within the parochial or other District in which fuch Pavement fo broken or taken up or disturbed fhall be fituate, or to their Treasurer, Clerk, or Surveyor, or to fuch other Perfon as they may appoint, the Sum of Forty Shillings for every Square Foot of Pavement which fhall be fo broken or taken up without fuch Notice or Confent as aforefaid, to be recovered in the fame Manner in which other Forfeitures and Penalties are herein-after directed to be recovered by virtue of this Act.

XII. And be it further enacted, That all new New Mains of or complete Mains or Pipes for the Conveyance of Water Pipes, Water, or inflammable Air or Gas, which after &c. to be the paffing of this A&t fhall be laid down beneath and not laid the Surface of any Streets or public Places within down during the Jurifdiction of this Act, by or on account of the Months any Water or Gas Light Company, and whether January, or fuch new or complete Main of Pipes fhall or fhall February. not be fubftituted for or added to any other complete Main or Mains of Pipes for the Conveyance of Water or inflammable Air or Gas, thentofore laid down for the Conveyance of Water or of inflammable Air or Gas, fhall confiit and be made of Iron alone, and of no other Material; and that the Pavements of any Streets or public Places with in the Jurifdiction of this Act, or any Part thereof, shall not be broken or taken up for the Purpose of laying down any new Main of Pipes, for the Conveyance of Water or of inflammable Air or Gas, during any Part of the Months of December, January, or February in any Year; and alfo, that from and after Ten Years from the paffing of this Act all and every new Main Pipe and Pipes for the Conveyance of Water, or of inflammable Air or Gas, which shall be laid down by or on account of any Water or Gas Light Company, or other Perfons, fhall confift and be made of Iron alone, and of no other Material; and all and every new Service and other Pipes fhall not confift or be made of Wood, but shall confift or be made of Iron or

Pavement.

Lead, or of fome durable Material; and that if any
Water or Gas Light Company, or any other Per-
fon, fhall break or take up, or caufe to be broken
or taken up, any fuch Pavement for the Purposes
aforefaid during the Months aforefaid, or fhall lay
or cause to be laid down any Pipes confifting or
made of any Materials in Violation of the Provi-
fions of this Act, then and in every fuch Case the
Company or other Person so offending shall forfeit
and the Sum of Five Pounds for every Square
pay
Foot of Pavement which shall be fo broken or taken
up by them or on their Account, and the like Sum
for every Foot in Length of Pipe which fhall be fo
laid down confifting or made of any fuch Material;
and which faid Forfeitures and Penalties fhall be
recoverable in the fame Manner in which other
Forfeitures and Penalties are herein-after directed
to be recovered by virtue of this A&t: Provided
always, that nothing herein contained fhall extend
or be construed to extend to hinder or prevent any
Water Company, at any Time within or after the
Space of Ten Years from the paffing of this A&,
from repairing all or any of their prefent Mains or
Service Pipes, which are not constructed of Iron,
with Wood or fuch other Materials whereof fuch
Mains or Pipes are now conftructed.

XIII. And be it further enacted, That it fhall and may be lawful to and for any Perfon appointed to act as a Surveyor of the Pavements in any parochial or other District within the Jurifdiction of this Act, and to and for any other Perfon or Perfons appointed by the Commiffioners or Trustees, or other Perfons having the Control of the Pavements of any fuch parochial or other District, when he fhall be directed fo to do by the Commiffioners or Trustees, or other Perfons by whom he or they fhall be appointed to act, from Time to Time and at any Times between the Hours of Ten of the Clock in the Forenoon and of Four of the Clock in the Afternoon of any Day not being a Sunday or Holiday appointed by

Law, at the Office or Counting-house of any Water or Gas Light Company, any of whose Pipes for the Conveyance of Water or of inflammable Air or Gas fhall then be laid beneath the Surface of any of the Streets or public Places within each of fuch parochial or other Districts, the Pavements whereof shall be under the Control of such several Commiffioners or Trustees or other Perfons, or for which any fuch Surveyor fhall be appointed to act, and at the Office of any Commiffioners of Sewers then having Jurifdiction over the common and public Drains and Sewers within every fuch parochial or other District, to examine and inspect any and every Map or Plan, or Draft or Survey, or Delineation or Description, of all and every the Main of Pipes and Pipes belonging to any of fuch Water or Gas Light Companies, then poffeffed by them, or being in their Cuftody or Power, and any and every Map or Plan, or Draft or Survey, Delineation or Defcription, of the common and public Drains or Sewers being within such parochial or other District, and under the Jurifdiction of fuch Commiffioners of Sewers, then poffeffed by them, or being in their Custody or Power, he fuch Surveyor for the Time being, or fuch other Person or Perfons appointed by the said Commiffioners or Trustees, or other Perfons having the Control of the Pavements in any fuch parochial or other District, having given to a Clerk of Secretary of any such Company or Commiffioners or Sewers, or having left at the Office or Counting-house of fuch Company or Commiffioners of Sewers, Two Days previous Notice in Writing of his or their Intention to attend at the Office or Counting-house of fuch Companies or Commiffioners of Sewers for the Purpose aforefaid; and that the Secretary or Clerk, or fome other Officer of fuch Company or Commiffioners of Sewers shall then and there produce and fhew, or caufe to be produced and fhewn, unto fuch Surveyor or other Perfon or Perfons, all and every the Maps,

their Names

Abode to

Surveyors of

Pavements.

Plans, Drafts, Surveys, Delineations, and Defcriptions aforesaid, in the Custody or Power of the faid Company or Commiffioners of Sewers, and fhall permit him or them then and there to take Extracts therefrom, or Copies thereof, or of and from any of them, or any Part of any of them, so far as may relate to the Mains of Pipes or Pipes, and to the public or common Sewers or Drains which fhall be laid or be beneath the Surface of the Streets or public Places within the parochial or other District for which fuch Surveyor of Pavements, or other Perfon or Perfons appointed by any fuch Commif fioners or Trustees, or other Perfons having the Control of Pavements, shall be deputed or directed

to act.

XIV. And be it further enacted, That all and every the Secretaries or Clerks, Surveyors or In&c. to notify fpectors, and the several and respective Turncocks and Places of employed or appointed, or hereafter being employed or appointed by all and every the Water and Gas Light Companies, any of whofe Pipes fhall be laid beneath the Surface of any Street or public Place in any parochial or other District within the Jurif. diction of this Act, and alfo all and every the Clerk and Clerks, Secretary and Secretaries appointed or being hereafter appointed by any Commiffioners of Sewers whofe Jurifdiction fhall extend over the common or public Drains or Sewers within every fuch parochial or other District, within Forty Days next after the paffing of this Act, or within the Space of Five Days next after he or they shall be hereafter severally appointed to fuch several Offices, Situations, or Employments, fhall give Notice in Writing to each and every of the Clerk or Clerks to the Commiffioners or Trustees, or other Perfons having the Control of the Pavements, or to the Surveyor and Surveyors of the Pavements of each parochial or other District, beneath the Surface of the Streets or public Places wherein the Mains or Pipes of fuch Company, or any of them, fhall be

laid, or there fhall be any common or

Drains or Sewers within the Jurifdiction of fuch
Commiffioners of Sewers, of his, their, and every
of their Chriftian and Surnames and Place or Places
of Abode, and of the Company or Commissioners
of Sewers by whom he or they is or are, or hath or
have been fo appointed or employed, and also of
the Place which is appointed as the Office or
Counting-house of the faid Company or Commif-
fioners of Sewers; and that in cafe any fuch Perfon
or Perfons fhall neglect to give fuch Notice within
the_respective Times aforefaid, every fuch Perfon
or Perfons fo offending in either of the faid Cafes
shall forfeit and pay the Sum of Ten Pounds, to
be recovered in the fame Manner in which other
Penalties and Forfeitures are hereafter directed to
be recovered by virtue of this Act.

XV. And be it further enacted, That when and Surveyor fo often as it fhall appear to any Perfon appointed may require to act as a Surveyor of Pavements in any parochial Repair of or other District within the Jurifdiction of this Act, Drains when Pipes and that any Pipe or Pipes, Stop-cock, Plug, or other defective. Thing belonging to any Water or Gas Light Company, or that any public Sewer beneath the Surface of the Pavement of any Street or public Place within fuch parochial or other District, be broken or damaged, it fhall be lawful for fuch Surveyor, and he is hereby required, to give immediate Notice, Notice to be figned by himself, to the Company or Commif- given to fioners of Sewers to whom it may appear to him that repair them. fuch Pipe or Stop-cock, Plug, or other Thing, or Sewer, doth or may belong, by either giving fuch Notice to a Clerk or Secretary, or to a Turncock of fuch Company, or to a Clerk or Secretary of fuch Commiffioners of Sewers, or to fome or one of them, or by leaving the fame at the Place or Places of Abode of fome or one of them, or at the Office or Counting-house of fuch Company or Commiffioners of Sewers, and fhall require that such Pipe, Stop-cock, Plug, or other Thing, or Sewer, be examined,
