fhall be final, binding, and conclufive; and that the Recognizances of any Party disobeying, or refufing or neglecting to obey, any Order which may be made by fuch Juftices, fhall be forfeited, and that every fuch Party fhall be guilty of a Mifdemeanor; and that if any Cofts awarded by them, when fo fettled by the faid Clerk of the Peace, fhall not be forthwith paid, then Double the Amount thereof may be recovered by an Action of Debt or on the Cafe in any of His Majesty's Courts of Record at Westminster, wherein no Effoign, Protection, or Wager of Law, or more than One Imparlance, shall be allowed; and that the Payment of any Rate or Affeffment shall not be fufpended or delayed in confequence of any fuch Notice of Appeal, or whilft fuch Appeal may depend, but that the fame and every Part thereof fhall and may be demanded, collected, and recovered in fuch and the fame Manner as if no fuch Notice of Appeal had been given.

CXXXIV. And be it further enacted,That all and Juftices to deevery the Recognizance and Recognizances entered liver Recoginto by any Perfon or Perfons relating to any Appeal as aforefaid, fhall be delivered on Demand to the Clerk or Clerks for the Time being to the Commiffioners or Trustees or other Persons having the Control of the Pavements in any parochial or other District within the Jurifdiction of this Act, as to which fuch Appeal fhall reiate, by the Juftice or Juftices who fhall have taken the fame; and that the Commiffioners or Trustees, or other Perfons having the Control of the Pavements of fuch parochial or other District, fhall and may fue for, recover, and receive the Penalty and Penalties, or Sum and Sums mentioned in any fuch Recognizance or Recognizances, either in fuch and the fame Manner as any Rate, Penalty, or Fine may be fued for and recovered by virtue of any local Act or Acts of Parliament relating to any fuch parochial or other District, or by virtue of this Act, or by Action or N 4 Actions

CXXXV. And be it further enacted, That no Rate or Rates, Affeffment or Assessments, nor any Proceeding to be had touching the Conviction of any Offender or Offenders against this Act, or any Order made, or any other Matter or Thing to be done or tranfacted in or about the Execution of any local Act or Acts of Parliament relating to any parochial or other District within the Jurifdiction of this Act, or in or about the Execution of this Act, or in pursuance or by virtue thereof, fhall be vacated or quashed for want of Form; but that any Rate or Affeffment, or any Matters of Form in any Conviction, Order, Proceeding, or other Matter and Thing, may be amended, as the Juftices at any General or Quarter Seffions of the Peace for fuch City, Borough, or County may order and nor removable direct; nor fhall any Rate, Proceeding, Convicby Certiorari. tion, Order, Matter, or Thing be removed or removable by Certiorari, or by any other Writ or Process whatsoever, into any of His Majefty's Courts of Record at Westminster or elsewhere; any Law, Statute, or Ufage to the contrary notwithstanding.

Limitation of Actions.

CXXXVI. And be it further enacted, That no Action or Suit fhall be commenced against any Person or Perfons for any thing done in Execution or pursuance of any local Act or Acts of Parliament relating, either exclufively or jointly with any other Objects or Purposes, to the Pavement of any parochial or other District within the Jurifdiction of this Act, until after Twenty-one Days Notice in Writing, figned by the Perfon or Perfons intending to bring fuch Action or Suit, and fpecifying his or their real Refidence, and his or their Trade or Profeffion, fhall be thereof given to the Clerk or Clerks to the faid

faid Commiffioners or Trustees, or other Persons having the Control of the Pavements in any parochial or other District within the Jurifdiction of this Act, wherein any Fact may be committed, or for which fuch Action or Suit may be brought; nor after fufficient Satisfaction shall be made or tendered, nor after Three Calendar Months next after the Fact may be committed for which fuch Action or Suit fhall be fo brought; and all fuch Actions or Suits shall be laid and tried in the County of Middlefex or City of London, and not in any other County, City, or Place; and that the Defendant or Defendants in fuch Action or Actions, Suit and Suits, and every of them, may plead the General Iffue, and give any local Act or Acts of Parliament relating to any fuch parochial or other District, or this Act, and the special Matter, in Evidence at any Trial or Trials which fhall be had thereupon, and that the Matter or Thing for or on which fuch Action or Suit fhall be brought was done in pursuance and by the Authority of any fuch local Act or Acts, or of this Act; and if the faid Matter or Thing fhall appear to have been so done, or if it shall appear that fuch Action or Suit was brought before Twenty-one Days Notice was given as before directed, or that fufficient Satisfaction was made or tendered or paid into Court as aforefaid, or if any fuch Action or Suit fhall not be commenced within the Time before for that Purpose limited, or fhall be laid in any other County, City, or Place than as aforefaid, then the Jury fhall find for the Defendant or Defendants therein; and if a Verdict shall be found for fuch Defendant or Defendants, or if the Plaintiff or Plaintiffs in fuch Action or Suit fhall become nonfuited, or fuffer a Discontinuance of such Action or Suit, or if upon a Demurrer or Demurrers in fuch Action or Suit, or upon a Verdict or otherwise, Judgment shall be given for the Defendant or Defendants therein, then and in either of the Cafes aforefaid fuch Defendant or Defendants fhall have

Treble Coits, and thall have fuch Remedies for recovering the fame as any Defendant may have for te Recovery of Coits in other Cafes by Law.

CKIXVIL Provided always, and be it further etadred. CXXXVII. Provided alio, and be it enacted, That neither any A&t or Acts of Parliament relating either exclufively to the paving or repairing the Pavements of the Streets or public Places in any parochial or other Diftrict within the Jurifdiction of this Act, or relating thereto jointly with any other Obiec or Purpose, nor any Clause, Matter, or Provition therein contained, fhall be hereby re

pealed;

pealed; but that the Commiffioners, Trustees, or other Perfons by any fuch local Act or Acts of Parliament vested with the Control or Superintendence of the Pavement of the Streets and public Places in every such parochial or other District, fhall retain and may exercise all and every the Powers and Authorities by all and every such local Act and Acts of Parliament conferred upon them or any of them; and that they may from Time to Time and at all Times, either act under and upon all or any of the Provisions, Clauses, Powers, and Authorities of fuch Act or Acts of Parliament, or under any of the Provifions, Clauses, Powers, and Authorities of this Act, as they from Time to Time, upon each Emergency or each particular Occafion, may think proper and deem most expedient; but subject nevertheless to all the Provifions contained in this Act as to the Appointment of Surveyors of the Pavement in every parochial or other District, and as to the Means hereby provided for compelling the speedy and effectual Reparation of imperfect Pavement in all Streets and public Places within the Jurifdiction of this Act, and the Regulation and Improvement of fuch Streets, and Removal and Prevention of Nuisances and Obstructions, according to the Provifions of this Act.

CXXXIX. Provided alfo, and be it further enacted, That neither this Act, nor any Enactment, Claufe, Provifion, Matter, or Thing herein contained, fhall extend or be conftrued to extend to the Estate of The Most Honourable The Marquis Camden, fituate and being in the Parish of Saint Pancras in the County of Middlefex, but that the fame shall be completely and entirely exempted therefrom; any thing herein contained to the contrary thereof in anywife notwithstanding.
