§ 68. The persons receiving the assignments mentioned in the last preceding section, shall be entitled, upon the redemption of the property, to receive the amount paid by them to the said Mayor, Aldermen and Commonalty, with interest, from the time of such payment, at the same rate, and in the same manner, as if they had purchased the property at a sale for assessments.

§ 69. In all cases of lands and premises purchased by the Mayor, Aldermen and Commonalty for assessments, in which the same shall not have been assigned, as provided in the 67th section of in this act, any person may redeem the same previous to the time when the Mayor, Aldermen and Commonalty shall be entitled to a lease of such lands and premises by paying, in the manner provided by this act, for the use of the said Mayor, Aldermen and Commonalty, the purchase money, with seven per cent. interest thereon, together with any expense which shall have accrued since the sale.

AN ORDINANCE

TO ESTABLISH A BUREAU IN THE STREET COMMISSIONER'S DEPARTMENT.

§ 1. There shall be a bureau in the Street Commissioner's Department, to be called "The Bureau of Railroads," the head of which shall be called the Superintendent of Railroads, who is charged with the duty of making, regulating

and repairing such railroads as my be ordered by the Common Council, and of performing such duties in relation to railroads already established by law, as the Common Council, from time to time, may by ordinance direct.

§ 2. Before entering upon the duties of his office, the Superintendent of Railroads shall execute a bond to the Corporation, with one or more surities, to be approved by the Comptroller, in the penal sum of thousand

dollars, conditioned for the faithful performance of the du

ties of his office.

§3. He shall make all estimates required for the construction of such railroads as may be ordered by the Common Council, oversee and superintend the building of the same; keep a correct account of all moneys appropriated for that purpose, and report the same, under oath, to the Comptroller, once in each month; all expenditures for labor and materials in the construction of railroads, shall be made under contracts, to be submitted to and approved of by the Common Council. And it shall be his duty, generally, to execute the ordinances and resolutions of the Common Council, applicable to railroads.

§ 4. When a railroad shall be ordered to be built over a line of streets, it shall be the duty of the superintendent to report to the Common Council the length of the line, the form of the rail best adapted to the line; the mode of building; the amount of materials, and the probable cost; the probable amount of travel over the same, and all such other facts as may enable the Common Council to judge of the expediency of prosecuting the work. And when the

road shall be determined on, it shall be his duty to advertise for proposals for building the same, upon specifications approved by the Common Council. And when the railroad shall be completed and accepted by him, it shall be his duty to advertise for proposals for equiping and using the same, under such rules and regulations as the Common Council may determine; but in any offers which shall be made for the use of said roads preference shall be given in all cases in the offers so made, to persons interested in any lines of omnibus injuriously effected by the building of said road.
