fame fhall not be remedied or removed within Seven Days after fuch Notice given to the Owner or Owners, Occupier or Occupiers of the Premises wherein fuch Nuisance or Nuifances fhall be fituate, or left for him, her, or them at his, her, or their laft or ufual Place or Places of Abode, or on the faid Premises, then every such Owner or Occupier fo neglecting to remedy or remove fuch Nuifance pursuant to fuch Notice, and to the Satisfaction of the faid Commiffioners or Trustees or other Perfons, or of their Surveyor or Surveyors of the Pavements for the Time being, fhall forfeit and pay the Sum of Ten Pounds for every fuch Neglect and Difobedience; and alfo it may be lawful to and for the faid Commiffioners or Trustees or other Perfons to indict or caufe to be indicted fuch Perfon or Perfons so neglecting or difobeying any fuch Notice, at the then next or at any future General or Quarter Seffions or Adjourned Quarter Seffions of the Peace for the City, Borough, cr County wherein fuch parochial or other Diftrict may be fituate, for fuch Nuisance, or for fuch Difobedience and Offence; and fuch Perfon or Perfons being found guilty thereof, fuch Nuisance or Nuisances fhall be removed, taken down, and abated according to Law with regard to public or common Nuifances, or may be fubject to fuch Punishment for a Misdemeanor, as the Juftices affembled at a General, Quarter, or Adjourned Seffions for the faid City, Borough, or County may direct.

LXVIII. And be it further enacted, That no Perfon or Perfons whomfoever, at any Time or Times hereafter, fhall breed, feed, or keep any Kind or Species of Swine in any Houfe, Building, Yard, Garden, or other Hereditaments fituate and being in or within Forty Yards of any Street or public Place in any parochial or other Diftri&t within the Jurifdiction of this A&t, nor fhall fuffer any Kind or Species of Swine belonging to him or them to ftray or go about in any Street or public

Place in any parochial or other District within the Jurifdiction of this Act; and that any Perfon or Persons who fhall fo offend shall forfeit and pay for every fuch Offence the Sum of Forty Shillings, and fhall also forfeit the faid Swine and every of them unto the Commiffioners or Trustees or other Perfons having the Control of the Pavements in any fuch parochial or other District; and that it shall and may be lawful for the faid Commiffioners or Trustees or other Perfons, or their Surveyor or Surveyors, Inspector or Infpectors, or any other Officer or Perfon or Perfons directed and appointed by them, and for any Conftables and Headboroughs, at all Times hereafter all fuch Swine to feize, take, drive, and carry away, and fell for the best Price that can be reasonably had; and the Money thereby produced, after deducting all the Cofts and Charges of and incidental to fuch Seizure, Removal, and Sale, to pay to the Treasurer or Treasurers of the faid Commiffioners or Trustees or other Perfons, or to fuch other Perfon or Perfons as the faid Commiffioners or Trustees or other Perfons as aforefaid fhall from Time to Time direct and appoint.

LXIX. And be it further enacted, That if any Lime not to Perfon or Perfons at any Time or Times hereafter be flacked in fhall fift, fcreen, or flack, or caufe to be fifted, the Streets. screened, or flacked, any Lime in any Street or public Place in any parochial or other District within the Jurifdiction of this Act, or fhall cause the fame to be fo done, without the Confent of the Commiffioners or Trustees or other Perfons having the Control of the Pavements in the Streets or public Places in fuch parochial or other District, or of their Surveyor or Surveyors of Pavements for the Time being, and without also previously erecting an Hoard or Inclofure, with the Licence of the Surveyor or Surveyors of the Pavements in any fuch parochial or other Diftrict first obtained as directed in any local A&t or Acts of Parliament relating to any fuch parochial or other District, or in this Act, and which Hoard or Inclosure

to be covered and fecured.

Inclosure shall inclofe all fuch Lime when and as it fhall be fifted, fcreened, or flacked; then he, fhe, or they shall forfeit and pay for every fuch Offence a Sum not being lefs than Forty Shillings nor exceeding Five Pounds, to be recovered in the fame Manner in which other Penalties are hereafter directed to be recovered by virtue of this Act.

LXX. And be it further enacted, That if at any Time or Times hereafter the Owner or Owners, Occupier or Occupiers of any Houfe, Building, or Premises in any parochial or other District within the Jurifdiction of this Act, having any Iron or Wooden Rails or Bars over the Areas or Openings to any Kitchens or Cellars or other Part or Parts of his or their Houfe, Building, or Premises, beneath the Surface of the Foot Pavements of any Streets or public Places in any fuch parochial or other District, or having any Door-way or Entrance into the Basement or Cellar Story thereof, fhall not either keep the fame, or the Walls of fuch Kitchens or Cellars, in fufficient and good Repair, or fafely and fecurely guard and conftantly keep the fame fecurely guarded by a Rail or Rails, or cover the fame over with a strong Flap or Trap Door, according to the Nature of the Cafe, and to the Satisfaction of the Commiffioners or Trustees or other Perfons having the Control of the Pavements in fuch parochial or other District, or of the Surveyor or Surveyors of the Pavements in any fuch parochial or other District for the Time being, or of any Infpectors or other Officers or Perfons appointed by the faid Commiffioners, Truftees, or other Perfons as aforefaid, or fome of them, and fo as to prevent Danger to Perfons paffing and repaffing; or if any fuch Occupier or Occupiers do or fhall leave open or not fufficiently and fubftantially cover and keep covered and fecured, to fuch Satisfaction as aforefaid, any Coal or other Hole, Funnel, Trap-door, or Cellar-flap, belonging to or connected with his, her, or their respective Houses, Buildings, or Pre

mifes (fave and except only during such reasonable Time as any Coals, Wood, Cafks, or other Things fhall be putting down or taking out of any fuch Vault or Basement Story, or during such reasonable Time as the Flap, Trap-door, or Covering thereof fhall be altering, repairing, or amending); or if fuch Owner or Owners, Occupier or Occupiers, shall not repair, and from Time to Time keep in good and substantial Repair, to the Satisfaction of the faid Commiffioners or Trustees or other Perfons, or of the faid Surveyor or Surveyors, Infpectors or other Persons appointed by the said Commiffioners or Trustees or other Perfons as aforefaid, all and every or any fuch Iron or Wooden Rails, Guard Rails, Flaps, Trap-doors, and other Covering; then and in every fuch Cafe the Perfon or Perfons neglecting fo to do fhall for every or any fuch Offence forfeit and pay any Sum not being less than Forty Shillings nor exceeding Five Pounds, to be recovered in fuch and the fame Manner in which other Penalties are hereafter directed to be recovered by virtue of this Act; and that in any or either of fuch Cafes of Neglect it shall and may be alfo lawful to and for any Two or more of the faid Commiffioners or Trustees, or other Perfons as aforefaid, and without the Authority of any public or general Meeting, or for their Surveyor or Surveyors of the Pavements for the Time being, or for their Infpectors, or for any other Perfon by fuch Commiffioners or Trustees or other Perfons appointed as aforefaid, to caufe all and every fuch Door-ways, Entrances, Holes, and Funnels to be well and fecurely covered over and guarded, and all Iron or Wooden Rails, or Guard Rails, Flaps, Trap-doors, or Coverings, to be well and fubftantially repaired or renewed by fuch Perfon or Perfons as they fhall think proper to employ, and with fuch Materials and in fuch Manner as they or he may direct; and that all the Costs, Charges, and Expences attending the fame be afcertained and

certified by the Surveyor or Surveyors of the Pavements in any fuch parochial or other District, and shall be borne and paid by the Owner or Owners, Occupier or Occupiers, or other Perfon or Perfons fo neglecting to repair and make good the fame in Manner aforefaid; and that if such Cofts, Charges, and Expences fhall not be fo paid by fuch Perfon or Perfons to the faid Surveyor or Surveyors, or to fuch other Perfon or Perfons as he or they fhall or may appoint to receive the fame, within Twenty-four Hours after an Account of the Cofts, Charges, and Expences fo afcertained and certified fhall have been given to or left for fuch Perfon or Perfons at or on fuch Houses, Buildings, or Premises, then double the Amount of the Sum fo certified fhall become due and payable from fuch Perfon or Persons, over and above the other Penalties hereby imposed, and shall and may be recovered and levied in fuch and the fame Manner in which any other Penalties are herein-after directed to be recovered, or in which any Monies may be recovered from any Water or Gas Light Companies, or any other Perfons, for or on account of any Cofts and Charges of relaying any Pavements, by virtue of any local Act or Acts of Parliament relating to fuch parochial or other District, or of this Act.

LXXI. And be it further enacted, That if at any Time or Times hereafter any Perfon or Persons shall dig or make or cause to be dug or made any Hole, or leave or caufe to be left any Hole before any vacant Ground, or before or behind or on the Side of any House or other Tenement or Building erected or being erected or about to be erected in and adjoining to any Street or public Place formed or to be formed or forming in any parochial or other District within the Jurifdiction of this Act, for the Purposes of making any Vault or Vaults, or the Foundation or Foundations to fuch Houfes or other Buildings, or for any other Purpose whatsoever, and fhall not forthwith inclose the fame in a good and fufficient
