularly of making and enacting ordinances, for the government of faid college, of filling vacancies in the board of trustees, occafioned by death, refignation, or otherwife; of electing and appointing the principal, and profeffors of the faid college; of agreeing with them for their falaries and ftipends, and removing them for misconduct, or breach of the laws of the inftitution; of appointing committees of their own body to carry into execution, all and every the refolutions of the board; of appointing a treasurer, fecretary, ftewards, managers, and other neceffary and cuftomary officers, for the taking care of the estate, and managing the concerns of the corporation: and a majority of the board or quorum, of the faid trustees at any annual or adjourned meeting, after notice given as aforefaid, fhall determine all matters and things, (although the fame be not herein. particularly mentioned) which fhall occafionally arife, and be incidentally necessary to be determined and tranfacted by the faid truftees: Provided always, That That no ordinances fhall be of force, which fhall be repugnant VOL.
