Provided always, that such Captain or Subaltern of Militia, or Road Officer, shall first have been furnished by the said Commissioner or Commissioners, with a copy of this Act, the Schedule thereunto annexed, and a Certificate in the form of the Schedule C, distinctly marking the limits for which such Captain or Subaltern, or Road Officer is to make such Enumerarion or Return, unassisted by such Commissioner or Commissioners.

V. VI. V. Et qu'il soit de plus statué par l'autorité susdite, que tout Commissaire ou Commissaires nommés comme susdit, ou aucun Capitaine, Subalterne de Milice, ou Officier des Chemins employé par tel Commissaire ou Commissaires qui, en autant qu'ils ou aucun d'eux sont respectivement intéressés, refuseront ou négligeront de faire ou faire faire l'Enumération requise par cet Acte, ou feront négligemment, volontairement ou sciemment une fausse énumération et retour, encourront une amende et pénalité de vingt-cinq livres, argent courant de cette Province, en sus de la perte de toute compensation qu'il ou ils pourroient avoir reçue, ou à laquelle il ou ils pourroient avoir droit en vertu de cet Acte, et le dit Commissaire ou Commissaires, ou telle autre Personne que le Gouverneur, Lieutenant-Gouverneur, ou la Personne ayant l'Administration du Gouvernement de cette Province pour le tems d'alors, pourra nommer, procédera ou procéderont incessamment de nouveau à faire ou à faire faire une vraie Enumération et retour, tel que ci-devant pourvu au présent.

VI. Et qu'il soit de plus statué par l'autorité susdite, que les Commissaires qui seront nommés en vertu de cet Acte feront lire cet Acte publiquement à la Porte de l'Eglise de la Paroisse ou Township où doit être faite telle Enumération comme susdit, immédiatement après le service divin du matin, deux Dimanches ou fêtes qui seront quinze jours au moins avant de procéder à l'Enumération telle qu'ordonnée par cet Acte, et dans le cas où il n'y auroit pas d'Eglise dans telle Paroisse ou Township, alors il sera notifié par écrit et affiché aux endroits les plus publics dans telle Paroisse ou Township comme susdit, que le dits Commissaires, au tems qui sera par eux fixé et mentionné dans telle annonce, aprèsl'expiration de quinze jours d'avis comme susdit, procéderont à faire l'Enumération tel qu'il est ordonné par cet Acte.

VII. And be it further enacted by the authority aforesaid, that the fines and Fines and for forfeitures incurred under this Act, shall, except as otherwise it is herein-before provided, be recovered by Action in the Court of King's Bench for the District in which the offence shall have been committed, by any person suing for the same; and one half of every such fine or penalty shall be paid to the ReceiverGeneral, for the public uses of the Province, and for the support of the Government thereof, and shall, as well as the monies which may be expended and paid by virtue of this Act, be accounted for to His Majesty, his Heirs and Successors, through the Lords Commissioners of His Majesty's Treasury for the time being, in such manner and form as His Majesty, his Heirs and Successors shall direct, and the other half to the Informer suing for the same, with the costs incurred in the prosecution thereof. Provided always, that if any Suit or Action be brought against any person or persons for any penalty by this Act imposed, such Suit or Action shall be commenced within six months next after the offence committed, and not afterwards.

VII. Et qu'il soit de plus statué par l'autorité susdite, que les Amendes et Confiscations encourues en vertu de cet Acte, seront recouvrées (excepté dans les cas où il est autrement pourvû par le présent Acte) par Action dans aucune confiscations seCour du Banc du Roi pour le District dans lequel l'offense aura été commise, par la Personne qui poursuivra pour icelles, et la moitié de toute telle amende ou pénalité sera payée au Receveur-Général, pour les usages publics de la Province, et pour le soutien du Gouvernement d'icelle, et il en sera rendu compte, ainsi que des argens dépensés et payés en vertu de cet Acte, à Sa Majesté, Ses Héritiers et Successeurs, par la voie des Lords Commissaires de la Trésorerie de Sa Majesté, pour le tems d'alors, en telles manière et forme que Sa Majesté, Ses Héritiers et Successeurs l'ordonneront, et l'autre moitié au Dénonciateur poursuivant pour icelles avec les dépens encourus dans la poursuite d'icelles. Pourvû toujours, que s'il est intenté aucune poursuite ou action contre aucune personne ou personnes pour aucune pénalité imposée par cet Acte, telle poursuite ou action sera commencée sous six mois aprés l'offense commise, et non après.
