Madges or HereČOLIKE IN TEZecter, zze the Perion or Perions making the Kits & Affoes by virtue of any face box Axis all from Time so I me prder and sertare to rate the actall Occupier or Occupiers of foch Medloages or Heredianers refpectarea; and the Perion or Perfons to rates, whether the Owner ce Outers, or the Occupier or Coupers, ball to The to Time pay or case to be paid all and every fuch Rates or Aftens in respect of fuch Meforces or Heredaments rebbeclay; and upon Nonpayment thereof, fuch Rates or Addments may be levied by the Diitreis and Sale of the Goods and Chattels of fuch Perfon or Fericas relpectively, wherefoever they thall be found, or of the Goods and Chattels of the Perion or Ferons inhabiting the fame Metfuages or Hereditaments relpectively, and may be otherwise fued for or recovered in like Manner in which such Rates or Affetiments may be levied and recovered from any other Perfons by virtue of fuch local A&t or Acts of Parliament, or by virtue of this A&t: Provided always, that no Owner or Owners, nor any Perfon or Perfons, thall be charged with or liable to pay for and in refpect of any increafed Rent referved or made payable to him or them for or on account of any Agreement made by fuch Owner or Owners, or Perfon or Perfons, with the actual Occupier or Occupiers of fuch Meffuages or Hereditaments, that fuch Owner or Owners or other Person or Persons would pay the several Rates or Affeffments theretofore chargeable upon the Occupier or Occupiers of fuch Meffuages or Hereditaments respectively: And provided alfo, that if the Owner or Owners of any Meffuage or Hereditament, the yearly Value whereof fhall not exceed

Twenty Pounds, and which fhall be let to One Tenant only at a Rent which fhall become payable and be collected only by quarterly Payments, fhall be rated and affeffed as the Occupier or Occupiers of any fuch Meffuage or Hereditament, then upon Request in Writing under the Hand or Hands of any fuch Owner or Owners, and a true and full Statement in Writing of the Name of the actual Tenant or Occupier of every fuch Meffuage or Hereditament, and fuch other Information relating thereto as the Commiffioners or Trustees or other Persons having the Control of the Pavements in any fuch parochial or other District refpectively fhall from Time to Time direct and require, and to their Satisfaction, the faid Commiffioners or Trustees or other Perfons aforefaid fhall compound with any fuch Owner or Owners of fuch Meffuage or Hereditament for Payment of the faid Rates or Affeffments for and in respect of every fuch Meffuage or Hereditament, at fuch reduced yearly Rental as fuch Commiffioners, Trustees, or other Persons shall think reasonable, not being more than Three Fourth Parts nor less than One Half of the Rack Rent or annual Value of each of such Meffuages or Hereditaments respectively, or fhall remit to fuch Owner or Owners fuch Part of fuch Rate or Affeffment as fuch Commiffioners, Trustees, or other Persons shall think reasonable, not being lefs than One Fourth Part nor more than One Half of fuch. Rates or Affeffments to which fuch Owner or Owners shall be rated or affeffed in refpect of each of fuch Meffuages or Hereditaments respectively; and also, that it may be lawful for the faid Commiffioners or Trustees, or other Perfons as aforefaid, if they fhall think proper, to compound with any Owner or Owners of any Meffuages or other Hereditaments in their parochial or other District, which shall be let to weekly or monthly Tenants, or which shall be let furnished or in. Lodgings, or in separate Apartments, or at Rents which fhall become payable or

to be collected at any thorter Periods than quarterly, for Payment of the faid Rates or Affeffments for or in respect of such Meffuages or Hereditaments at fuch reduced yearly Rental as fuch Commiffioners or Trustees or other Perfons fhall think reasonable, not being less than Two Third Parts of the Rack Rent or annual Value of fuch Meffuages or Hereditaments respectively, or to remit to the Owner or Owners of any fuch Meffuages or Tenements respectively last mentioned fuch Part of fuch Rate or Affeffment as fuch Commiffioners, Trustees, or other Perfons fhall think proper, not being more than One Third Part of the Rates or Affeffments to which fuch Owner or Owners fhall be rated or affeffed in respect of each of such last-mentioned Meffuages or Hereditaments respectively, or otherwife to collect from fuch Owner or Owners the whole of such Rates or Assessments, as they shall think proper; and also that any such Commiffioners, Trustees, or other Persons as aforesaid, may vary, discontinue, or renew either or any of fuch Compofitions, as fuch Commiffioners, Trustees, and other Perfons fall from Time to Time deem expedient.

XXXIV. Provided always, and be it further enacted, That nothing in this Act contained fhall be conftrued, deemed, or taken to impeach, alter, or make void any Agreement made between any Landlord and Tenant, in any Leafe now granted or hereafter to be granted, pursuant to any Contract or Agreement now existing; any thing in this Act contained to the contrary thereof notwithstanding.

XXXV. And be it further enacted, That in cafe at any Time or Times hereafter any Owner or Owners, or Occupier or Occupiers of any Meffuage or Hereditament, fituate in any Street or Place in any parochial or other District within the Jurifdiction of this Act, for and in refpect whereof he or they shall be rated or affeffed to any Rate or Affeffment made or to be made for and towards

the Expences of paving or repairing the Pavement of the Streets or public Places in fuch parochial or other District, and either exclufively or jointly with or for any other Objects or Purposes, either by virtue of any local Act or Acts of Parliament relating to fuch parochial or other District, or by virtue of this Act; or any other Perfon or Perfons fo rated and affeffed, or liable to be rated and affeffed, or to pay the Money fo rated or affeffed as aforefaid, fhall refufe or neglect to pay the Money rated and affeffed upon him or them refpectively, or which he or they may be liable to pay by virtue of fuch local Act or Acts of Parliament or of this Act, and all Arrears now or hereafter due thereon, or upon any former Rate or Rates or Affeffment or Affeffments, it shall be lawful for any one of His Majesty's Justices of the Peace for the City, Borough, or County wherein such parochial or other District shall be fituate, and he is hereby authorized and directed, by Writing under his Hand, or in his Name under the Hand of any Perfon authorized by him to fign the fame, on Complaint made by the Commiffioners, Trustees, or other Perfons having the Control of the Pavements of fuch parochial or other District, or any one or more of them, or any Officer or other Perfon appointed by them, to fummon all and every Perfon and Perfons who fhall have refused and neglected as aforefaid, to appear, at a Time and Place to be mentioned in fuch Summons, before fuch Justice, or before any Juftice or Juftices of the Peace for the fame City, Borough, or County, who fhall be then and there present; and it shall be lawful for any Perfon appointed to collect and receive fuch Rates or Affeffments, or for any of the Constables, Headboroughs, or Beadles of any fuch parochial or other District, or for any other Perfon, to ferve all and every fuch Summons and Summonfes upon all and every Perfon and Perfons fo refufing or neglecting to pay as aforefaid, either by delivering

the fame to the Person or Persons thereby intended to be fummoned, or by leaving the fame at his or their last or usual Place or Places of Abode, or at or on the Premises for or in refpect whereof the Rate or Rates, Affeffment or Affeffments mentioned in such Summors, fhall remain due and owing; and if any Perfon or Perfons fo fummoned fhall refufe or neglect to attend at the Time and Place mentioned in fuch Summons, or if he or they shall attend, and fhall not fhew good and fufficient Caufe to fuch Juftice or Juftices as may be then and there present, that he or they is or are not chargeable with fuch Rate or Rates, Affeffment or Afsessments, then and in every such Case every fuch Perlon or Perfons fhall pay the Rate or Rates in respect of which fuch Summons was issued, and also the Cofts and Charges of fuch Summons; and in all Cafes where fuch Rate or Rates, Afseffment or Affeffments, or any of them, fhall not be paid upon the Return of fuch Summons, it fhall be lawful for the Juftice who fhall have figned and iffued fuch Summons or Summonfes, or who fhall have directed fuch Summons and Summonfes to be figned and iffued as aforefaid, or for any other Justice of the Peace for the fame City, Borough, or County, and he is hereby authorized and required, upon. Oath made before him of the due Service of fuch Summons or Summonfes by the Person who fhall have ferved the fame, to grant a Warrant under his Hand and Seal, authorizing or directing any fuch Perfon appointed to collect fuch Rate or Rates, Affeffment or Affeffments as aforefaid, or any Conftable, Headborough, or Beadle of the faid parochial or other District, or any other Constable, Headborough, or other Perfon, to levy fuch Rate or Rates, Affeffment or Assessments, and all Arrears thereof, and the faid Cofts and Charges of the Summons (if the fame fhall not have been paid before), and the Cofts and Charges of every fuch Warrant, and also the Costs, Charges, and Expences
