Preamble. Clause in A& 45. Geo. III. Cap. 10 recited. CA P. IX. AN ACT to provide a temporary Goal for the District of Montreal. (14th April, 1808.) WHE 66 HEREAS in and by an Act made and passed in the forty fifth year of His Ma jelly's reign, intituled, "An Act to provide for the erecting of a Common Gaol, "in each of the Districts of Quebec and Montreal, refpectively, and the means for defraying the expences thereof." It is amongst other things enacted, that the Commif fioners to be appointed by virtue of the faid Act, or any two of them, in each of the faid Districts refpe&ively, shall cause to be erected and finished, one ftrong and fubftantial Common Gaol, on the Lots of Ground in the faid Cities of Quebec and Montreal, refpectively, belonging to His Majefty, and intended to be appropriated by His Majefty for that purpose. And Whereas the faid new Common Gaol for the District of Montreal, is about to be erected upon the Seite of the prefent Gaol, for the faid Diftrict of Montreal, and it is therefore neceffary to provide a temporary Gaol for the faid Diftrict of Montreal. Be it therefore enacted by the King's Mot Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by vir tue of, and under the authority of an A&t paffed in the Parliament of Great Britain, intituled: "An Act to repeal certain parts of an Act paffed in the fourteenth year of his Majefty's reign," intituled, " An Act for making more effectual pro "vifion for the Government of the Province of Quebec in North America, and to make further provifion for the Government of the faid Province." And it is hereby enac ted by the authority of the fame, that it fhall and may be lawful, to and for the Sheriff of the faid Diftrict of Montreal, to remove the Prifoners in the said present Gaol being, to fuch place or places, House or Houfes, Building or Buildings, with to fuch place as in the faid District of Montreal, as the Governor, Lieutenant Governor or Perfon adminiftering the Government of this Province for the time being, by warrant under his Hand and Seal at Arms, shall appoint for the reception and confinement of Prifoners, until the faid new Common Gaol fhall be erected and finifhed; and that fuch Place or Places, House or Houses, Building or Buildings, to appointed, shall be and be deemedand held to be the Common Gaoi of, and for the faid District of Montre al, until the faid new Common Gaol fhall be erected and finished, and the Prisoners there in cuftody, be thereunto removed, under the directions for that purpose given, in and by the above in part recited Act. areal impowered to remove the Pri. foners confined in the Governor may appoint, [Such place to be deemed the Com mon Gaol, until Gaol be read, to which Gaol Prifoners fhall be a New Common when finished, removed and con fined. AN ACT for extending the duration of the Patent granted for erecting the Bridge over the river Saint Charles, now called,Dorchester Bridge. W (14 h April, 1808.) HEREAS His Majefty's Letters Patent were granted on the twenty fecond day of April in the year of our Lord, one thoufani feven hundred and eighty nine, by His Excellency the Right Honorable Guy Lord Dorchester, then Governor in Chief of this Province, unto Nathaniel Taylor, John. Coffin, William Lindsay, David Lynd, Peter Stuart, Charles Stewart, and James Johnston, Elquires, and Ralph Gray and John Purfs, Gentlemen, their heirs and affigns, for constructing a Bridge, over the River Saint Charles, whereby th y were authori ed for, and during the term of fifty years, from the date of faid Letters Patent, to col lect, and receive certain Tolls for paffing the faid Bridge, and conditioned that the fame, (now called Dorchefter Bridge,) fhould be delivered up to His Majefty in good and fi.fficient condition, at the end of the faid term, free of any coft or expence. And Whereas an Act was paffed in the thirtieth year of His Majefty's reign, inti tuled, "An Act or Ordinance for fecuring more effectually the Toll of the Bridge "over the River Saint Charles, near Quebec, whereby the faid Tolls were confir med, and whereas the faid Bridge having been erected at a heavy expence, with a very doubtful prospect of advantage to the Proprietors, and being of great public utility and convenience, as alfo the firft Toll Badge erect d within this Province, the Proprietors thereof, merit the like favorable terms, as have been granted to any fucceeding Budge Proprietor. And Whereas a Toll Bridge has been fince erect.d, under the authority of an Act of the Legislature, at the expence of an individual, in whom, his heirs and affigns the fame is vefted for ever, with a power of atlumption by His Majefty, after the expiration of fifty years, upon paying to the Proprietor the full value of the lame, at the time of tuch,affumption. Préambules Citation d'un A&te ou Ordon. nance de la gore. ATTENDU que les Lettres Patentes de Sa Majesté furent accordées le vingtdeuxième jour d'Avril, dans l'année Mil fept cent quatre-vingt neuf, par Son Excellence le très Honorable GUY LORD DORCHESTER, alors Gouverneur en Chef de cette Province, à Nathaniel Taylor, John Coffin, William Lindfay, David Lynd, Peter Stuart, Charles Stewart et James Johnfton, Ecuiers, et à Meffieurs Ralph Gray et John Purfs, leurs Hoirs et ayans caufe, pour conftruire un Pont fur la Rivière Saint Charles, par lefquelles ils furent autorifés, pour et durant le terme de cinquante années, à compter de la date des dites Lettres Patentes, de prélever et recevoir certains péages pour paffer fur le dit Pont, aux conditions que le dit Pont (actuellement appellé Pont Dorchefter) feroit délivré à Sa Majefté en bon et fuffifant état, au bout du dit terme, fans qu'elle fut tenue à aucuns frais et dépenses; Et attendu qu'un Acte fut paffé dans la trentième année du Regne de Sa Majefté, intitulé, "Acte ou Ordonnance qui affure plus efficacement le droit de Pontage du "Pont fur la Rivière Saint Charles, près Quebec," par lequel les dits péages font confirmés; Et comme le dit Pont a été conftruit à grands frais, avec la peripective très Geo, III. cap. 3. douteuse d'un avantage pour les propriétaires, et qu'il eft d'une grande utilité et commodité pour le public, de même auffi qu'il eft le premier Pont de péage érigé dans cette Province, et que conféquemment les propriétaires méritent les mêmes conditions favorables qui ont été accordées enfuite à tout propriétaire de Pont: Et attendu qu'un Pont de péage a été depuis érigé fous l'autorité d'un Acte de la Législature, aux frais d'un feul individu, auquel, ainsi qu'à fes Hoirs et Ayans caufé, la, propriété du dit Pont eft donnée pour toujours, avec pouvoir à Sa Majefte de le reprendre après l'expiration de cinquante années, en payant au propriétaire l'entière valeur d'icelui au tems de telle prife de poffeffion: Quil plaife donc à Votre Majefté qu'il puiffe être ftatué, et qu'il foit ftatué par la très Excellente Majefté du Roi, par et de l'avis et co lentement du Confeil Législatif et de l'Affemblée de la Province du Bas Canada, conftitués et affemblés en vertu.et fous l'autorité d'un Acte |
