Scott, President pro tempore of the Senate, on warrant drawn by the Auditor General on presentation of proper vouchers.

Section 39. For contingent expenses of the State Highway DepartHighway Department, for two years, the sum of eight thousand dollars ($8,000).

Approved-The fifteenth day of May, Anno Domini one thousand nine hundred and three, except as to the following items:

Executive Department.

Section 2, the item which provides as follows: "For the payment of contingent expenses, two years, the sum of three thousand dollars, or so much thereof as may be necessary." This item is approved in the sum of $2,800. I withhold my approval from the remainder of said item, for the reason that the clerk, heretofore paid out of the contingent fund of $4,000, is now provided for by law, and his entire salary deducted from that fund would leave $2,800, and not $3,000.

State Department.

Also the item which provides as follows: "For the payment of contingent expenses, two years, the sum of seven thousand five hundred dollars, or so much thereof as may be necessary." This item is approved in the sum of $6,000. I withhold my approval from the remainder of said item, for the reason that the clerks, heretofore paid out of this fund, are now regularly provided for by law.

Attorney General's Department.

Also the item which provides as follows: "For the payment of the contingent expenses, two years, the sum of two thousand dollars, or so much thereof as may be necessary." This item is approved in the sum of $1,400. I withhold my approval from the remainder of said item, for the reason that the messenger, heretofore paid out of this fund, is now regularly provided for by law.

Department of Internal Affairs.

Also the item which provides as follows: "For the payment of the salary of the chief draftsman of the Department of Internal Affairs, two years, the sum of four thousand eight hundred dollars." This item is approved in the sum of $4,000. I withhold my approval from the remainder of said item, for the reason that the act of Assembly creating the office of chief draftsman fixes his salary at $2,000 per annum.

Also the item which provides as follows: "For the payment of the salaries of the other officials, clerks and employes in the Department of Internal Affairs, two years, the sum of ninety-three thousand two hundred dollars." This item is approved in the sum of $80,600. I withhold my approval from the remainder of said item, for the reason that the Bureau of Mines has been removed from the Department of Internal Affairs, as provided in the act of Assembly creating the Department of Mines, approved the 14th day of April, A. D. 1903; also for the reason that the salary of the chief draftsman is provided for in a separate item.

Also the item which provides as follows: "For the payment of the contingent expenses of the Bureau of Mines of the Department of Internal Affairs, the sum of three thousand dollars, or so much thereof as may be necessary, for the two years beginning June first, one thousand nine hundred and three." I withhold my approval from this item, for the reason that the act approved April 14, 1903, creating the Department of Mines, removes the Bureau of Mines from the Department of Internal Affairs.

Also the item which provides as follows: "For the temporary employment of draftsmen in the copying of surveys or other ancient papers, important to be preserved in the Land Office Bureau, as required by the act approved the sixteenth day of February, one thousand eight hundred and thirty-three (Pamphlet Laws, page forty-seven), the sum of fifteen thousand dollars for each of the two years beginning June first, one thousand nine hundred and three." This item is approved in the sum of $20,000. I withhold my approval from the remainder of said item, for the reason that the sum of $20,000 is sufficient to complete the work.

Public Grounds and Buildings.

Also the item which provides as follows: "For the payment of the general contingent fund, as provided for in section sixteen of the act of Assembly approved March twenty-sixth, one thousand eight hundred and ninety-five, two years, the sum of six thousand two hundred dollars, or so much thereof as may

be necessary." This item is approved in the sum of $6,000. I withhold my approval from the remainder of said item, for the reason that I know of no cause why the contingent fund of this department should be increased.

Department of Agriculture.

Also the item which provides as follows: "For the payment of the salary of the Commissioner of Horticulture, for two years, the sum of five thousand dollars, or so much thereof as may be necessary." I withhold my approval from this item for the reason that this office is not authorized by law.

Also the item which provides as follows: "For the payment of the salary of the clerk of the Division of Horticulture, for two years, the sum of three thousand dollars, or so much thereof as may be necessary." I withhold my approval from this item for the reason that this additional clerk is not authorized by law.

Department of Mines.

Also the item which provides as follows: "For the payment of contingent expenses, for two years, the sum of five thousand dollars, or so much thereof as may be necessary." This item is approved in the sum of $2,000. I withhold my approval from the remainder of said item, for the reason that the sum of $2,000 would seem to be sufficient for all the contingent expenses of this department.

Judiciary Department.

Section 3, also the item which provides as follows: "For the payment of the increase made in the salaries of the judges, under the act of April fourteen, one thousand nine hundred and three, the sum of three hundred and eighty-five thousand dollars, or so much thereof as may be necessary." I approve this item in the sum of $296,089. I withhold my approval from the remainder of said item, for the reason that the act approved April 14, A. D. 1903, specifies that the salaries begin from and after the first day of January, A. D. 1904.

Board of Pardons.

Section 15, also the item which provides as follows: "For the payment of postage, express charges, and other incidental expenses of the Board of Pardons, for the two fiscal years commencing June first, one thousand nine hundred and three, the sum of two thousand dollars, or so much thereof as may be necessary." This item is approved in the sum of $800. I

withhold my approval from the remainder of said item, for the reason that the clerk heretofore paid out of this fund is now regularly provided for by law. SAML. W. PENNYPACKER.

AN ACT

Making an appropriation to the American Art Society of Philadelphia, for the purpose of encouraging American art.

Section 1. Be it enacted, &c., That the sum of five thousand dollars be and the same is hereby specifically appropriated to the American Art Society of Philadelphia, for the two fiscal years beginning June first, one thousand nine hundred and three, for the purpose of encouraging American art.

AN ACT

To repeal so much of an act, entitled "An act to prohibit the sale of intoxicating liquors, wines, ale and beer, in certain boroughs and townships in the County of Allegheny," approved May thirteen, Anno Domini one thousand eight hundred and seventy-one, as relates to or affects the Borough of Glassport, formerly a part of the Township of Lincoln, in the County of Allegheny.

Section 1. Be it enacted, &c., That the act, entitled "An act to prohibit the sale of intoxicating liquors, Borough of Glass- wines, ale and beer, in certain boroughs and townships in the County of Allegheny," approved the thirteenth day of May, Anno Domini one thousand eight hundred and seventy-one, be and the same is hereby repealed, in so far as its provisions to or affect the Borough of Glassport, formerly a part of the Township of Lincoln, in the County of Allegheny and State of Pennsylvania.

I do certify that the above bill, entitled "An act to repeal so much of an act, entitled 'An act to prohibit the sale of intoxicating liquors, wines, ale and

beer in certain boroughs and townships in the County of Allegheny,' approved May thirteen, Anno Domini Act of May 18, one thousand eight hundred and seventy-one, as re- 1871, cited for relates to or affects the Borough of Glassport, formerly a part of the Township of Lincoln, in the County of Allegheny," was presented to the Governor on the fifteenth day of April, one thousand nine hundred and three, and was not filed by him, with his objections thereto, in the office of the Secretary of the Commonwealth, within thirty days after the adjourn ment of the General Assembly, wherefore it has, agreeably to the Constitution of this Commonwealth, become a law in like manner as if he had signed it.
