On motion of Mr. Shepard,

The following resolution was twice read, considered and agreed to, viz.:

Resolved, That a committee of nine members of the Senate be appointed to draft suitable resolutions and prepare a programme for memorial exercises on the deaths of the late Senator John T. Harrison, of Philadelphia, who died on December 18th, 1903; of the late Senator Alexander E. Patton, who died September 5th, 1904, and upon the late Edwin W. Smiley, Chief Clerk of the Senate, who died September 7th, 1904, and that a special meeting of the Senate be held on Tuesday, February 7th, 1905, at 2 o'clock P. M., to which said resolutions be submitted and the programme carried out.

Ordered, That Messrs. Shepard, Irvin, Cumings, Woods (Westmoreland), Fisher, Scott, Stober, Cochran and Hall be said committee.

A motion was made by Mr. Keyser,

That when the Senate adjourn to-day it be to meet to-morrow morning, at eleven o'clock.

Which was agreed to.

The Senate proceeded to the first reading and consideration of Senate bill No. 1, entitled "A joint resolution to provide for the celebration of the State of Pennsylvania in the Lewis and Clark Centennial Exposition, to be held in the city of Portland, Oregon, in the year one thousand nine hundred and five, in commemoration of the one hundredth anniversary of the exploration of the Oregon country by an expedition planned by President Jefferson and commanded by Captain Meriwether Lewis and William Clark, and providing for the appointment of a commission, and making an ap propriation to defray the expenses of the same."

And said bill having been read at length the first time, Ordered, To be laid aside for second reading.

The Senate proceeded to the first reading and consideration of Senate bill No. 2, entitled "An act to amend A supplement to an act, entitled 'An act to consolidate, revise and amend the penal laws of this Commonwealth,' approved the thirty-first day of March, one thousand eight hundred and sixty; amending the ninety-first section thereof defining rape and carnal knowledge of female children, and prescribing the penalty thereof,' approved the nineteenth day of May, Anno Domini one thousand eight hundred and eightyseven."

And said bill having been read at length the first time, Ordered. To be laid aside for second reading.

The Senate proceeded to the first reading and consideration of Senate bill No. 3, entitled "An act to provide for charging the cost of construction of sewers and drains heretofore or hereafter constructed in townships of the first class against properties accommodated or benefited thereby; authorizing the township commissioners to create sewer districts, to apportion the cost of sewer construction among the same, and to prescribe the manner in which the charges shall be assessed on properties and municipal liens filed for the same, or to assess an annual tax for payment of such cost."

And said bill having been read at length the first time, Ordered, To be laid aside for second reading.

The Senate proceeded to the first reading and consideration of Senate bill No. 4, entitled "An act to provide for the retirement of judges of courts of record in this Commonwealth who have served as such judge for twenty-five successive years and have attained the age of seventy years, and for the payment of such retired judges, and for the filling of vacancies caused by said retirement."

And said bill having been read at length the first time, Ordered, To be laid aside for second reading.

The Senate proceeded to the first reading and consideration of Senate bill No. 5, entitled "An act in reference to the eligibility of road jurors and jurors of view."

The Senate proceeded to the first reading and consideration of Senate bill No. 7, entitled "An act to create the Department of Public Printing and Binding, to carry out the provisions of seetion twelve article three of the Constitution in relation to the public printing and binding and the supply of paper and other materials therefor."

The Senate proceeded to the first reading and consideration of Senate bill No. 8, entitled "An act to amend paragraph sixteen of section one of an act, entitled 'An act to regulate the publication, binding and distribution of the public documents of this Commonwealth,' approved the second day of May, Anno Domini one thousand eight hundred ad ninety-nine."

And said bill having been read at length the first time, Ordered, To be laid aside for second reading.

A motion was made by Mr. Quail,

That Senate bill No. 6, entitled "An act creating a Department of Health and defining its powers and duties," be re-committed to the Committee on Public Health and Sanitation.”

Which was agreed to.

A motion was made by Mr. White,

That the Senate do now resolve itself into executive session for the purpose of acting on the nomination of N. R. McNeal, of Claysville, Washington county, to be commissioner of the National road, lying between the Monongahela river, westward, and the line of the State of West Virginia, for the term of three years, to compute from June 1, 1903, agreeably to the Executive message presented on January 18th.

Which was agreed to.

Whereupon,

A motion was made by Mr. White,

That the Senate do advise and consent to the nomination of N. R. McNeal, of Claysville, Washington county, to be commissioner of the National road, lying between the Monongahela river, westward, and the line of the State of West Virginia, for the term of three years, to compute from June 1, 1903.
