fioners or Trustees or other Perfons as aforefaid, then every such Perfon or Perfons fo offending fhall in like Manner forfeit and fhall pay the like Sum of Five Pounds: Provided always, that it fhall and may be lawful to and for the faid Commiffioners, Trustees, or other Perfons having the Control as aforefaid, either to contract and agree with and to appoint the fame Person or Perfons or a different Perfon and other Perfons to be the Scavengers, Rakers, or Cleansers within their parochial or other District of the Streets or public Places therein, and to be the Persons to collect and carry away and poffefs and retain the Soil, Ashes, Cinders, Rubbish, Duft, Dirt, and Filth from the Houses and Premises within their respective parochial or other Districts, as they fhall deem moft expedient; but that the Right and Benefit of fuch Soil, Afhes, Cinders, Rubbish, Duft, Dirt, and Filth, fhall belong exclufively to the Perfon or Perfons who fhall be from Time to Time by the faid Commiffioners or Trustees or other Persons as aforefaid appointed to collect and poffefs the fame; any thing in any local Act or Acts of Parliament or in this Act to the contrary notwithstanding.

LX. And be it further enacted, That if any Perfon Duft to be or Persons, other than the Scavengers, Rakers, or removed only Cleansers of any parochial or other District, or the by Scaven other Person or Perfons employed or appointed gers fo apby or contracting with the faid Commiffioners or Trustees, or other Perfons as aforefaid, to collect and retain the Duft, Cinders, or Afhes within their respective parochial or other District, or those employed by and under fuch Perfon or Perfons, shall on any Pretence whatsoever go about to collect or gather, or fhall ask for, receive, or carry away any Duft, Cinders, or Afhes, it fhall and may be lawful for any Juftice of the Peace for the City, Borough, or County within which fuch parochial or other District may be fituate, upon Complaint to him made, to grant a Warrant to bring before him

fuch Offender or Offenders, and alfo for any Perfon or Persons who fhall fee any fuch Offence committed to seize, and alfo for any other Perfon or Perfons to affift in feizing, the Offender or Offenders, together with the Horfes, Affes, Cattle, Carts, Trucks, Wheelbarrows, or other Carriages or Implements made ufe of for carrying the fame away; and by the Authority of this Act, and without any other Warrant, to convey him, her, or them before fuch Justice of the Peace, or any Justice of the Peace for the faid City, Borough, or County; and fuch Justice shall and he is hereby authorized and required to examine upon Oath the Perfon or Perfons apprehending fuch Offender or Offenders, or any Witness or Witneffes who fhall appear to give Information or Evidence touching fuch Offence; and if the Party or Parties fhall be convicted of going about to collect or gather, or of afking for, receiving, or carrying away any Dust, Cinders, or Ashes from any House or other Premises within any parochial or other District within the Jurifdiction of this Act, not being the Perfon or Perfons employed or appointed by or contracting with the faid Commiffioners or Trustees, or other Persons having the Control of the Pavements within fuch parochial or other District, to collect and poffefs the Duft, Cinders, and Ashes from the Houses and Premises therein, or not acting with or under his or their Authority, he, she, or they shall refpectively for the First Offence forfeit and pay the Sum of Ten Pounds; for the Second Offence, the Sum of Fifteen Pounds; and for the Third and every other subsequent Offence, the Sum of Twenty Pounds; and One Moiety of which refpective Penalties fhall be paid to the Informer or Informers, or to the Perfon or Persons who fhall apprehend the Offender or Offenders, and the other Moiety fhall be paid and fhall belong to the Person or Perfons fo employed or appointed by or contracting with the faid Commiffioners or Trustees or other Perfons

Perfons as aforefaid; and if such Offender or Offenders fhall not on Conviction pay the said Penalty or Penalties, fuch Justice is hereby required to direct fuch Horses, Affes, Cattle, Carts, Trucks, Wheelbarrows, or other Carriages or Implements which fhall have been so seized, to be appraised and fold; and after deducting out of the Monies to arife by fuch Sale the Penalty or Penalties incurred, together with the reasonable Charges and Expences of fuch Warrant, and of fuch Distress, Appraisement, and Sale, the Overplus thereof fhall be returned upon Demand to the Party or Parties whose Horses and other Things fhall be appraised and fold; and in cafe there fhall have been no fuch Seizure as aforefaid, or if the Horfes, Affes, Cattle, Carts, or other Things which fhall be appraised and fold, shall not produce a fufficient Sum of Money to pay the faid Penalty or Penalties, Charges and Expences, then if fuch Offender or Offenders fhall not upon the Conviction pay the said Penalty or Penalties, or fuch Part or Parts of the said Penalty or Penalties, Charges and Expences, which shall remain over and above the Produce of the Horses, Affes,Cattle, Carts, and other Things fo feized and fold, then fuch Justice is hereby required to commit such Offender or Offenders to the Common Gaol or House of Correction for the City, Borough, or County where fuch parochial or other District shall be fituate, there to be kept to hard Labour for any Time not exceeding Thirty Days, unless fuch Penalty or Penalties, and Charges and Expences, and every Part thereof, fhall be fooner paid and

fatisfied.

LXI. And be it further enacted, That in case On the fuch Perfon or Perfons fo employed or appointed by Neglect of Scavengers or contracting with the faid Commiffioners or to remove Trustees or other Perfons for the Purposes aforefaid, Duft for shall neglect for the Space of Seven Days to bring Seven Days, or cause to be brought Carts or proper Carriages the Duft may into all the Streets or public Places as aforefaid by any oth

where fuch Carriages can pafs, and to give Notice in Manner aforefaid to the Inhabitants of their coming, for the Purpose of taking away fuch Duft, Dirt, Soil, Rubbish, Filth, Cinders, and Afhes, and to give the like Notice in every Place into which the faid Carts and Carriages cannot pafs, or to take away and remove all fuch Duft, Dirt, Soil, Rubbish, Filth, or Cinders or Ashes from the Houses and Premises of all and every the Inhabitants of fuch Streets or public Places, or from fuch Part or Parts of fuch Houses or Premises where such Duft, Dirt, Soil, Rubbish, Filth, Cinders, and Ashes fhall be depofited, that then (after Twenty-four Hours Notice given to fuch Perfon or Perfons fo employed or appointed by or contracting with the said Commiffioners or Trustees or other Perfons for the Purposes aforefaid, or left for him or them at his or their usual Houfe or Houses, Yard or other Premises, requiring him or them to bring or caufe to be brought Carts or Carriages to take away their Duft, Dirt, Filth, Cinders, or Ashes, and to take away and remove the fame from their respective Houses and Premises) it fhall and may be lawful for fuch of the Inhabitants of fuch of the said Streets or public Places, who fhall have given fuch Notice as aforefaid, to give away or to fell their Duft, Dirt, Filth, Cinders, or Ashes to any Perfon or Perfons whomsoever; and that fuch Perfon or Perfons who fhall take and carry away the said Dust, Dirt, Filth, Cinders, or Athes, fhall not be fubject or liable to any Penalty or Penalties for fo doing upon every fuch Neglect; any thing in this Act or in any local Act or Acts of Parliament contained to the contrary thereof notwithstanding.

LXII. And be it further enacted, That no Scavenger, Raker, or Cleanfer, or any other Person, any Common fhall fweep, rake, or place any of the Slop, Mud, Dirt, Duft, Rubbish, Ashes, Filth, or Soil, found or being in any Streets or public Places in any parochial or other District within the Jurifdiction of

this Act, or any other Slop, Mud, Dirt, Dust, Rubbish, Afhes, Filth, Soil, or other Articles or Things, over any Grate or Grates placed above or communicating with any common or public Drain or Sewer, or into any common or public Drain or Sewer; and that any and every Scavenger, Raker, or Cleanfer, or any other Perfon or Perfons, who shall so offend, shall for every such Offence forfeit and shall pay the Sum of Five Pounds, to be recovered in the fame Manner in which other Penalties and Forfeitures are herein-after directed to be recovered by virtue of this Act.

LXIII. And be it further enacted, That every Footways Occupier of any House, Tenement, Warehouse, to be swept Shop, Shed, Coach House, Stable, Chapel, Meeting daily during House, or other public or private Building in any Snow. Street or public Place in any parochial or other District within the Jurifdiction of this Act, during the Continuance of Frost, or after or during the Fall of Snow, from Time to Time, and at all Times hereafter, shall Once in every Day before the Hour of Ten of the Clock in the Forenoon of each Day, except Sunday, fweep and cleanfe, or caufe to be swept and cleanfed, the Footway all along the front Side or back Walls of their refpective Houfes, Tenements, Warehouses, Shops, Sheds, Coach Houses, Stables, Chapels, Meeting Houses, or other public or private Building; and that every Occupier who fhall neglect fo to do fhall for every fuch Offence forfeit and pay any Sum not exceeding the Sum of Ten Shillings, to be levied and recovered and applied in such and the same Manner in which other Penalties are by this Act herein-after directed to be recovered and applied; and alfo_that_the Owner or Owners of any Houfe or other Tenement within the Jurifdiction of this Act, which may be let furnished or in divided Apartments, shall be deemed and taken, for the Purpose of this Provifion, to be the Occupier or Occupiers of every fuch House or other Tenement refpectively.
