At Beaver Bay, Minn., breakwaters and dredging, as shown on plate 8 of maps in appendix I, at an estimated initial cost of $77,875, with annual maintenance estimated at $1,000; provided that local interests shall contribute $38,875 in cash toward the cost of the protective structures and dredging; furnish the right to obtain breakwater stone from the quarry at the northeast point of the bay; and comply with conditions 1, 2, 3, and 5 of paragraph 126 (c);

At Black River, Mich., entrance piers and dredging, as shown on plate 12 of maps in appendix I, at an estimated initial cost of $100,300, with annual maintenance estimated at $1,500; provided that local interests shall contribute $30,000 in cash toward the cost of the protective structures and dredging; and comply with conditions 2, 3, and 5 of paragraph 126 (c).

At Eagle Harbor, Mich., breakwater, dredging, and removal of one old guide pier, all as shown on plate 14 of maps in appendix I, at an estimated initial cost of $55,600, with annual maintenance estimated at $500; provided that local interests shall contribute $27,800 in cash toward the cost of the protective structure, removal of guide pier, and dredging; and comply with conditions 1, 2, 3, and 5 of paragraph 126 (c).

125. A chain of harbors of refuge for light-draft craft would provide a marine highway similar in many respects to Federal aid highways for vehicular traffic. The Federal contribution toward the construction of Federal aid highways for vehicular traffic is 50 percent of the cost. In view of the distribution of benefits to be derived, it is the opinion of the special board that the Federal Government should also bear 50 percent of the cost of providing harbors to be used strictly for refuge for light-draft craft. In special cases where harbors are to be used jointly for commercial and refuge purposes, the 50-percent rule should be applied only to that part of the cost applicable to refuge purposes.

RECOMMENDATION

LAKE SUPERIOR

126. The special board recommends:

(a) That the following improvements be provided by the United States subject to prior compliance, in a manner satisfactory to the Secretary of War, with all specified conditions of local cooperation. At Chippewa Harbor, Isle Royale, Mich., dredging as shown on plate 2 of maps in appendix I, at an estimated initial cost of $41,000, with no annual maintenance required.

At Lutsen, Minn., breakwaters and dredging, as shown on plate 5 of maps in appendix I, at an estimated initial cost of $133,585, with annual maintenance estimated at $1,000; provided that local interests shall contribute $66,785 in cash toward the cost of the protective structure and dredging, and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c).

At Lac LaBelle, Mich., entrance piers, shore revetment, and dredging, as shown on plate 15 of maps in appendix I, at an estimated initial cost of $76,380, with annual maintenance estimated at $1,000; provided, that local interests shall contribute $38,190 in cash toward the cost of the protective structures and dredging; and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c).

At Grand Traverse Bay, Mich., entrance piers, shore revetment, and dredging, as shown on plate 16 of maps in appendix I, at an estimated initial cost of $76,560, with annual maintenance estimated at $1,000; provided that local interests shall remove all structures from the area to be improved; and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c).

At Big Bay, Mich., entrance piers, shore revetments, and dredging, as shown on plate 18 of maps in appendix I, at an estimated initial cost of $75,765, with annual maintenance estimated at $1,000; provided that local interests shall contribute $38,000 in cash toward the cost of the protective structures and dredging; and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c).

At Little Lake, Mich., entrance piers, shore_revetments, and dredging, as shown on plate 19 of maps in appendix I, at an estimated initial cost of $115,340, with annual maintenance estimated at $1,000; provided that local interests shall contribute $57,670 in cash toward the cost of the protective structures and dredging; and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c).

At Whitefish Point, Mich., a south breakwater, extending the existing north breakwater, and dredging, all as shown on plate 20 of maps in appendix I, at an estimated initial cost of $156,950, with annual maintenance estimated at $1,000; provided that local interests shall comply with conditions 1, 2, 3, and 5 bf paragraph 126 (c).

(b) The above harbors are grouped as follows:

(c) That in order to insure completion of useful chains of harbors of refuge for through traffic no work shall be done by the United States at any harbor in any one of the above groups of harbors, until all conditions of local cooperation stipulated in paragraph 126 (a) have been complied with for all harbors in that group; except those noted for independent construction:

1. Assurance that a suitable and adequate public wharf will be constructed or provided for transient vessels.

2. Established a competent and properly constituted public body which is empowered to regulate the use, growth, and free develop ment of all harbor facilities (exclusive of United States Coast Guard and National Park Service property where such property is involved) on a nonprofit basis and in the best interest of the public.

3. Released the United States from all liability from claims for damage to lands and structures attributable to the dredging and construction operations.

4. Furnished suitable areas on shore for disposal of the material from the initial dredging.

5. Furnished the lands, rights-of-way, and easements necessary for the proposed work.

(d) That the full amount of the estimated cost of the improvement of at least each group of harbors listed in the immediately preceding subparagraph, less the amount to be contributed by local interests, be made available in one allotment, as completion of less than a full group or chain of harbors would not accomplish the purpose for which these improvements are recommended and justified and therefore would be of but little value to navigation, except that the estimated amounts for any one of the harbors justified on its own merits, less the amount to be contributed, should be available at one time.

(e) That if the required local cooperation at any individual locality tain a group of harbors is not furnished within 5 years after the authorization of the projects by Congress, the authorization for improvement of that group shall be null and void, except that this provision shall not prevent construction of any harbor noted above as justified on its own merits provided local cooperation is complied with for that harbor within said 5-year period.

(f) That no project for harbor improvement be adopted at Grace Harbor, Isle Royale, Mich.; Grand Portage; Tofte and Two Islands, 5. Minn.; Amnicon and Brule Rivers, Wis.; and Carvers Bay and L'Anse, in Mich., at this time. No improvements at Knife River, Minn., (c) additional to those recommended by the Chief of Engineers in House Document No. 686, Seventy-seventh Congress, second session, are considered at this time.

At St. James Harbor, Beaver Island, Mich., dredging, as shown on plate 9 of maps in appendix II (a), at an estimated initial cost of $15,000, with annual maintenance estimated at $1,500; provided, that local interests shall contribute $7,500 in cash toward the cost of the dredging and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c)

LAKE HURON

128. The special board recommends:

(a) That the following improvements be provided by the United States subject to prior compliance, in a manner satisfactory to the Secretary of War, with all specified conditions of local cooperation:

At Hammond Bay, Mich., breakwaters and dredging, as shown on plate 2 of maps in appendix III, at an estimated initial cost of $180,800, with annual maintenance estimated at $750; provided that local interests shall contribute $89,400 in cash toward the cost of the protective structures and dredging; and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c).

At Harrisville, Mich., breakwaters and dredging, as shown on plate 4 of maps in appendix III, at an estimated cost of $261,100, with annual maintenance estimated at $750; provided that local interests shall contribute $129,500 in cash toward the cost of the protective structures and dredging; and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c).

At Oscoda (Au Sable River), Mich., dredging and placing riprap protection on about 200 linear feet of the outer end of the north pier as shown on plate 5 of maps in appendix III, at an estimated initial cost of $36,800, with annual maintenance estimated at $2,000; provided that local interests shall contribute $16,400 in cash toward the cost of the jetty protection and dredging; and comply with conditions 2, 3, 4, and 5 of paragraph 126 (c).

At Port Austin, Mich., breakwaters and dredging, as shown on plate 7 of maps in appendix III, at an estimated initial cost of $344,200 with annual maintenance estimated at $750; provided that local interests shall contribute $172,100 in cash toward the cost of the protective structures and dredging; and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c).

At Port Sanilac, Mich., breakwaters and dredging, as shown on plate 8 of maps in appendix III, at an estimated initial cost of $264,300 with annual maintenance estimated at $750; provided that local interests shall contribute $130,100 in cash toward the cost of the protective structures, removal of existing dock structure and piling, and dredging; and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c).

Near Point Lookout, Mich., breakwaters and dredging, as shown on plate 6, on maps in appendix III, at an estimated initial cost of $209,000, with annual maintenance estimated at $300; provided that local interests shall contribute $104,500 in cash toward the cost of the prospective structures and dredging; and comply with conditions 1, 2, 3, 4, and 5 of paragraph 126 (c).

(b) That in order to insure completion of useful chains of harbors of refuge for through traffic, no work shall be done by the United States at any harbor in any one of the following groups of harbors until all conditions of local cooperation stipulated in subparagraph 128 (a) have been complied with for all harbors in that group.

Group A harbors, Port Huron to Saginaw Bay:

Port Austin, Mich.

(c) That the full amount of the estimated cost of the improvement of at least one group of harbors listed in the preceding subparagraph 128 (b) less the amount to be contributed by local interests, be made available in one allotment, as completion of less than a full group or chain of harbors would not accomplish the purpose for which these improvements are recommended and justified, and therefore would be of little value to navigation.

(d) That if the required local cooperation at any individual locality in a group of harbors is not furnished within 5 years after the authorization of the project by the Congress, the authorization for improvement of that group shall be null and void.

(e) That no project for harbor improvement be adopted at Rogers City, Mich., at this time.

LAKE ERIE

129. The special board recommends:

(a) That the following improvements be provided by the United States subject to prior compliance, in a manner satisfactory to the Secretary of War, with all specified conditions of local cooperation:

At Barcelona Harbor, N. Y., breakwaters and dredging, as shown on plate 2, of maps in appendix IV (b), at an estimated initial cost of $303,000 with annual maintenance estimated at $2,000; provided that local interests shall contribute $7,500 in cash toward the cost of the protective structures and dredging, and also comply with conditions in paragraph 126 (c).

At Grand View Bay, N. Y., breakwaters and dredging, as shown on plate 5 of maps in appendix IV (b), at an estimated initial cost of $158,700, with annual maintenance estimated at $3,300; provided that local interests shall contribute $79,300 in cash toward the cost of the protective structure and dredging, and also comply with conditions in paragraph 126 (c).

(b) That the full amount of the estimated cost of the improvement at each locality, less the amount to be contributed by local interests, should be made available in one allotment, as partial completion of the work would be of little benefit to navigation.

(c) That if the required local cooperation at any individual locality is not furnished within 5 years after the authorization of the project by Congress, the authorization for that project shall be null and void.

(d) That no project for harbor improvement be adopted at West Sister Island, Ohio, and Cattaraugus and Big Sister Creeks, N. Y.,

at this time.

LAKE ONTARIO

130. The special board recommends:
