ing, within Three Days after fuch Notice fhall be given or left as aforefaid, at his or their own Charges; and in cafe he or they shall refuse or neglect fo to do pursuant to fuch Notice, he or they fhall forfeit and pay for every such Offence a Sum not being lefs than Ten Shillings nor exceeding Twenty Shillings for each and every Day after the Expiration of the faid Term of Three Days, after fuch Notice fhall be given or left, during which he or they fhall fo refuse or neglect; and that every fuch Penalty fhall be recovered in the fame Manner as other Penalties are herein-after directed to be recovered by virtue of this A&t.

LXXVII. And be it further enacted, That it fhall Streets may and may be lawful to and for the faid Commiffioners be watered. or Trustees, or other Perfons having the Control of the Pavements of any parochial or other District within the Jurifdiction of this Act, from Time to Time and at any Time hereafter to cause all or any of the Streets and other public Places within their respective Jurifdiction to be watered, and to be fo watered either by any Perfon or Perfons employed by them, or by any other Perfons engaging to execute the fame by public Contract or private Agreement, for fuch Prices and for fuch Time, and in fuch Manner and on fuch Terms, as they fhall think proper and approve; and alfo may cause any Well or Wells to be dug or funk, and any Pump or Pumps to be made and erected, in fuch Places (not being a Vault, Cellar, or other Building, under any of the said Streets or other public Places), and allo to cause any Pump or Pumps now ftanding, or which shall hereafter be erected for the Purposes of watering the fame, from Time to Time to be removed, altered, or repaired; and may purchase and repair Carts and Horfes and Pipes and other Implements, and may employ any Carters, Workmen, and Servants, and may rent or erect any Stables or other Buildings neceffary for the Purpose of keeping fuch Carts and Implements and Horfes, and may

do or cause to be done all other Matters and Things which they may deem neceffary for that Purpose; and the Charges and Expences thereof fhall be paid out of the Monies received for and towards the paving and repairing the Pavements of fuch parochial or other District, either exclufively or jointly with, for, or towards any other Objects or Purposes, or out of any Monies to be raised and produced by the Rates or Affeffments herein-after authorized to be made for that Purpose; and that it may be lawful to and for the faid Commiffioners or Trustees, or other Perfons as aforefaid, at any Meeting or Meetings from Time to Time in each and every Year, to make and fign fuch further and additional Rates or Affeffments upon all and every Person and Persons who do or fhall inhabit, hold, occupy, be in Poffeffion of, or enjoy any enjoy any Meffuages, Tenements, Lands, Grounds, Coach-houses, Stable, Cellars, Vaults, Houses, Shops, Warehouses, or other Buildings or Hereditaments whatsoever, within any fuch Street or public Place which shall be watered by virtue of this Act, as may, in the Opinion of the faid Commiffioners or Trustees, or other Perfons as aforefaid present at fuch Meeting, be fufficient for defraying the Charges and Expences of finking fuch Wells, and erecting and repairing fuch Pumps, and watering fuch Streets and public Places respectively, and all other Charges and Expences relating or incidental thereto; so that in any one Year fuch further additional Rate or Affeffment fhall not exceed the Sum of Sixpence in the Pound upon or according to the full Annual Rents or Value of fuch Hereditaments refpectively; and that every fuch Rate and Affeffment fhall specify the Period for which it is made, and fhall be demanded and collected from the ufual Quarter Day preceding the to be paid to Time of making and figning the fame; and that all and every fuch Rates or Affeffments, if fo made and figned, fhall be paid, by the Person and Perfons liable to the Payment thereof, to the Collector

noisome and offenfive; be it therefore further enacted, That if upon the View of any Two or more of His Majesty's Juftices of the Peace for the City, Borough, or County wherein fuch Court, Alley, or Place may be fituate, it fhall to them appear that any fuch Court, Alley, or Place is become unneceffary, and may, without Inconvenience to the Public, or to the Owners of Houses or Tenements adjoining thereto, be discontinued and stopped up, then and in fuch Case it shall and may be lawful to and for fuch Justices, by and with the Consent of the Commiffioners or Trustees, or other Perfons having the Control of the Pavements of the Streets and public Places in fuch parochial or other District, testified by Writing under the Hand of the Clerk or Clerks to fuch Commiffioners or Trustees or other Perfons as aforefaid for the Time being, and by and with the Confent of the Owner and Owners of the Houses, Lands, or Tenements adjoining to Four Parts in Five in the Length of any fuch Court, Alley, or Place, teftified by Writing under his, her, or their Hand or Hands, at any Special Seffion to be holden for that Purpose, by Order under the Hands and Seals of fuch Justices, to discontinue and stop up any and every fuch Court, Alley, or Place; and all fuch Courts, Alleys, and Places, or fuch Proportion thereof as may adjoin to the Houses or Tenements of fuch Perfon who fhall have fo confented, fhall be difcon

LXXX.
