Treasurers, if

relating to fuch parochial or other District, by the Commiffioners or Trustees or other Perfons having the Control of the Pavements whereof he or they shall have been so appointed, are impofed or directed to be imposed on Collectors or other Officers neglecting or refufing to account at the Times and in the Manner thereby directed; and that any Person or Perfons being fo appointed a Treasurer as aforefaid, although he shall be a Commiffioner or Trustee, or one of the Perfons having the Control of the Pavements of such parochial or other District, shall not in consequence of fuch Appointment become difqualified or incapable to act as a Commiffioner or Trustee, or in the Control of the Pavements for fuch parochial or other District; any thing in this Act or in any local Act or Acts of Parliament to the contrary in any wife notwithstanding.

XLVI. And be it further enacted, That if the appointed, to Commiffioners or Trustees or other Perfons having give Security. the Control of the Pavements in any parochial or other District within the Jurifdiction of this Act, fhall have appointed or fhall hereafter appoint any Treasurer or Treasurers as aforefaid, then and in every such Cafe fuch Commiffioners or Trustees or other Persons shall and they are hereby required to take good and fufficient Security from fuch Treasurer or Treasurers, by the Bond or Bonds of Two or more fufficient Perfons in a fufficient Penalty, and fuch further Security as they may deem neceffary and shall approve, conditioned that fuch Treasurer or Treasurers fhall duly account for and pay all Monies received by him or them pursuant to the Directions of this A&t, or of the local Act or Acts of Parliament relating to fuch parochial or other District, by the Commiffioners or Trustees or other Perfons having the Control of the Pavements whereof he or they fhall be or fhall have been fo appointed.

Collectors and other

XLVII. And be it further enacted, That the Commiffioners or Trustees, or other Perfons hav

ing the Control of the Pavements of any parochial Officers may or other District within the Jurisdiction of this Act, be alfo appointed. may at any Meeting or Meetings appoint a Clerk or Clerks, and may appoint One or more Col-lectors of the Rates or Affeffments, and an Inspector or Inspectors of the Pavement within their parochial or other District, and fuch other Officer or Officers for the Execution of this Act or of the local Act or Acts of Parliament relating to the paving of fuch parochial or other District, exclufively or jointly with any other Matters or Objects, as such Commiffioners, Trustees, or other Persons shall think proper, and may from Time to Time remove them or any of them, and appoint other Perfons in his or their Stead, as they fhall think it neceffary or convenient; and by and out of the Monies to be raised by virtue of this Act, or of fuch local Act or Acts of Parliament, may and they are hereby empowered to appoint and pay fuch Salaries, Gratuities, and Allowances to fuch Clerk or Clerks, Collectors, Infpectors, and other Officers, and to the Surveyor or Surveyors of the Pavements by this Act directed to be appointed, and to all other Perfons by them the faid Commiflioners, Trustees, or other Persons employed in the Execution of this Act, or of fuch local Act or Acts, as they fhall think reasonable; and also shall take good and fufficient Security from every fuch Collectors, and may take fuch Security for the due Execution of their respective Offices by fuch other Officers and Perfons as aforefaid, as they fhall think proper; and that in case of the Appointment of any Collector or Collectors of the faid Rates or Affeffments, then all and every Person and Persons who is or are liable to pay any fuch Rates or Affeffments, or any Sums of Money authorized to be raised and demanded by this Act, or by fuch local Act or Acts of Parliament, fhall pay the fame to fuch Collectors, or to the Perfons who fhall from Time to Time be fo appointed to collect and receive

the fame, according to the true Meaning of this Act or of fuch local Act or Acts of Parliament; and that each and every of fuch Collectors or other Person or Persons weekly and every Week, or as often as they or any of them fhall be thereunto required by the Commiffioners or Trustees, or other Perfons having the Control of the Pavements of fuch parochial or other District, by whom he or they fhall have been fo appointed, shall render and deliver unto them the faidCommiffioners or Trustees or other Perfons, or to their Clerk or Clerks, or to any other Perfons whom they fhall direct, distinct, true, and perfect Accounts in Writing, figned with their own Hands refpectively, of all Monies from Week to Week and from Time to Time collected and received by them, and each and every of them refpectively, of any Person or Persons whomfoever, for or on account of fuch Commiffioners, Trustees, or other Perfons, by whom he or they fhall have been fo appointed; and that all other Officers and Perfons fo to be appointed as aforefaid under their Hands, and at fuch Time and Times and in fuch Manner as the faid Commiffioners or Trustees or other Perfons by whom they fhall have been appointed may direct, fhall deliver to them, or to any other Persons whom they fhall direct, true and perfect Accounts in Writing of all Matters and Things committed to their Charge, and also of all the Monies which shall have been by fuch Officers or Perfons refpectively received by virtue of fuch Appointment, or for or on account of fuch Commiffioners or Trustees, or other Perfons by whom they shall severally have been appointed, and how nuch thereof hath been paid and disbursed, and for what Purposes, together with the proper and legal Receipts or Vouchers for fuch Payments; and that the faid Collectors of the faid Rates and Affeffments fhall weekly and every Week pay to the Treasurer or Treasurers appointed by the faid Commiflioners. or Trustees, or other Perlons for, the Time being,

or

or to fuch Perfon or Perfons as they fhall direct, all Sum or Sums of Money by each of them refpectively collected and received during the preceding Week, or oftener, if the faid Commiffioners or Trustees or other Perfons fhall fo direct and require; and that all other Officers and Perfons fo to be appointed as aforefaid fhall from Time to Time pay to fuch Treasurer or Treasurers, or such Perfon or Persons as the faid Commiffioners or Trustees or other Perfons having the Control of the Pavements fhall direct, all Monies which may be and remain in their or any of their respective Hands; and that they the faid Collectors for the Time being, and each and every of them, if thereunto required by the faid Commiffioners or Trustees, or other Perfons by whom they fhall have been appointed, thall verify the Truth of all Accounts and Statements fo rendered and delivered by them from Time to Time respectively upon Oath, and which Oath any and every Commiffioner or Trustee, or other Perfon having the Control of the Pavements in any such parochial or other Diftrict, is hereby empowered to administer; and that if any Collector or other Officer or Perfon appointed as aforefaid, shall not render and deliver, figned with his own Hand, all and every fuch Statements and Accounts, or fhall not verify the fame upon Oath when thereunto required as aforefaid, or fhall not produce and deliver up the Receipts or Vouchers relating to all Monies received and paid by him, or fhall not pay any Monies in his Hands to fuch Treasurer or Treasurers, or to fuch other Perfons as the Commiffioners or Trustees or other Perfons by whom he fhall have been appointed fhall direct, or fhall not deliver to fuch Commiffioners or Trustees or other Perfons by whom he fhall have been appointed, or to any other Perfon or Perfons whom they fhall direct, all Books, Papers, and Writings in his or their Cuftody or Power relating to the Execution of this Act, or of any fuch local Act or Acts of Par

liament as aforefaid, within Twenty-four Hours after he shall have been required fo to do by the faid Commiffioners or Trustees or other Perfons by whom he shall have been appointed, then and in either of the Cafes aforefaid, fuch Commiffioners or Trustees, or other Perfons by whom any fuch Collector or other Officer or Perfon fhall have been appointed, may and they are hereby authorized and empowered to bring or cause to be brought any Action or Actions against any fuch Collector, Officer, or other Perfon fo neglecting or refusing as aforefaid, for the Recovery of the Monies that fhall be in the Hands of fuch Collector, Officer, or Perfon respectively, or against the Perfon or Perfons having become Securities for him, or fuch Commiffioners or Trustees or other Perfons, or their Clerk or Clerks, or any other Perfon whom they fhall direct for that Purpose, may complain of any fuch Refufal or Neglect as aforefaid to any Justice of the Peace for the City, Borough, County, or Place wherein fuch Collector or other Officer or Person so neglecting or refufing shall be and refide; and fuch Justice may and is hereby authorized and required, by a Warrant under his Hand and Seal, to cause the Collector or other Officer or Perfon fo refufing or neglecting, and against whom fuch Complaint shall be made, to be brought before him, and upon his appearing, or not being to be found, to hear and determine the Matter in a fummary Way; and if upon the Confeffion of the Party, or by the Testimony of any credible Witness or Witneffes upon Oath, it fhall appear to fuch Justice that any of the Monies that fhall have been collected and received by any fuch Collector or other Officer or Perfon fhall be in the Hands of fuch Collector or other Officer or Perfon, or that he fhall not have rendered and delivered fuch true and perfect Account, figned as aforefaid, or fhall have detained any Receipts or Vouchers, Books, Papers, or Writings as aforefaid, then fuch Justice may and is hereby autho
