CXVI. And be it further enacted, That the faid CommiffionCommiffioners or Trustees or other Perfons as afore- ers may enter faid at any of their General Meetings fhall and may tracts. and they are hereby authorized and empowered from Time to Time to contract or agree with any Perfon or Perfons whomfoever for removing the Duft and Ashes, cleanfing, paving, and repairing the Pavement of and within their refpective parochial or other District, and for doing and executing all or any of the Works which, under and by virtue of any local Act or Acts of Parliament relating thereto, or of this Act, the faid Commiffioners or Trustees or other Perfons as aforefaid may direct to be done and executed; and also to purchase or provide, either by Contract or otherwife, from Time to Time, fuch Goods, Materials, and Things whatfoever, as they fhall think proper for effectually executing the Powers and Provifions of fuch local Act or Acts of Parliament or of this Act, and shall pay or order the Payment of the Monies due or to become due upon any fuch Contracts, Agreements, or Purchases, to the Perfon or Perfons entitled to receive the fame, by and out of all or any Monies which shall or may be paid to or received by them by virtue of any fuch local Act or Acts of Parliament or of this Act, for and towards the Expence of paving and repairing the Pavements of the Streets or public Places within their respective parochial or other Districts, either exclufively or jointly with or for or towards any other Objects or Purposes, or whereof they may be authorized and entitled to difpofe.

CXVII. And be it further enacted, That previous Public Notice to any Meeting of the Commiffioners or Trustees, fhall be given or other Perfons as aforefaid, for the making of any ings for fuch Contracts which they may deem expedient for making Conthe better Execution of this Act, Seven Days Notice tracts. of fuch Meeting to make any fuch Contracts fhall be given in Two or more of the public Newspapers published in London or Westminster, expreffing the

Nature and Objects of each of fuch Contracts, in order that any Perfon or Perfons willing to contract may make Proposals for that Purpose, to be offered and prefented to the faid Commiffioners or Trustees or other Perfons as aforefaid, or to their Clerk or Clerks, at the Time and Place mentioned in fuch and Contracts Notice; and alfo that the Particulars of all fuch and Accounts Contracts or Agreements, and all Receipts and Payments by fuch Commiffioners or Trustees or other Perfons in the Execution of the faid local Act or Acts of Parliament or of this Act, and alfo Minutes of their Proceedings at all and every of their General Meetings, fhall be fairly entered by their Clerk or Clerks, or by his or their Direction, in a Book or Books to be provided for those Purposes, and to be carefully preferved.

CXVIII. And be it further enacted, That in case any fuch Contract or Contracts, for any Purpose or or compound Purposes whatsoever, fhall have been heretofore or shall be hereafter entered into by any Commiffioners or Trustees or other Perfons as aforefaid acting in pursuance of any local Act or Acts of Parliament or of this Act, and the Perfon or Persons who may have entered or who fhall hereafter enter into any fuch Contract or Contracts, fhall be guilty of any Breach or Non-performance of any fuch Contract or Contracts, it fhall and may be lawful to and for the faid Commiffioners or Trustees or other Perfons as aforefaid at any of their General Meetings, in case they shall deem it proper and expedient, to declare fuch Contract or Contracts to be null and void, and fuch Contract or Contract fhall be from thenceforth null and void accordingly; or it fhall or may be lawful to and for them to compound for fuch Sum or Sums of Money with the Perfon or Perfons fo having entered into or who fhall hereafter enter into fuch Contract or Contracts, for fuch Breach or Non-performance of fuch Contract or Contracts, and for all Cofts, Charges, and Expences which have been or fhall be occafioned thereby, as

to them the said Commiffioners or Trustees or other Perfons fhall appear proper and expedient; or it fhall and may be lawful to and for them the faid Commiffioners or Trustees or other Perfons as aforefaid to fue for and to recover the full Penalty or Penalties contained and expreffed in any such Contract or Contracts, or in any Bond or Bonds given and executed for the due Performance of fuch Contract or Contracts, by Action of Debt or on the Cafe in any of His Majesty's Courts of Record at Westminster, in which Action or Actions no Effoign, Protection, Wager at Law, nor more than One Imparlance, fhall be allowed.

CXIX. And be it further enacted, That it fhall Accounts be lawful for all and every the Perfons poffeffing or may be entitled to any Bonds, Mortgages, Annuities, or mined. other Securities affecting or charged upon the faid Rates or Affeffments for any parochial or other District within the Jurifdiction of this Act, and all Persons rated to the Rates or Affeffments to be made for or towards the Expences of paving or repairing the Pavement in any parochial or other District, either exclusively or jointly with or for or towards any other Objects or Purpofes, either by virtue of any local Act or Acts of Parliament or of this Act, at all seasonable and convenient Times to peruse and inspect and to make and take Extracts from all Rates or Rate Books, and all other Book or Books, Accounts, Vouchers, Papers, and Writings whatfoever, which shall be kept under any fuch local Act or Acts of Parliament, or under this Act, in relation to the paving or repairing the Pavements of fuch parochial or other District, either exclusively or jointly with or for any other Objects or Purposes, in the Cuftody or Power of the faid Commiffioners or Trustees or other Persons having the Control of the Pavements for the Time being; and also, that the Clerk or Clerks to the faid Commiffioners or Trustees or other Persons as aforefaid for the Time being, or One of them, within Twenty Days after Demand

Actions may be brought and defended

Demand made thereof in Writing, figned by any one of the Persons before mentioned, and delivered to or left for him or them at his or their ufual or laft Place of Abode, shall make and deliver or caufe to be made and delivered a Copy or Copies of all and every fuch Book and Books, Accounts, Vouchers, Papers, and Writings whatsoever, or of any Part or Parts thereof, whereof a Copy or Copies fhall be fo demanded, to the Person or Perfons demanding the fame, on his or their Application for the same, at any Time after the Expiration of the faid Term of Twenty Days, he or they paying for the fame, at or before the Delivery thereof, at and after the Rate of Two Shillings and Sixpence for every Three hundred Words contained in fuch Copy or Copies fo demanded and delivered as aforefaid, every Figure in fuch Copy or Copies being calculated as a Word; and in cafe any fuch Clerk fhall at any Time refuse or wilfully neglect to make and deliver or caufe to be made and delivered fuch Copy or Copies of all and every fuch Book and Books, Accounts, Vouchers, and Papers, and of every Part thereof refpectively, to the Person or Perfons demanding the fame, on Application for the fame, after Twenty Days from the Day of the Demand thereof as aforefaid, on Payment for the fame as aforefaid, then every fuch Clerk fhall for every Refufal or Neglect forfeit and pay the Sum of Twenty Pounds; One Moiety thereof to the Treasurer or Treasurers to the Commiffioners, Trustees, or other Perfons as aforefaid for the Time being, and the other Moiety to any Perfon or Perfons who fhall fue for the fame in any of His Majefty's Courts of Record at Westminster, by Action of Debt or on the Cafe, wherein no Effoign, Protection, Wager of Law, nor more than One Imparlance, fhall be allowed.

CXX. And be it further enacted, That the faid Commiffioners or Trustees or other Perfons having in the Name the Control of the Pavements in any Streets or of the Clerks. public Places in any parochial or other District

within the Jurifdiction of this Act, may fue and be fued in the Name of their refpective Clerk or Clerks for the Time being; and that all Actions or Suits tha the faid Commiffioners or Trustees, or other Perfons having the Control of the Pavements in any Streets or public Places in any fuch parochial or other District, may at any Time or Times hereafter direct to be brought for the Recovery of any Penalty or Rates, or any other Sum or Sums of Money from Time to Time or at any Time due or payable from or by any Water or Gas Companies, or Commiffioners of Sewers, or any other Perfon or Perfons, due or payable by virtue of any local Act or Acts of Parliament relating to their refpective parochial or other District, or of this Act, or for or in refpect of any other Matter or Thing relating to fuch local Act or Acts of Parliament or to this Act, may be brought in the Name of fuch Clerk or Clerks refpectively for the Time being, in any of His Majesty's Courts of Record at Westminfter, by Action of Debt, Bill, Plaint, or Information, in which no Effoign, Protection, or Wager of Law, or more than One Imparlance, fhall be allowed; and in which Action or Actions it fhall be fufficient for the Clerk or Clerks as fuch Plaintiff or Plaintiffs to declare that the Defendant or Defendants is or are indebted to him or them as fuch Clerk or Clerks in the Sum of Ten Shillings, (or fuch other Sum as the Clerk or Clerks fhall fuppofe to be then due or forfeited), for fo much Money before then owing (forfeited or Fine fet, as the Cafe may be) from or by the Defendant or Defendants to the faid Clerk or Clerks by virtue of fuch local Act or Acts, or either of them, relating to his or their respective parochial or other District, or by virtue of this Act, (as the Cafe may be, and mentioning the Titles of fuch Act or Acts refpectively); and if the Plaintiff or Plaintiffs fhall recover in any fuch Action or Actions, he or they shall have full Cofts, to be levied and recovered as other Monies upon Judgments
