Communication from the Canal Commissioners, relative to certain claims against the Commonwealth.

SIR-In pursuance of several acts of Assembly, the Board of Canal Commissioners report the following cases of claims for damages, and the testimony on which the awards were founded, which have received their examination, and which have not been heretofore reported:

Act of 3d April, 1846-George Hogg, for work done on section No. 3, of the Erie Extension, award nine hundred fifty-one dollars and forty cents; for work done on aqueduct, No. 20, no allowance.

Act of 8th April, 1846-Alfred Royer, for damage to his section boat on the Portage railroad, award one hundred and seventy-five dollars.

Act of 17th April, 1846-John M. Marshall, for damage to his section boat on the Portage railroad, no allowance.

Communication from the Canal Commissioners, in relation to the claim of M'Kown and Flood.

The Board of Canal Commissioners in compliance with the provisions of the act of Assembly of 10th April, 1846, entitled "An Act concerning the claim of M'Kown and Flood," have examined into said claim and found that in their judgment there is equitably due to said contractors, a balance of nine hundred and forty dollars. As the act above referred to requires the board to report the facts and principles upon which their decision may be based, they would beg leave, in compliance with that portion of it, to state, that the material facts are that M'Kown and Flood entered into a contract for cleaning out the canal from the Allegheny to the Monongahela river, through the tunnel, in October, 1839, at the rate of twenty-seven cents per cubic yard. That they executed the work according to their contract and that a final estimate was made on it at the contract price only, notwithstanding it appears from the appended statement of Mr. Morris, the engineer, who had charge of the work during its execution, that a portion of it was much more difficult than was anticipated, and was therefore, a fair item for extra compensation. For the quantity on which this allowance should be made, the Board have had to rely on the statement of the engineer before referred to, as the best evidence on that point which could be had at this time, and the price estimated by the engineer, corresponding with the judgment of the board in regard to the value of the work, has been adopted also.

Statement of Mr. Morris.

HARRISBURG, March 26, 1841.

To the Committee of Claims in Senate of Pennsylvania:

The contract for cleaning out the Monongahela branch of the canal at Pittsburg, from the aqueduct over the Allegheny river, to the Monongahela, including the tunnel, and the removal of the bar outside of out-let locks, was allotted to Flood and M'Kown, contractors. They completed their job and a final estimate has been made out but not paid. Cleaning out the tunnel and removing the bar were attended with great difficulty, much more I believe, than was anticipated by the contractors.

The quantity of excavation in tunnel was about

A fair compensation for excavation of tunnel, would be forty-seven cents per yard, and for excavation of bar, eighty-seven cents per yard. The contractors' prices for

the whole excavation was twenty-seven cents per yard, which in my opinion was not

too much for any part.

From this data an allowance should be made the contractors as follows:

With these facts before them, the Board on the 3d day of October, 1846, adopted the following resolution, viz:

"Resolved, That in the opinion of the board, M'Kown and Flood, are justly entitled to receive nine hundred and forty dollars, in addition to the amount they have received under the contract for cleaning out the canal between the Monongahela and Allegheny rivers, in the city of Pittsburg, and removing the bar opposite the out-let locks in the Monongahela river."

Communication from the State Treasurer, in relation to the payment of the Interest on the Public debt.

SIR-In compliance with a resolution requesting the State Treasurer “to inform the Senate, as soon as practicable, whether the whole of the half yearly interest upon the State debt, which fell due on the first instant, [ultimo] has been paid, if not, what amount remains unpaid; and what amount of available funds there is in the Treasury; and also, whether any of the accruing revenues of the present year have been antici/pated," I have the honor to submit the following statement:
