.86 At to authorife Thomas Porteous, Efquire, to build a Bridge over a branch of the river Outaouais, otherwife des Prairies, from Lachenaye to the Ille called Bourdon; "and another Bridge, from that Ifland to the Island of Montreal, to establish the rates of Toll payable thereon, and for regulating the faid Bridges," it is amongst other things enacted, that if, at any time after the faid Bridges fhall have been erected and completed, they fhall become impaffable or unfafe for Travellers, Cattle or Carriages, he the faid Thomas Porteous, his heirs, executors, curators or affigns, fhall, within eighteen months after the fame fhall be afcertained, and notice thereof given by His Majefty's Court of General Quarter Seffions of the Peace, in and for the Liftrict of Montreal, repair or rebuild the fame, on pain of forfeiting all his right, title or claim of, into, or out of the laid Bridge. And whereas the faid Thomas Porteous, in virtue of the afore recited Act, did caufe the faid Bridges to be erected and opened, at a great expence. and that the fame were unfortunately carried away by the breaking up of the ice, laft fpring, to the great damage of the laid Thomas Porteous, and to the great inconvenience of the Public; and that he hath ftated, by his humble petition to the Legiflature, that the time fo allowed for rebuilding as afore faid, is not fufficient: for remedy whereof; May it pleafe Your Majefty that it may be enacted, and be it enacted by the King's Most Excellent Majefty by and with the ad vice and consent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of, and under the authority of an A&t paffed in the Parliament of Great Britain, intituled, " An Act to repeal certain, parts of "an Act, paffed in the fourteenth year of His Majesty's, reign," intituled, "At for making more effectual provifion for the Government of the Province of Que"bec in North America," and to make further provifion for the Government of the "faid Province," and it is hereby enacted by the authority of the fame, that there fhall be allowed and granted unto the faid Thomas Porteous a delay of fix years from and after the paffing of this Act for rebuilding the faid Bridges. Provided always, that nothing in the prefent A&t, fhall be held or conftrued to change, alter, or amend any other part of the above recited Act, of the forty fifth year of His prefent Majefty's reign, Chapter fourteenth, which faid Act, in every other refpect, shall remain in full force and effect, as if this A&t had never been palled.. II. And whereas it may be neceffary for the purpose of effecting a communica. tion with the said Bridge, to change the direction of the King's highway, in the vi cinity thereof, or to open a new highway or highways. Be it further enacted by the authority aforesaid, that it fhall be lawful for the Grand Voyer, or his deputy of the faid Diftrict of Montreal, to fend an order to the Surveyor of highways, in every Parifh through which the faid King's highway or highways may pafs, to be by him read and publifhed in the ufual manner, at the Church door of every such Parish; in which order the faid Grand Voyer or his Deputy, fhall require the perfons interested in the King's highway or highways to meet, on the day and at the hour and place which he hall fix, to give fuch information as they may judge neceffary or proper, and after such meeting, the faid Grand Voyer, or his Deputy, fhall go upon the fpot to change the direction of fuch part or parts of the said King's highway or highways or bye roads, and open fuch other highways or highways, bye road or bye roads as may be neceffary for communicating with the faid Bridge; and the faid Grand Voyer, or his Deputy, fhall fix and allot the work to be performed, and by whom, upon fuch parts of the King's highway or highways to be so as aforefaid changed, and upon fuch highway or highways, bye road or bye roads, which fhall be opened as a forefaid, of all which he fhall make his Procès Verbal to be heard, examined and determined upon, in due courfe of law. III. And be it further enacted by the authority aforefaid, that the faid Bridge vefted in Thomas and the faid Toll Houfes, Turnpikes and conveniencies to be erected thereon, or near thereto, and alfo the afcents and approaches to the faid Bridge, and all materials which fhall be from time to time gotten or provided, for ere&ting, building, making, maintaining and repairing the fame, fhall be vested in the faid Thomas Porteous, his heirs and affigns for ever.
