CA P. VII.

AN ACT for applying certain Sums of Money therein mentioned, to complete the Bridge over the River Jacques Cartier, and to open and improve the road leading towards the faid Bridge.

(25th March, 1805.)

WHEREAS the fum of five hundred Pounds current money of this Province, by Your Majesty's Orders has been iffued and advanced to the Commiffioners, appointed by virtue of and under the authority of an A&t paffed in the fortieth year of Your Majesty's Reign, intituled, "An Act for erecting a Bridge over At 40 Gro. III. "the river Jacques Cartier," May it therefore please Your Majefty that it may be enacted, and be it enacted by the King's moft Excellent Majefty, by and with the advice and consent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an Act, paffed in the Parliament of Great Britain, intituled, "An Act to repeal "certain parts of an A&t paffed in the fourteenth year of his Majefty's Reign, "intituled, "An Act for making more effectual provifion for the Government of the "Province of Quebec in North America," and to make further provifion for the "Government of the faid Province;" and it is hereby enacted by the authority of the fame, that out of the furplus of any fund or funds fubject to the difpofition of the Provincial Parliament, under the authority of an Act paffed in the thirty fifth year of his Majefty's Reign, intituled, "An Act for granting to his Majefty, additional and new duties on Goods, Wares and Merchandifes, and for appropria "ting the fame towards further defraying the charges of the adminiftration of Fultice "and fupport of the Civil Government within this Province, and for other purpofes "therein mentioned." And alfo under and by virtue of another A&t paffed in the thirty fifth year of his Majesty's Reign, intituled, "An Act for granting to his MaA& 35 Geo. III, « jefty, Duties on Licences to Hawkers, Pedlars and Petty Chapmen, and for regulating "their Trade, and for granting additional Duties on Licences to perfons for keeping Houfes for Public Entertainment, or for retailing Wine, Brandy, Rum, or other "Spirituous Liquors in this Province, and for regulating the fame, and for repealing "the Act or Ordinance therein mentioned." And alfo under and by virtue of aA&t 41 Geo: III.❝nother A&t, paffed in the forty first year of his Majefty's Reign, intituled, "An "Act for granting to his Majefty certain new Duties on the importation into this Pro"vince, of all manufactured Tobacco and Snuff, and for disallowing the Drawback on "Tobacco manufactured within this Province," and now remaining in the hands of the Receiver General of this Province, unappropriated, there fhall be iffued and applied, the fum of Five hundred Pounds, current money of this Province, to make good the like fum which has, so as aforefaid, been issued and advanced by his Majefty's orders.

vince, a été payée et avancée par les Ordres de Votre Majefté aux Commiffaires nommés en vertu et fous l'autorité d'un Acte paffé dans la Quarantième Année du Règne de Votre Majefté, intitulé," Acte pour ériger un Pont fur la Rivière Jacques Cartier," Qu'il plaife donc à Votre Majefté qu'il puiffe être ftatué, et qu'il foit ftatué par la Très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil Législatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un Acte du Parlement de la Grande-Bretagne, intitulé, " Acte qui rappelle certaines parties d'un Acte paflé "dans la quatorzième Année du Règne de Sa Majefté, intitulé, "Acte qui pourvoit plus efficacement pour le Gouvernement de la Province de Québec dans l'Amérique Sep"tentrionale;" et qui pourvoit plus an.plement pour le Gouvernement de la dite "Province;" Et il eft par le préfent ftatué par l'autorité fufdite, que fur le furplus d'aucun des Fonds fujets à la difpofition du Parlement Provincial fous l'au torité d'un Acte paffé dans la Trente-cinquième Année du Règne de Sa Majefté, intitulé," Acte qui accorde à Sa Majefté des droits nouveaux et additionels fur cer"taines Marchandifes et Effets, qui les approprie à fournir des moyens plus amples "de défrayer les dépenfes de l'Adminiftration de la Justice, et au foutien du Gouvernement Civil de cette Province, et à d'autres effets y mentionnés ;" et auffi fous et en vertu d'un autre Acte paffé dans la Trente-cinquième Année du Règne de Sa Majesté, intitulé, “Acte pour accorder à Sa Majesté des Droits fur les Licences de Colporteurs, Porte-Caffettes et Petits Marchands, et pour règler leur trafic, et pour "accorder une augmentation de Droits fur les Licences de perfonnes qui tiennent des "Maifons publiques, ou qui détaillent du Vin, de l'Eau-de-vie, Rum ou aucune autre "Liqueur forte dans cette Province, et pour les règler, et pour abroger un Acte ou "Ordonnance y mentionnée;" et auffi fous et en vertu d'un autre Acte paffé dans la Quarante-unième Année du Règne de Sa Majefté, intitulé," Acte qui accorde à "Sa Majesté certains droits nouveaux fur l'importation dans cette Province de tout 111. "Tabac manufacturé et Tabac en poudre, et qui retranche les Rabais fur le Tabac ma"nufacturé dans cette Province," et actuellement reftant entre les mains du Receveur Général de cette Province non-approprié, il fera payé et employé la Somme de Cinq cents Livres Argent courant de cette Province, pour rembourfer pareille Somme qui a été ainfi, comme fufdit, payée et avancée par les Ordres de Sa Majesté.

II. And whereas certain work is yet neceffary for completing the faid Bridge; be it therefore enacted by the authority aforesaid, that it fhall and may be lawful to and for the Governor, Lieutenant Governor, or perfon adminiftering the Government of this Province, for the time being, out of any unappropriated monies which now are, or at any time hereafter fhall be in the hands of the Receiver General of this Province, to caufe to be iffued to the Commiffioners appointed for erecting the faid Bridge, over the faid River Jacques Cartier, or their Succeffors in office, any fum, not exceeding the fum of Two Hundred Pounds current money aforefaid, to be by them applied and expended, in completing the faid Bridge.

III. And be it further enacted by the authority aforefaid, that it fhall and may Quebec empow be lawful to and for the Grand Voyer of the faid Diftrict of Quebec, for the ered to compound time being, to compound, yearly, and every year, with any perfon or perfons living in the vicinity of the faid Bridge, for the Tolls to be paid by fuch perfon or persons, his, her and their families, fervants, horfes and carriages, paffing and repaffing by the faid Bridge, and to agree for, and receive from fuch perfon or perfons, fuch fum and fums of money, as he, in his direction, fhall think a reasonable compofition for the probable amount of the Tolls to be incurred and paid by fuch perfon or perfons, his, her and their families, fervants, horses, and carriages, paffing and repaffing the faid Bridge, for and during the term of one year next enfuing, from the time of making fuch compofition, as aforefaid.

IV. V. And be it further enacted by the authority aforefaid, that the due appli cation of the faid fums of money pursuant to the directions of this Act, shall be accounted for to His Majefty, his Heirs and Succeflors, through the Lords Commiffioners of His Majefty's Treafury, in fuch manner and form, as His Majefty, his Heirs and Succeffors fhall direct.

II. Et attendu que certains ouvrages font encore néceffaires pour parachever le dit Pont, qu'il foit donc ftatué par l'autorité fufdite, qu'il fera et pourra être loifible d'accorder au Gouverneur, Lieutenant Gouverneur ou à la Perfonne ayant l'administration du Commiffaires £ 200 de plus. Gouvernement de cette Province, pour le tems d'alors, de faire avancer, à même aucuns des Argens qui feront ci-après, en aucun tems que ce foit, entre les mains du Receveur Général de cette Province, aux Commiffaires nommés pour ériger le dit Pont fur la dite Rivière Jacques Cartier, ou à leurs Succeffeurs en Office, aucune Somme quelconque, n'excédant point la Somme de Deux cents Livres, Argent courant fufdit, pour être employée et dépensée à achever le dit Pont.

III. Et qu'il foit de plus ftatué par l'autorité fusdite, qu'il fera et pourra être loifible au Grand Voyer du dit Diftrict de Québec pour le tems d'alors, d'entrer en composition annuellement et chaque Année avec toute perfonne ou perfonnes de meurant dans les environs du dit Pont, pour les péages à être payés par telle perfonne ou perfonnes, fa famille ou leurs familles, domeftiques, chevaux et voitures paffant et repaffant fur le dit Pont, et de convenir et recevoir de telle perfonne ou perfonnes telle Somme et Sommes d'Argent qu'à fa discrétion il croira être une compofition raisonnable pour le montant des péages que telle perfonne ou perfonnes, fa famille ou leurs familles, domeftiques, chevaux et voitures auroient probablement eu à payer pour paffer et repaffer fur le dit Pont, durant le Terme d'une Année, à compter du tems que telle compofition fera faite comme fusdit.

IV. Et attendu qu'il fera très avantageux d'améliorer le chemin qui conduit au dit Pont du Village de l'Ancienne Lorette par l'intérieur des Paroiffes de Saint Auguftin et de la Pointe aux Trembles, Qu'il foit donc ftatué par l'autorité fufdite, qu'il fera et pourra être loifible au Gouverneur, Lieutenant Gouverneur ou à la Perfonne ayant l'administration du Gouvernement de cette Province pour le tems d'alors, de faire payer au Grand Voyer du District de Québec pour le tems d'alors, fur quelques-uns des Argents non-appropriés qui font actuellement ou feront ciaprès en aucuns tems que ce foit, entre les Mains du Receveur Général de cette Province, une Somme quelconque n'excédant point Deux cents Livres, Argent courant fufdit, pour être par lui employée et dépensée à améliorer le dit Chemin.

V. Et qu'il fuit de plus ftatué par l'autorité fufdite, qu'il fera tenu compte à Sa Majefté, Ses Héritiers et Succeffeurs, par la voie des Lords Commiffaires du Tréfor de Sa Majefté, de la due application des dites Sommes d'Argent conformément aux directions de cet Acte, en telles manière et forme que Sa Majefté, fes Héritiers et Succeffeurs l'ordonneront.

An Act to continue, for a limited time, the powers granted to certain Commissioners, by an Act, intituled, " An Act for removing the old "Walls and Fortifications that surround the City of Montreal, and "otherwise to provide for the salubrity, conveyance and embellishment of the faid City," and for extending the faid powers, in certain cases.

WHEREAS an A&t paffed the Legislative Council and Affembly of this

Province, which was affented to by his Majefty in his Privy Council, in the forty fecond year of his reign, intituled, "An Act for removing the old walls "and fortifications that furround the City of Montreal, and otherwife to provide for the falubrity, convenience and embellishment of the faid City," and which A& in refpect to the duration of the powers of the Commiffioners to be appointed under the fame, was limited to three years, to be computed from the day of the date of their Commiffion, and which Commiffion being dated on the fecond day of October, in the faid forty fecond year of his Majefty's reign, the said powers, unlefs continued, will expire on the fecond day of October next; and it be. ing expedient and neceffary, that the faid powers fhould be continued beyond that period, in order to enable the Commiffioners which are, or fhall be appointed under the faid Act, more effectually to carry the fame into execution. May it therefore please your Majesty, that it may be enacted, and be it enacted by the King's most excellent Majesty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an A& paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act "paffed in the fourteenth year of his Majefty's Reign, intituled, "An Act for making more effectual provifion for the Government of the Province of Quebec in North "America," and to make further Provifion for the Government of the faid Pro"vince;"" And it is hereby enacted by the authority of the fame, that all and every Powers of the of the powers of the Commiffioners, and of their Treafurer, which have been or fhall be appointed in conformity to the Provisions of the Act firft abovementioned, is and are hereby continued and fhall remain in full force and effect, for and during the space of three years, from and after the faid fecond day of October next, and from thence to the end of the next Seffion of the Provin cial Parliament,
