TUESDAY, March 12, 1816,

Mr. Rogers presented a petition from Philip H. Mattes of the borough of Easton, stating that in the year 1812 he purchased from Jacob Arndt and John Herster a house and lot in said borough, but that before a conveyance was completed the said Jacob Arndt died the petitioner therefore prays that the said John Herster, and the executors of the last will and testament of Jacob Arndt may be authorized by law to make a conveyance for the said property; and

Said petition was read, and laid on the table.

Mr. Frailey from the committee of accounts, made further report in part, which was read as follows, to wit.

That they have settled the account of William Erwin, a member of Senate, for his daily pay, 98 days, 392 dollars, 43 dollars and 20 cents mileage, 435 dollars and 20 cents. They there fore offer the following resolution:

Resolved, That the Speaker draw his warrant in favor of William Erwin, a member of Senate, for 435 dollars and 20 cents. On motion,

Said report was again read, and the resolution thereto attached, considered and adopted.

Whereupon,

A warrant was accordingly so drawn.

The bill from the House of Representatives, entitled

A supplement to the act, entitled, an act to authorize James Barton and George Biddis, their heirs and assigns, to convey wa ter from a spring or stream of water called the Vandine Kill, into the town of Milford in the county of Pike,' was read the third time, and

Resolved, That this bill pass.

The bill from the House of Representatives untitled

An act to review part of the state road from the mouth of Beaver creek, to the top of the hill north-west of Greersburg,' was read the third time, and

Resolved, That this bill pass.

The bill from the House of Representatives, entitled

An act for the relief of Benjamin Jennings, an old revolutionary soldier,' was read the third time, and

Resolved, That this bill pass.

Ordered, That the clerk return said bills to the House of Representatives with information, that Senate have passed the same with amendments, in which the concurrence of that house is requested.

Agreeably to order,

The Senate resolved itself into a committee of the whole, Mr. Lane in the chair, on the bill from the House of Representatives, entitled

An act authorizing the Governor to incorporate four companies for making an artificial road from the town of Washington in this state, to intersect the Harrisburg and Pittsburg turnpike road at or near the town of Bedford.'

And after some time,

The committee rose and reported said bill as committed. The clerk of the House of Representatives being introduced, presented for concurrence, the bill, entitled

An act authorizing a special court to be holden in the county of Lancaster, for certain purposes therein mentioned,' which was read the first time.

He returned the bills, entitled as follow, viz.

An act directing the formation of a map of Pennsylvania.'
An act to incorporate the city of Pittsburg.'

An act providing for the erection of a state capitol.'

A supplement to the act, entitled, an act establishing a fee bill.'

And informed,

That the House of Representatives have passed said bills with amendments, in which the concurrence of Senate is requested. He presented for signature, the bills, entitled as follow, viz.

A further supplement to an act, entitled, an act to incorporate a company for making an artificial road from Harrisburg through Lewistown and Huntingdon to Pittsburg.'

An act vesting the title of a certain piece of land in Bethel township and county of Bedford, in certain trustees and their successors, for the use of the Baptist congregation in said township.'

An act to authorize the surveyor of the township of the Northern Liberties in the county of Philadelphia, to re-survey, lay out and regulate Slesman's alley in the incorporated district of the Northern Liberties.'

An act authorizing the Secretary of the Land Office to issue a patent to Amos Judson, for an in lot in the town of Waterford in Erie county."

An act to incorporate the town of Strasburg, in the county of Lancaster.?

An act to incorporate the Greensburg Manufacturing company, in Greene county.'

An act to authorize the removal of the prisoners confined in the jail or debtors apartment in the city of Philadelphia to the new prison, and for other purposes.'

An act to authorize the Governor to incorporate a company to erect a bridge over the river Juniata at the borough of Huntingdon.'

An act appropriating money to improve the road across Jack's mountain in Mifflin county, and the road leading from McCall's ferry bridge in Lancaster county.'

An act to enable Edward Duffield and Joseph K. Swift, executors of John Swift, deceased, to sell and convey a certain tract of land therein mentioned.' Also,

A resolution authorizing the Surveyor General to renew the seal of his office.

He informed,

That the House of Representatives have concurred in the amendments by Senate, to the bill, entitled

An act to authorize the Governor to incorporate a company for erecting a bridge over the north-east branch of the river Sus quehanna, between the town of Cattawissa and the mouth of Fishing creek,'

He further informed,

That the House of Representatives have concurred in the amendments by Senate, to the bill, entitled

'An act to authorize Andrew Flemming to erect and maintain a toll bridge over Oil creek in the county of Venango,' except the following, viz..

Sect. 1. line 36, insert after worship' these words on Sabbeth days,' in which they have non-concurred.

The Speaker signed the bills and resolution presented for sig

nature.

The amendment by the House of Representatives, to the bill, entitled

'An act providing for the erection of a state capitol,' was read as follows, viz.

Sect. 5. lines 2 and 3, strike out these words previous to the materials being delivered.'

Said amendment was again read, considered and concurred in. Ordered, That the clerk inform the House of Representatives

A supplement to an act, entitled, an act establishing a

fee bill,' were read as follows, viz.

Sect. 1. after sheriff' in line 4, insert or constable.'

Add thereto a section to be called. section 2. as follows, viz.

Sect. 2. And be it further enacted by the authority aforesaid,

That' from and after the passage of this act, it shall and may be lawful for the recorders of deeds throughout this commonwealth to charge, demand, and receive their fees, as prescribed in the act to which this is a supplement, before the service for which such fees are chargeable shall have been actually done and performed, any former law, usage or custom to the contrary notwithstanding: Provided nevertheless, That it shall be, and it is hereby made the duty of the said recorders of deeds, to do, perform, or cause to be done and performed in case of their resignation or removal from office, the business for which the fee or fees has or have been by them received, within sixty days after the time at which such fee or fees was or were received, and for every neglect or failure of said recorders, to do and perform, or cause to be done and performed as aforesaid, the service or services for which the fee or fees has or have been received, within sixty days as aforesaid, he or they so neglecting or failing, shall for every such neglect or failure, forfeit and pay the sum of fifty dollars to the person or persons aggrieved, to be by him or them recovered as debts of equal amount are made by law recoverable.

The amendments by the House of Representatives, to the bill, entitled

An act to incorporate the city of Pittsburg,' were read as follow, viz.

Sect. 2. strike out from the word 'the' in the beginning of line 2 to the word 'shall' in line 4, and insert in lieu thereof the following freemen of the city of Pittsburg qualified to elect members of the general assembly of this commonwealth.'

Sect. 5. line 2, strike out whole legislative.' Same line strike out exclusively.'

Sect. 8. line 15, strike out the words or upon any other duty.' Line 16, between the words or associate' insert one of the." Sect. 9. line 11, between the words the common' insert ' court of.'

Sect. 11. line 35, strike out and usage.' Same line make the words case require' read cases requires.'

Add two new sections as follow, viz.

Sect. 9. And be it further enacted by the authority aforesaid, That the Secretary of the Commonwealth and Surveyor General,

shall be empowered to authorize the publisher of the state map, to publish the county maps or any number of them separately: Provided, The same shall be done without any expence to the state.

Sect. 10. And be it further enacted by the authority aforesaid, That it shall be the duty of the Surveyor General, or any deputy surveyor duly commissioned, and they are hereby required, to demand, receive and recover from any person whatsoever, in whose possession they may be found, any records, drafts, field notes or other papers, made, filed or kept by any former deputy surveyor, or which of right appertained to his office, in the same manner as the like documents may or can be recovered under the act, entitled • An act to enable persons appointed to offices of public trust, to recover official documents appurtenant to the said offices from persons detaining the same,' passed the 3d day of April 1804, from the persons therein mentioned.

Agreeably to order,

The Senate resolved itself into a committee of the whole, Mr. Lowrie in the chair, on the bill from the House of Representa tives, entitled

An act to declare certain creeks within this commonwealth public highways.'.

And after some time,

The committee rose and reported said bill with amendments. On motion,

The Senate resolved itself into a committee of the whole, Mr. Maghee in the chair, on the report of the committee appointed on the subject of the obstructions to the navigation of the river Delaware.

And after some time,

The committee rose and reported the resolutions attached to said report with an amendment.

WEDNESDAY, March 13, 1816.

Mr. Lowrie from the committee appointed for the purpose on the 19th of February last, made report which was read as follows, to wit.

That they are sensible of the weight of the subject committed to them, and have given to it all the consideration due to its importance. The happiness and prosperity of the people are so intimately connected with the prudent and impartial administration of justice, that the wisdom of the legislature can never be more nobly displayed, than in providing means adequate to the public necessity, for the dispensation of its benefits through every
