AN ACT

Amending the act, entitled "A further supplement to an act concerning divorces," approved May eighth, one thousand eight hundred and fifty-four, by providing that conviction for certain enumerated crimes only shall be cause for divorce, and repealing the act of June first, one thousand eight hunand ninety-one, relating to the same subject.

Section 1. Be. it enacted, &c., That the act, entitled "An act to amend the second subdivision of the first section of an act, entitled 'A further supplement to the act, entitled "An act concerning divorces,' approv ed May eighth, one thousand eight hundred and fiftyfour,' by extending to the courts jurisdiction to grant divorces when either of the parties has been or shall be convicted of forgery or any infamous crime, either within or without this State, and sentenced to imprisonment therefor," and approved on the first day of June, Anno Domini one thousand eight hundred and ninety-one, be and the same is hereby repealed.

Section 2. That the second subdivision of the first section of the act, entitled "A further supplement to the act, entitled 'An act concerning divorces,' approved May eighth, one thousand eight hundred and fiftyfour," which reads as follows:

AN ACT

To prevent the pasting, painting, branding, stamping, or placing of advertisements, notices, signs, cards, or posters in certain places, and providing penalties for the violation thereof. Section 1. Be it enacted, &c., That no person shall paste, paint, brand or stamp, or in any manner whatsoever place upon or attach to any building, fence, bridge, gate, outbuilding or other object, upon the grounds of any charitable, educational or penal institutions of the State of Pennsylvania, or upon any property belonging to the State of Pennsylvania or to any county, township, borough or city therein, any Bill, sign, notice Written, printed, painted or other advertisement, bill, notice, sign or poster: Provided, That nothing herein shall be so construed as to prevent the posting of any notice required by law or order of court to be posted, nor to prevent the posting or placing of any notice particularly concerning or pertaining to the grounds or premises upon which the same is so posted or placed

out the limits of a highway, any written, printed, painted, or other advertisement, bill, notice, sign, card or poster, without first having obtained the written consent of the owner, or tenant lawfully in possession or occupancy thereof: Provided, That nothing herein shall be so construed as to prevent the posting of any notice required by law or order of court to be posted, nor to prevent the posting or piacing of any notice particularly concerning or pertaining to the grounds or premises upon which the same is so posted or placed.

Section 3. Every person violating the provisions of this act shall be liable to a penalty of not less than five dollars nor more than twenty dollars, to be recovered before any magistrate or justice of the peace, as fines and penalties are by law recoverable; and such written, printed, painted, or other advertisement, bill, notice, sign, card, or poster is hereby declared to be a public nuisance, and may be removed and abated as such.

AN ACT

To amend section two of an act, entitled "An act to provide for the better protection of life and property by the examination and licensing of engineers having charge of steam boilers, steam engines, and appliances connected therewith, in cities of the first class in this Commonwealth, and providing penalties for violations," approved the eighteenth day of April, Anno Domini one thousand eight hundred and ninety-nine.

Section 1. Be it enacted, &c., That the second section of an act, entitled "An act to provide for the class. better protection of life and property by the examination and licensing of engineers having charge of steam boilers, steam engines, and appliances connected therewith, in cities of the first class in this Commonwealth, and providing penalties for violations," approved the eighteenth day of April, Anno Domini one thousand eight hundred and ninety-nine, which reads as follows: "Section 2. All persons claiming authority to perform the duties of engineer shall apply to the boiler inspector of such cities, who shall examine the applicant as to his knowledge of steam machinery and his experience as an engineer, also the proofs which he produces in support of his claim, and if, upon full consideration, the inspector is satisfied that the appli cants' character, habits of life, knowledge and experience in the duties of an engineer, are all such as to authorize the belief that he is a suitable and safe person to be entrusted with the powers and duties of such a station, he shall grant him a license, upon the payment of three (3) dollars, authorizing him to be employed in such duties for the term of one year, and such license shall be renewed, without examination, upon the payment of one dollar; but such license shall be suspended or revoked upon satisfactory proof of violation of any provision of this law. Whenever complaint is made against any engineer, holding a license authorizing him to take charge of boilers or machinery, that he has through negligence or want of skill permitted the boilers in his charge to burn or otherwise become in bad condition, or that he has not kept his engine or machinery in good working order, the inspector shall, upon satisfactory proof of such negligence or want of skill, revoke the license of such engineer," be amended so as to read as follows:

Character, experi- character, habits of life, knowledge, and experience in the duties of an engineer, are all such as to authorize the belief that he is a suitable and safe person to be entrusted with the powers and duties of such a station, he shall grant him a license, upon the payment of three (3) dollars, authorizing him to be employed in such duties for the term of one year, and such license shall be annually renewed, without examination, upon the payment of one (1) dollar, provided it is presented for renewal within ten days after its expiration. Licenses Grade of licenses. so granted shall be graded into two classes: One of which shall entitle the licensee to have charge of or to operate stationary steam boilers and steam engines only; the other of which shall entitle the licensee to have charge of or to operate portable steam boilers and steam engines only; such licenses shall not be transferred from one grade to the other without a reexamination, said re-examination to be conducted without cost to the licensee.

Eligibility for examination.

No person shall be eligible for examination for a license unless he furnishes proof that he has been employed about a steam boiler or steam engine for a period of not less than two years prior to the date of application, which must be certified to by at least one employer and two licensed engineers.

Vacancy in office of high constable or constable.

AN ACT

Supplementary to an act, entitled "An act to amend an act, entitled 'An act to authorize the election of constables for three years', approved the fourteenth day of February, Anno Domini one thousand eight hundred and eighty-nine, by providing for the election of a high constable of each of the boroughs of this Commonwealth for three years, and by correcting the ambiguity as to the beginning of the terms of office under said act," approved the twenty-sixth day of June, Anno Domini one thousand eight hundred and ninetyfive; making provisions for the filling of vacancies in the office of high constable in any borough, or in the office of constable in any borough, ward of any borough, or township of this Commonwealth.

Section 1. Be it enacted, &c., That whenever a vacancy may occur in the office of high constable in any borough in the Commonwealth of Pennsylvania, whether created by general or special law, or in the office of constable in any borough, ward of any borough, or township in said Commonwealth, by reason of failure to elect, failure to qualify, incompe
