rials, Meat, Offal, Garden Pots, Matters or Things, or of the Coaches, Carts, Waggons, Drays, Wheelbarrows, Handbarrows, Sledges, Trucks, or other Carriages which fhall be fo fet or placed, expofed or fet out as aforefaid, and the Mafter or Masters, Employer or Employers of the Perfon or Perfons fo offending, shall forfeit and pay for the First Offence the Sum of Forty Shillings, and for the Second and every subsequent Offence any Sum not exceeding Five Pounds; and that such respective Penalties shall be paid to the Treasurer or Treasurers of the Commiflioners, Trustees, or other Persons having the Control of the Pavements in the Streets or public Places in the parochial or other District wherein any fuch Offence fhall have been committed, or to fuch other Perfon or Perfons as they fhall direct and appoint; and also, that not only fhall fuch Penalties become payable and to be recovered, but that it fhall and may be lawful to and for any Person or Persons appointed or to be appointed by the faid Commiffioners or Trustees or other Perfons as aforefaid for that Purpofe, without any Warrant or other Authority than this Act, to seize any fuch Stall Board, Shew Board, Chopping Block, Basket, Wares, Merchandize, Casks, Goods, Coach, Cart, Wain, Waggon, Dray, Wheelbarrow, Handbarrow, Sledge, Truck, or other Carriage, together with the Horfe or Horfes, Afs or Afses, Mule or Mules, if any shall be thereunto belonging, with the Harness, Gear, and Accoutrements thereof, or any fuch Timber or other Materials, or other Matters or Things aforefaid, or any of them; and in cafe any of the Wares, Goods, and Merchandizes fo feized shall be perishable, or shall be Articles of Food, then the fame fhall be immediately forfeited, and fuch Perfon or Perfons who fhall feize the fame fhall deliver the fame or cause the fame to be delivered to the Churchwardens or Overfeers of the Poor, or fome of them, or to the Master of any Workhouse fituate in the faid paroH 4

chial or other District, or of the Parish whereunto fuch District shall belong; and the fame fhall and may be given and distributed by him or them unto one or among any one or more of the poor Inhabitants of the faid parochial or other District, or of fuch Workhouse, to and for his or their Benefit ; but otherwife fuch Perfon or Perfons fhall cause the Stall Board, Basket, Cafk, Goods, Coach, Cart, Wain, Waggon, Dray, Wheelbarrow, Handbarrow, Sledge, Truck, or other Carriage, Horse or Horses, Affes or Mules, or any Materials and Things fo feized, to be removed to any Place appointed for the Reception thereof in any fuch parochial or other District, if any fuch there be, and otherwise to fuch Place or Places as he or they fhall judge convenient, giving parole or written Notice of fuch Place or Places whereunto the fame fhall be removed, unto the Owner, Driver, or other Perfon having any Interest in the Goods, Coach, Cart, Wain, Waggon, Dray, Wheelbarrow, Handbarrow, Sledge, Truck, or other Carriage, Horses, Affes, Mules, Materials, or other Things fo feized or removed, if he, fhe, or they fhall be then and there prefent; and the same shall be there kept and detained until fuch Owner, Driver, or other Person interested therein as aforefaid fhall cause to be paid the faid Penalty, together with the Charges for taking or removing the fame, and of keeping fuch Horse or Horses, Affes or Mules, if any; and in cafe the Goods, Carriage, Horfes, Materials, or other Things fo removed (not being perishable or Articles of Food) fhall not be claimed, and the faid Penalty and Charges be paid, within Five Days next after fuch Removal thereof, then and in every fuch Cafe it fhall and may be lawful to and for the faid Commiffioners or Trustees, or other Perfons as aforefaid, or their Surveyor of the Pavements, or any other Person to be appointed by the faid Commiffioners or Trustees or other Perfons as aforefaid, to order the same to be appraised and fold; and

the Overplus of the Money arifing by fuch Sale fhall be returned to the Owner or Owners thereof, if he or they shall have given fuch Notice as aforefaid, after deducting the faid Penalty, and fuch Cofts, Charges, and Expences attending such seizing, removing, keeping, appraising, and felling the fame, as the faid Commiffioners or Trustees or other Perfons as aforefaid, or any Surveyor of the Pavements in any parochial or other District, fhall ascertain and allow.

LXVI. And be it further enacted, That in all For the ReCafes where by this Act or by any local Act or Acts moval of of Parliament relating to any parochial or other and AnnoyDistrict within the Jurifdiction of this Act, it may ances, a Rebe directed, required, and provided that any Perfon petition of or Persons setting or placing any Stall Board, Notices unChopping Block, Basket, Wares, Merchandize, Pipe, Barrel, Cafk, or Veffel, Goods, Timber, Stones, Bricks, Lime, or any other Materials, Matters, or Things, or causing or procuring the fame or any of them to be fet or placed upon any of the Carriage or Foot Pavements or otherwife, contrary to the Regulations herein or in any fuch local Act or Acts contained, in any of the Streets or public Places within the Jurifdiction of this Act, or that any Person or Perfons driving or placing any Coach, Cart, Waggon, Dray, Dray, Wheelbarrow, Wheelbarrow, Handbarrow, Sledge, Truck, or other Carriage in or upon or over any of the Foot Pavements in any Streets or Places within the Jurifdiction of this Act, or caufing or procuring the fame to be so driven or placed, fhall have Notice and be required to remove the fame previous to fuch Perfon or Perfons being fubject or liable to the Penalty or Penalties impofed by virtue of fuch local Act or Acts or of this A&t, and to the Seizure, Forfeiture, Appropriation, Appraisement, or Sale of any fuch Goods, Materials, Matters and other Things, Coaches, Carts, Waggons, Drays, Wheelbarrows, Handbarrows, Sledges, Trucks, or other Carriages, in Manner directed by fuch local Act or

Acts or by this Act, then if any Perfon or Perfons fhall fet or place any Goods, Materials, Matters, or other Things, or fhall fet, place, or drive any Coaches, Carts, Waggons, Drays, Wheelbarrows, Handbarrows, Sledges, Trucks, or other Carriages upon or over the faid Pavements, or any of them, or any Part thereof, at any Time or Times fubfequent to his, her, or their having received fuch Notice, or having been required to remove the fame, or any other Goods, Materials, Matters, or Things, or any other Coaches, Carts, Waggons, Drays, Wheelbarrows, Handbarrows, Sledges, Trucks, or other Carriages from off the said Pavements or any of them, or shall caufe or permit the fame or any of them to be fet or placed or driven by his or their Servants, or by any Person or Persons employed by him or them; in any and every fuch Cafe it fhall not be neceffary or requifite that any Perfon or Perfons, feeing fuch Offence or Offences committed again, fhould require the Removal of the faid Goods, Materials, Matters, or Things, or Coaches, Carts, Waggons, Drays, Wheelbarrows, Handbarrows, Sledges, Trucks, or other Carriages; but the fame or any of them, being fo again fet, placed, or driven in, upon, or over the faid Pavements or any of them, or any Part thereof, contrary to the Directions of any fuch local Act or Acts of Parliament, or of this Act, fhall and may be seized, forfeited, removed, applied, detained, appraised, and fold in Manner herein provided as to any other Goods, Materials, Matters or Things, or Coaches, Carts, Waggons, Drays, Wheelbarrows, Handbarrows, Sledges, Trucks, or other Carriages, which shall not be removed on a Requifition or Notice being given fo to do as herein-before provided; and the Perfon or Perfons fo committing the faid Offence or Offences, and the Owner or Owners of the Goods, Materials, Matters or other Things, or Coaches, Carts, Waggons, Drays, Wheelbarrows, Handbarrows, Sledges, Trucks, or other Carriages which shall be so placed

or driven, and the Master or Masters, Employer or Employers of the Perfon or Perfons fo offending, fhall be fubject and liable to the fame Penalty or Penalties, Forfeitures, Proceedings, Charges, and Punishments, as if fuch Perfon or Perfons offending had neglected or refused to remove the faid Goods, Materials, Matters, or other Things, or Coaches, Carts, Waggons, Drays, Wheelbarrows, Handbarrows, Sledges, Trucks, or other Carriages, when required fo to do, under and by virtue of any local Act or Acts of Parliament, or of this Act, and although the said Notices or Requifitions fhall not have been repeated or again given to the Perfon or Perfons committing or directing or permitting fuch Offence or Offences, or any of them; any thing in this Act or in any local or other Act or Acts of Parliament to the contrary thereof in anywife notwithstanding.

LXVII. And be it further enacted, That in cafe Hog-ftyes any Hog-ftye, Slaughter-house, Horfe-boiling Ef and other tablishment, or any other Matter which in the Nuisances Judgment of the Commiffioners or Trustees, or moved. other Perfons having the Control of the Pavements in any parochial or other District within the Jurifdiction of this Act, is a Nuisance to the other Inhabitants of fuch parochial or other District or any of them, at any Time or Times hereafter shall be in any of the Streets, Lanes, or public Places in any parochial or other District within the Jurifdiction of this Act, it fhall be lawful for the said Commiffioners or Trustees, or other Perfons having the Control of the Pavements of the faid Streets and public Places, upon Complaint thereof to them made by any Inhabitant, and after due Investigation of fuch Complaint, by Notice in Writing under the Hand or Hands of any of their Surveyor or Surveyors, or of their Clerk or Clerks for the Time being, to order that every or any fuch Hog-ftye, Neceffary-house, Slaughter-house, or other Matter, being a Nuisance, fhall be forthwith remedied or removed; and if the
