Act to extend to all Streets

within the Metropolis, and the Bills of Mortality,

and Pancras and Mary-lebone.

to the various Water and Gas Companies and Commiffioners of Sewers, by whom the Pavements of fuch Streets and public Places have been frequently difplaced; and alfo if more adequate Funds and Authorities were given to the said several Commiffioners, Trustees, and other Perfons having the Superintendance and Regulation of the Pavements of fuch Streets and public Places; for which Purposes, may it please Your Majesty that it may be enacted; and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament assembled, and by the Authority of the fame, That this Act and the Provifions herein contained fhall extend to all Streets and public Places which are now paved, or which may be hereafter paved, within the Cities of London and Westminster and Borough of Southwark, and any other Parts of the Metropolis which are included within the Weekly Bills of Mortality, and to all Streets and public Places which are now paved, or which may be hereafter paved, within the Parishes of Saint Pancras and Saint Mary-le-bone in the faid County of Middlefex, except only any Parts thereof which may be herein-after particularly excepted.

Surveyors of II. And be it further enacted, That within Two Pavements to Calendar Months after the pafling of this Act the be appointed. Commiffioners, Trustees, or other Perfons having

the Control of the Pavements of any Parish or other District included within the Operation of this Act, fhall appoint One or more competent Perfon or Perfons, being a Housekeeper or Housekeepers, and having an Houfe or Houses, or an Office or Offices, within their feveral Parifhes or other Districts, and to be and be called "The Surveyor" or "The Surveyors of the Pavements," within each of fuch refpective Parishes or other Districts, and that fuch Perfon or Perfons so to be appointed the Surveyor or Surveyors fhall fuper

intend the Pavements of the feveral Parishes or other Districts to which he or they fhall be fo appointed by the Commiffioners, Trustees, or other Perfons having the Control of the Pavements therein, and shall obferve and perform all the Duties imposed on Surveyors or Infpectors of Pavements by this Act, or by the feveral local Acts of Parliament whereby or by virtue whereof fuch Commiffioners, Trustees, or other Perfons fhall have been and shall be appointed, and which they shall be from Time to Time directed to observe and perform by the several Commiffioners, Trustees, or other Persons by whom they shall be so appointed; and also that all and every the Surveyors fo appointed fhall and may be discharged and removed from Time to Time by the feveral Commiffioners, Trustees, and other Perfons by whom they shall be fo appointed, at their Pleafure; and that they fhall be paid fuch annual or other Salaries, Gratuities, or Compenfation, out of the Monies arising from the Rates made and to be made for or towards the paving and repairing the Pavements of each of fuch Parishes or other Diftricts, and either feparately, or jointly with any other Objects or Purposes, during their Continuance in the faid Office, as the faid Commiffioners, Trustees, or other Perfons by whom they fhall be feverally appointed, fhall from Time to Time think fit: Provided nevertheless, that this Act fhall not limit or prevent the Appointment by the faid Commiffioners, Trustees, or other Persons, of any Inspectors or other inferior Officers for the Affiftance of the Surveyor or Surveyors of the Pavements within each of their respective parochial or other Districts, as they fhall think neceffary for the better Prefervation and Superintendance of the Pavements

therein.

III. And be it further enacted, That no Perfon Perfons inshall at any Time hereafter be appointed to the capacitated from being Office of Surveyor of the Pavements of and in any Surveyors. Parish or other District, or shall continue in fuch

Office, or fhall act therein, who at the Time of fuch Appointment fhall be, or after fuch Appointment fhall become, a Commiffioner or Truftee, or a Perfon having the Control of the Pavements of fuch Parish or other District by virtue of any focal Act or Acts of Parliament or otherwise, or who fhall be a Pavior or Mason, or Dealer in Stones, and who fhall have any Share or Interest in any Employment or Contract for the Pavement or Reparation of the Pavement of such Parish or other District, or in any other public Works under fuch Commiffioners or Trustees or other Persons within fuch Parish or other District; and that no Perfon fhall be continued in fuch Office of Surveyor of Pavements by any Commiflioners, Trustees, or other Perfons having the Control of the Pavements of any Parish or other District, or fhall act therein, who fhall cease to be an Housekeeper, or to have an House or Office within the particular Parish or other District, to the Superintendance of the Pavements whereof he fhall have been so appointed, or who shall become otherwife difqualified by virtue of this Act; and that if any Perfon fhall prefume to act as a Surveyor of Pavements for and in any Parish or other District, being difqualified as herein mentioned, every fuch Perfon fhall for every fuch A&t forfeit and pay the Sum of Twenty Pounds, to be recovered in the Manner in which other Forfeitures and Penalties are herein-after directed to be recovered by virtue of this A&t.

IV. And be it hereby further enacted, That from Time to Time and at all Times hereafter, within One Calendar Month after the Death or Removal or Difqualification of any Person appointed by any Commiffioners or Trustees, or other Perfons having the Control of the Pavements within any parochial or other District, to be a Surveyor of the Pavements of and within fuch parochial or other District, the faid Commiffioners or Trustees, or other fuch Per. fons, shall appoint another competent Perfon, quali

fied as herein-before directed, to the Office of a Surveyor of the Pavements of and within such parochial or other District, in the Room or Stead of the Perfon who fhall fo die or be removed, or otherwise become difqualified for fuch Office.

V. And be it hereby further enacted, That the Boards inCommiffioners or Trustees, or other Perfons having fcribed with the Control of the Pavements of and in every and Refidence parochial or other District within the Jurifdiction of of Surveyors, this Act, from Time to Time and at all Times to be placed within Fourteen Days after they fhall have appointed in confpicuany Person or Perfons to the Office of a Surveyor or Surveyors of the Pavements of and within fuch parochial or other District, fhall caufe to be painted on Boards the Christian and Surnames of each and every such Perfon or Perfons fo from Time to Time by them appointed to the Office of Surveyor for fuch parochial or other District, with the Number of the House, and the Street or other public Place within the faid parochial or other District which may then be the Dwelling Houfe or Dwelling Houses, or Office or Offices, of the Perfon or Perfons fo appointed a Surveyor or Surveyors of the Pavements for fuch particular parochial or other District, and that fuch Infcriptions fhall be fo painted on the faid Boards in Oil Colours, and in Roman Letters, being at least One Inch in Height; and that they the faid Commiffioners or Trustees, or other Persons having the Control of the Pavements of and in every fuch parochial or other District, fhall also cause one of fuch Boards, being so painted, to be set up or fixed in a confpicuous Place of the external Part of every Parish Church and parochial Chapel and Watch-house, within their several paro. chial or other Districts, and also on any Walls or Erections or Buildings within their several parochial or other Districts refpectively, not being private Dwelling Houses, as they may think neceffary, and from Time to Time may vary and tranfpofe the same, or cause the same to be varied or transposed,

as they fhall think neceffary or convenient; and that they the faid Commiffioners or Trustees, or other Perfons having the Control of the Pavements of and in every fuch parochial or other District, from Time to Time and at all Times fhall cause to be renewed or repaired and repainted all and every fuch Boards with the Inscriptions aforefaid, when and as often as Occafion fhall require, and fo that the Infcriptions on the faid Boards, with the Names and Refidence of the feveral Surveyors of the Pavements of and in every parochial or other District, shall be legible at all Times during the Day; and that if any Perfon fhall wilfully remove, destroy, or injure any of fuch Boards, or fhall obliterate or deface the Words painted thereon, or any of them, or any Part thereof, or fhall caufe or procure the fame to be removed, deftroyed, or injured, or obliterated or defaced, then every fuch Perfon fhall for every fuch Offence forfeit and pay a Sum not exceeding Thirty Shillings nor less than Fifteen Shillings, to be recovered in the Manner hereinafter provided.

VI. And be it further enacted, That in cafe any Housekeep- Perfon being the Occupier of an inhabited Dwelling House, fituate in any Parish or Place alfo within the Jurifdiction of this Act, and rated to the Relief of the Poor of fuch Parish or Place wherein such Dwelling Houfe fhall be fituate, at the Sum of Fifty Pounds at the leaft, for and in respect of fuch Dwelling House, or in cafe any Two Persons being the Occupiers of Two feveral inhabited Dwelling Houfes fituate in any Parish or Place, Parishes or Places, alfo within the Jurifdiction of this Act, and each of whom fhall be rated to the Relief of the Poor of fuch Parish or Place, Parishes or Places, wherein fuch Dwelling Houfes fhall be respectively fituate, at the Sum of Twenty-five Pounds at the leaft, for and in refpect of their faid refpective Dwelling Houses, shall think that the Pavement of any Street or public Place in any parochial or other

defective Pavement, and shall require the Reparation thereof.
