DEAR MR. SPEAKER: I am transmitting herewith a partial report dated January 15, 1944, from the Chief of Engineers, United States Army, together with accompanying papers and illustrations, on a review of reports on the Arkansas River, Kans., Okla., and Ark., requested by resolutions of the Committee on Flood Control, House of Representatives, adopted on November 19, 1940, April 23, 1942, and July 2, 1943.

The Department approves of the submission of the report to Congress. In view of the large quantities of manpower, materials, and equipment involved in the proposed projects, and since they are not essential to the war effort, the Department desires that, if any of the proposed projects are approved, construction thereof be deferred until after the war.

The Bureau of the Budget has been consulted and advises that while there would be no objection to the submission of this proposed report to the Congress, in the absence of evidence showing that the proposed works are necessary to the prosecution of the war, the submission during the present emergency of any estimate of appropriation for the construction of the project would not be in accord with the program of the President.

MY DEAR MR. CHAIRMAN: 1. The Committee on Flood Control of the House of Representatives, by resolution adopted November 19, 1940, requested the Board of Engineers for Rivers and Harbors to review the report on Arkansas River, Little Rock to Pine Bluff, Ark., submitted in House Document No. 718, Seventy-sixth Congress, third session, with a view to determining whether any works for control of floods along Fourche Bayou are justified by present developments in this vicinity; under date of April 23, 1942, requested the Board of Engineers for Rivers and Harbors to review the report on Arkansas River and tributaries, submitted in House Document No. 308, Seventy-fourth Congress, first session, with a view to determining whether any improvement for flood control in Cypress drainage district, Perry and Conway Counties, Ark., is advisable at this time; and under date of July 2, 1943, requested the Board of Engineers for Rivers and Harbors to review the reports on the Arkansas River and tributaries contained in House Document 308, Seventyfourth Congress, first session, with a view to determining whether any modification should be made therein at this time with respect to local flood protection along the main stem of the Arkansas River. I enclose the report of the Board in response thereto. Insofar as the resolution of July 2, 1943, is concerned, this is a partial or interim report since it is limited to the section of the river between Great Bend, Kans., and Pine Bluff, Ark. which are, respectively, 878 and 111.1 miles above the river mouth. Extensive levee systems have been constructed by the United States on both banks of Arkansas River below Pine Bluff and that section does not require investigation under these resolutions. A separate report is in preparation for the river above Great Bend. Cypress drainage district, referred to in the resolution of April 23, 1942, borders Arkansas River on the right bank between miles 217 and 218.1. Fourche Bayou is a short tributary which enters Arkansas River just below Little Rock, mile 165.5. Thus it is appropriate to cover the resolutions of November 19, 1940, and April 23, 1942, in this report on the main stem of Arkansas River.

2. After full consideration of the reports secured from the district and division engineers, the Board recommends: (1) Modification of the following existing flood-control projects along Arkansas River, to provide for improvement in general accordance with the plans of the district engineer as described in his report and shown on the accompanying drawings with such changes therein as in the discretion of the

Chief of Engineers may be advisable, at estimated additional costs to
the United States for construction, not to include the cost of sanitary
sewage pumps, as indicated: Tulsa and West Tulsa, Okla., $133,000;
near Fort Gibson in Oklahoma, $260,100; Crawford County levee dis-
trict, Arkansas, $1,546,000; near Dardanelle in Arkansas, $122,500;
west of Morrilton in Arkansas, $855,000; Little Rock, Ark., including
protection of Fourche Bayou area and to include elimination of the
West End improvements, $465,200; south bank between Little Rock
and Pine Bluff, Ark., $790,000, and (2) the construction of improve-
ments for flood protection along Arkansas River at the following
localities, in general accordance with the plans of the district engineer
as described in his report and shown on the accompanying drawings
with such modifications thereof as in the discretion of the Chief of
Engineers may be advisable, at estimated costs to the United States
for construction, not to include the cost of sanitary sewage pumps, as
shown: Jenks, Okla., $264,000; Dirty Creek Bottom, Okla., $421,000;
Tucker Lake Bottom, Okla., $485,000; Braden Bottom, Okla.,$192,000
Big Skin Bayou-Camp Creek Bottom, Okla., $349,000; Moffett Bot-
tom, Okla., $957,000; Fort Smith, Ark., $898,600; Van Buren, Ark.,
$329,000; McLean Bottom levee district No. 3, Arkansas, $517,000;
Conway County levee district No. 6, Arkansas, $371,000; Conway
County levee districts Nos. 1, 2, and 8, Arkansas, $1,005,000; Roland
drainage district, Arkansas, $339,000; provided that no money shall
be spent on the construction of the improvements recommended under
(1) and (2) above until, for the unit of work considered, responsible
local agencies have given assurances satisfactory to the Secretary of
War that they will (a) provide without cost to the United States all
lands, easements, and rights-of-way necessary for the construction,
(b) suitably modify the approaches of the Arkansas River bridges which i
are planned to be raised and alter and construct any bridges required
across lesser water courses, (c) hold and save the United States free
from damages due to the construction works, and (d) maintain and
operate all works after completion in accordance with regulations pre-
scribed by the Secretary of War to include protection of the flood-
carrying capacity of the channel of Arkansas River at these localities.
3. After due consideration of these reports, I concur in the views
and recommendations of the Board.
